Background/Discussion
Mark Ruttger residing at 11287 205'h Ave NW in Elk River has requested that the City Council provide
direction on a Comprehensive Land Use change for his property and neighboring properties. Mr. Ruttger
is interested in changing his property to some type of a commercial use. In the memo provided by Mr.
Ruttger, he explains that the high traffic volUlnes in this area are more suitable for commercial uses rather
than residential uses. He further mentions that the new interchange would be beneficial to commercial
uses. These properties in question are surrounded by a gravel pit, concrete plant, trunk highway 169, and
County Road 121, providing easy access for commercial uses.

Overview/Analysis
Mr. Ruttger's property is less than half a mile from the Commercial Reserve area. The Elk River
Comprehensive Land Use Plan reserves land designated as Commercial Reserve for future commercial
development. The areas identified for Commercial Reserve lie adjacent to Highway 169 and Highway 10
outside the Urban Service Area, which are locations suited for highway business uses. Lack of municipal
utilities in this district does not support immediate development in these areas. The Commercial Reserve
land use designation allows planning to facilitate the desired form of development in the future. Planning
staff is currendy working on zoning language for the Commercial Reserve area.
It is important to note that this is not a formal request to amend the land use plan, and the City Council is
not obligated to approve a formal application once received. The concept review is beneficial for the City
Council (to be aware of major developments being contemplated and provide initial feedback), staff (to
understand CC concerns and desires with the project), and the applicant (to get an understanding of the
major issues observed by staff and the City Council). Following input regarding this discussion, staff will
work \vith Mr. Ruttger and neighbors towards development of a proposal that meets Council's stated and
published goals.
Recommendation
Staff is requesting direction and identification of concerns of a possible Comprehensive Land Use change
in the areas identified on the location map from Rural Residential to Commercial Reserve.

To The Members of the City Council:
My name is Mark Ruttger; I live at 11287 20Sth Ave NW.
I loosely represent my neighbors and myself in a proposed
change in zoning for a variety of reasons. This letter
comes at the request of the zoning department for the city
council members, as a concept review. Most of us have
lived in our homes for ten to twenty years now, and have
seen Elk River grow by leaps and bounds in this period of
time, with all kinds of commercial and a variety of
economic growth.
We all purchased our homes with the idea of having a
little taste of country living, but given the popularity of
this intersection it's getting impossible to have quiet
moment any longer. We have beepers from the heavy
equipment from the gravel pit, a personal address system
along with jack hammers coming from the concrete company,
truck horns and jake brakes. According to Sherburne County
Public Works, we have traffic numbers exceeding Three
Thousand on Highway 33 (20Sth Ave.), and greater than Forty
Thousand on Highway 169, making it impossible to sleep with
the windows open.
There is also a projected change merging Anoka County
Highway 22 (Viking Blvd.) with Highway 33 (20Sth Ave.)
resulting in even more traffic. There is also a proposed
medium commercial zone plan for the North West corner of
this intersection, and yet another commercial zone planned
one quarter mile North of properties in question.
Would it not be an advantage for commercial growth to
extend this zone to the South, past Highway 33, to better
meet the commercial needs? Thus giving companies better
access to the new overpass and gradually expand North from
here. Another advantage to rezoning these properties would
unlock an otherwise landlocked 20 acre parcel of land held
by the MNDOT directly West and South of properties 8 and 9
(see map). We also have a main gas line located next to
the properties to meet the future needs of companies.
I have been a contractor for over ten years now; I've
dealt with many realtors, contractors, and developers.
Even without the label of commercial property, I still get
inquiries about the property from time to time. If the
city council members felt the same way we do about this
matter, I truly believe we would have companies beating our
doors down to gain access to this land.
