SUBJECT: SANDPIPER ESTATES
RECOMMENDATION: Staff supports Option #2 as outlined by
Councilmember Dietz in his 8/29/94 memo to the Mayor & City Council. This
option calls for the extension of the trunk line through Sandpiper Estates (via
183rd Avenue) to the County property with no Sandpiper trunk assessments
and no lateral extensions into Sandpiper. This option is the easiest and the
one most requested to the staff by the citizens and property owners in this
vicinity. This proposal retains all of the City's and homeowner's options for
the future. It is also the most economical proposal from a City financial
point of view.

The original plan for the extension of utilities through Sandpiper goes back a
few years. This plan was for a complete installation of trunk, laterals, new
streets, and storm sewer. It is obvious that this original concept is not
acceptable to the property owners or to the City Council and, therefore,
something less than this full public improvement project needs to be
considered.
With each new compromise and option that is discussed by citizens, property
owners, and Councilmembers, it seems that more and more City funds are
put into this proposed project by way of subsidizing the improvements. The
City cannot afford some of these more expensive options. Additionally, a
precedent may be established with this project that could force the City's
hand from a financial perspective when it comes to future public
improvement projects.
If the City Council decides to assess some improvements to the Sandpiper
area (either trunk or lateral or street improvements), it is recommended that
these improvements not take place until 1995. In this manner the
assessments can be levied at the October 3 assessment public hearing and we
can determine how many of the property owners appeal their assessment.
Over the winter months, these appeals will go through the process and we
. will find out how many are successful. If a large number of appeals are

successful, the Council can then reevaluate whether or not the improvements
should actually be installed.
It is highly unlikely that there will be unanimous agreement from the
Sandpiper property owners for any option that is considered. In a similar
manner, it may be difficult for a unanimous vote from the City Council on
any particular option. When considering all the issues related to this project,
staff feels that John Dietz' Option #2 is in the best interest of the property
owners and the City.

RE: WESTERN AREA PHASE II IMPROVEMENTS
Dear Council Members:
As I understand, it is the City Council's intention to further discuss the issue of Sandpiper
Estates at Tuesday evening's meeting. I also understand that the options put forth by
Council member Dietz will be discussed in detail and residents of Sandpiper Estates will have
an opportunity to give their input to the issue. As you are aware, we will be opening bids
and presenting them at Tuesday evening's meeting. I would strongly encourage the City
Council to make a decision on the status of Sandpiper Estates prior to considering award of
the construction bids.
The decision that should be made prior to considering award of the bids is whether the
Sandpiper Estates lateral utilities and streets are in or out. If they are to be included in the
project, it is not critical that the funding or assessment of that portion of the construction be
determined. It is, however, somewhat important that a change order be written prior to
awarding the contract if some portion of the project is to be deleted.
I will be in attendance at Tuesday evening's meeting if you have any questions regarding this
issue.

IN ANSWER TO DON HEINZMAN'S REMARK "OWNERS IN THAT DEVELOPMENT
HAD TO HAVE KNOWN SEWER AND WATER WAS COMING". THE CITY COUNCIL
AND SHERBURNE COUNTY MUST HAVE KNOWN THEY CHOSE BUILDING SITES
THAT WERE NOT ON WATER AND SEWER .....THEY FIND IT EASY TO SPEND
TAX DOLLARS THAT TAXPAYERS HAVE WORKED SOH A R D FOR.
THE CITY HALL ALSO DID THE TAXPAYERS OF ELK RIVER A DISSERVICE
BY TURNING HIGH TAX REVENUE INTO ZERO TAX.
ASSESSMENTS RANGING FROM $13,000 TO $21,000 BECOME IMPOSSIBLE
TO PAY - - DOES ANY MEMBER OF THE CITY COUNCIL LIVE ON EITHER
OF THE PROJECT AREAS???? I DOUBT ANYONE HAS THE $13,000 OR
$21,000 TO PAY OUTRIGHT AND SAVE THE INTEREST - A $20,000
DOUBLES OVER A 10 - 15 YR. PERIOD.

WORKED "FOR THE PEOPLE" I SURE FOUND OUT THAT I HAVE BEEN WRONG.
THE LARGE PERCENTAGE OF TAX FOR THE SCHOOLS IS SPREAD OVER THE
ENTIRE COUNTY EVEN IF A PROPERTY OWNER DOES NOT USE THE SCHOOLS.
WHY NOT SPREAD THE ASSESSMENT FOR THE CITY HALL TO ALL ELK RIVER
RESIDENTS AND THE ASSESSMENT FOR THE GOVERNMENT CENTER TO ALL
OF SHERBURNE COUNTY. THESE WERE BOTH BUILT TO SERVE THE ENTIRE
CITY OF ELK RIVER AND THE GOVERNMENT CENTER SERVES BOTH COUNTY
AND CITY.
I AM ASKING TO HAVE THIS ON THE EDITORIAL PAGE OF THE PAPER
AND ALSO READ AT THE NEXT MEETING SET UP TO DISCUSS AND VOTE
ON THE SANDPIPER PROJECT.

Dear Council Members:
We have tabulated the construction bids for the Western Area Phase II bids opened on
Wednesday, August 31, 1994, at 10:00 a.m. There were a total of 11 bids received. The
following table provides a list of the bidders and their total bids:

The feasibility study for these improvements estimated the total construction cost at
$2,150,000. The low bid received from Barbarossa & Sons is approximately 9% below this
estimated cost. Barbarossa & Sons have previously completed similar projects satisfactorily,
and they were the contractor who completed the 1983 Lions Park, Elk River Mall Sewer,
Water, and Storm Sewer improvements. This is the project that constructed the large storm
sewer outletting to the Mississippi River by Old City Hall. Based on their low bid and
previous work on similar projects, we would recommend award to them as the lowest
responsible bidder.

Prior to awarding this project to Barbarossa & Sons, the City Council should make a
determination on whether the lateral utilities and street improvements for the Sandpiper
Estates area are to be included in the project. If, in fact, they are determined to be
eliminated from the project, the award should be contingent upon Change Order No.1 being
approved by the Contractor making this adjustment to the scope of the total project.
Attached for the City Council's consideration is a draft resolution which authorizes award
of the project to Barbarossa & Sons. I will be in attendance at your September 6, 1994, City
Council meeting should you have any questions regarding this issue.
