MEETING OF THE ELK RIVER
BOARD OF APPEAL AND EQUALIZATION
HELD AT THE SHERBURNE COUNTY GOVERNMENT CENTER,
WEDNESDAY, APRIL 18, 2007

1. Call Meeting- To Order
Pursuant to due call and notice thereof, the meeting of the Elk River Board of Appeal and
Equalization was called to order at 6:30 p.m. by Mayor Klinzing.

Jerry Kritzeck, Sherburne County Assessor indicated that the purpose of the Board of
Appeal and Equalization is to consider and review 2007 estimated market values and
property classifications.
Information was presented on the assessment procedures and statistics for the City of Elk
River 2007 assessments.
The Council reviewed concerns from individual property owners.
1. Steve Rohlf, representing Scott Powell, Parcel Identification Number 75-011-
2325 and 75-011-2330
J\fr. Rohlf stated these two parcels increased in value by approximately 270% in one year. He
stated the parcels are metes and bounds and at this time he can't get a building permit on
them. He stated that in order to cover the increased cost of the taxes he would need to plat
this propetty now but he would like to wait for the city's concept plan for Gateway Business
Park.
Appraiser Cullen stated sales for similar properties that are platted, have sewer and water,
and are on comer lots came in with double sales figures than what he expected.
Mayor Klinzing stated it is difficult to compare these two parcels with platted parcels.

Councilmember Farber concurred and stated the 2700/0 increase was too dramatic of a
change in one year.

MOVED BY COUNCILMEMBER FARBER AND SECONDED BY
COUNCILMEMBER ZERWAS TO SET THE 2007 ASSESSMENT AT 30
PERCENT OVER THE 2006 ASSESSMENT, MOTION CARRIED 4-0.
2. Brent Richter, Parcel Identification Number 75-679- 0208
Tom Lucas, Parcel Identification Number 75-679-0210
Mr. Richter stated he believed the land value of these two parcels is assessed too high
because they are adjacent to a commercial area and don't own the river frontage.
Appraiser Olson stated the value for these two parcels was compared against two home sales
in the neighborhood.
Councilmember Gumphrey noted that the land values for Mississippi Ridge have gone down
over the last few years and the assessment for Mr. Richter is at its 2003 rate.
MOVED BY COUNCILMEMBER FARBER AND SECONDED BY
COUNCILMEMBER GUMPHREY TO HAVE NO CHANGE IN VALUATION
FOR BOTH OF THESE PARCELS. MOTION CARRIED 4-0.
3. Linda Schultz and Greg Anderson, Parcel Identification Number 75-549-0120
Ms. Anderson stated she purchased her property three years ago for $400,000 with the
intention of subdividing it. She stated she has since learned that she can't split the property
due to a developer's agreement. She further explained that extensive remodeling was done to
the house. She stated she tried to get green acres classification on her property but learned
she couldn't because it is platted.
Appraiser Olson stated the property is valued at $526,100 due to the remodel of the house.
He stated it is valued as single family residential and not as developable property. He noted it
is near the gun range. He further noted that a nearby parcel sold for $580,000.

4. Dave Aust, Parcel Identification Number 75-135-3306
Mr. Aust stated he felt his property was assessed too high.
Appraiser Quinn stated she could visit Mr. Aust's property to complete an inspection.
Mr. Aust was fine with having the appraiser out to his home.

COUNCILMEMBER MOTIN TO TAKE NO ACTION. MOTION CARRIED 5-0.
5. Appraiser Greg Olson presented a handout and reviewed a list of three
parcels to the Board of Equalization consisting of 75-128-4101, 75-773-0110,
and 75-506-0230.

7. Appraiser Riley presented a letter from Michael Leuer, Parcel Identification
Numbers 75-110-1401, 75-110-2410, 75-110-1400, 75-110-4101, and 75-110-4102
These parcels are considered aggregate land in a mineral excavation zoning overlay. Mr.
Leuer's letter appeals the valuations and classifications of his parcels but he has agreed to
submit soil boring information that shows there is no aggregate product on his parcels.

COUNCILMEMBER ZERWAS TO TAKE NO ACTION ON THESE PARCELS.
