OVERVIEW
Last week, Kraus-Anderson was informed that Target would not longer be
pursuing a "super store" concept at Elk Park Center. Target has gone back to
their original proposal of a 90,000 square foot store, which is consistent with
the development plan originally approved by the City Council.
Given this turn of events, Kraus-Anderson has submitted a development plan
which is identical to the original plan approved by the City Council with the
following exceptions:
. Driveway onto Jackson Road would remain within the power line
easement, which is the location as approved on the development plan for
the super target concept.
. An easement along the north side of Target would need to be vacated and
reestablished within the power line easement.

. Target's lot line needs to be adjusted approximately fifty (50) feet for a
distance of three hundred (300) feet to correspond with the adjustment of
retail space.

The development plans submitted by Kraus-Anderson do not contain any new
elements the City Council have not seen in the past. However, one element
that has continued to change with each new development plan is the total
square footage has been reduced as follows:
. Original Development Plan (12/20/93)
. Super Target Dev. Plan (7/5/94)
. Current Development Plan (8/29/94)

337,900 Square Feet
311,393 Square Feet
SUMMARY
The new development plan is in keeping with the spirit and intent of the
previous plans approved by the City Council. The City Council did allow staff
the ability to make minor adjustments to the development plan without
coming before the City Council. However, the most current plan includes
elements of both plans approved by the Council and staff wanted to present
this to the Council to ensure a blending of the two development plans is
acceptable.

Several utility improvements have been installed at Elk Park Center and
Target is preparing to receive a building permit within the next week.
Kraus-Anderson is requesting the new development plan be accepted by the
City Council and allow the project to continue on schedule.
RECOMMENDATION
It is recommended the City Council approve the submitted development plan
which is within the spirit and intent of previous plans approved for Elk Park
Center PUD. On the other hand, if the Council feels this is a significant
change, staff should be directed to proceed with a formal amendment which
requires a public hearing before the Planning Commission and City Council.

Dear Mayor Duitsman and Members of the city Council:
It is my understanding the City planner will bring before you at
your next Council meeting our revised site plan for our Elk Park
Shopping Center. My purpose for writing you at this time is to let
you know of the many difficulties and frustrations we have
experienced in this development project and to ask for your
patience and cooperation.

We have changed our site plan back to what essentially was our
originally approved site plan with the minor exception of the
southerly access to Jackson Road. This access road to the rear of
our center was moved approximately 400 feet to the north. It was
approved on our site plan when we submitted a revised plan for a
Target superstore.
As you probably are aware at this time, for reasons we can only
specula te upon, Target has decided to cancel their plans for a
162,000 sq. ft. superstore and has reverted back to their original
plan to construct a 90,000 sq. ft. Target store. With changes of
this type, a developer really has no choice but to accept the
change. If a supermarket operator decides to locate elsewhere, a
developer has little choice but to find alternative users or adopt
a workable plan which addresses these problems.
We and Target would like to start constructing the Target store as
well as buildings "5" and "e" and the site improvement work from
our south property line through our Jackson Road access drive as
soon as possible. It is my understanding that the original Target
store which we will now be building has been submitted to the
building inspection department for plan review. It is our
intention to start that portion as soon as the plan review has been
completed and approved and a building permit issued.
We have been contacted by two major supermarket operators who have
expressed a high degree of interest in having a store on the
northerly portion of our land. I would expect we could finalize
this part of our development and begin building within the next 60

days. Our goal is to have a simultaneous opening of both elements
of the center in July of 1995, which is a date Target has set for
its opening,
I ask your cooperation in accepting these necessary changes which
have taken place in this shopping center development. These
changes are not of our choosing and have been very costly to us.
We want to finally begin construction of buildings as soon as
possible as we have experienced what happens on a project when it
is not started on a timely basis.
If there is any doubt in the mind of any city official whether this
project is worthwhile, I can only say that besides the millions of
dollars in taxes the project will bring in, we have also invested
$2.6 million in public improvements.
By developing our property, we have also made it possible for other
property owners in the area to develop their commercial property.
without our paying for utilities and Freeport Avenue, these
utilities would not be available for the other commercial property
in the area. In consideration of these other commercial
developments, I would ask the city council to afford them the same
fine cooperation you have extended to us; and conversely that they
not be assessed to any greater extent that we were for utilities
and other city services.

Ladies & Gentlemen:
An issue demands your immediate attention. The issue is
last week's construction project that reduced the outbound
(west bound) traffic lanes at the intersection of 169 and Elk
Hills Drive from 3 lanes to 2 lanes! This ill advised action
was taken at a time when traffic volume at that intersection
is increasing daily.
We either outright or through partnerships pay well over
$100,000 a year in taxes in Elk River. It is unacceptable to
us that the safety and convenience of the many customers to
our businesses that access Dodge Avenue via the 169 and Elk
Hills Drive intersection be so adversely affected. Also, the
many home owners and other residents on the east side of 169
have been adversely affected by this ill advised reconstruc-
tion of this intersection.
We urge you to insist that city staff immediately
undertake the rather simple project of adding a third west
bound lane on the east side of this intersection. This
additional lane should be a right hand turn lane.
The additional lane also serves to provide better
alignment of Elk Hills Drive with .the just constructed School
Street access to 169. Enclosed is a picture taken at that
intersection that clearly points out that a serious alignment
issue now exists. .
Thank you for your attention and support to correct this
serious safety and access issue.
