SUBJECT: PARK LAND OFFER BY SHIELY CO.

The Shiely Company has made an offer to the City of Elk River to dedicate
approximately 50 acres of park at this time, in lieu of some consideration of
future park dedication fees. Attached is a letter from The Shiely Company
regarding this offer. Also attached is a map showing the general vicinity of
the land they are offering to dedicate as park.

As you can see on the attached photo, the land Shiely is proposing to dedicate
to the City is heavily wooded. In fact, this land is an old growth oak forest
that is classified as threatened by the DNR. This woods was specifically
referenced in the City's Environmental Impact Statement on mineral
excavation and its preservation was encouraged in that document.
The boundaries shown on the attached maps and photo were developed by
Mike Niziolek, a biology teacher at Elk River Senior High. The 50 acres
proposed by Mr. Niziolek encompasses a good portion of the old growth forest
in this area. The parcel to the east of the proposed 50 acre park has also
been identified by Mr. Niziolek as high priority for preservation. Shiely is
open to negotiating an option, purchase agreement or first right of refusal on
this parcel, if the City wishes to acquire it
Another significant feature of Shiely's' property in this location is that there
is an approximately 150 foot elevation change from east to west along their
south property line. The area identified as high priority would make an
excellent trail corridor connecting Woodland Trails Park to Proctor Avenue.

The land between the western boundary of the proposed park and the City's
railroad hiking trail is currently owned by Elk River Country Club.
However, the proposed 50 acre park does attach to Woodland Trails Park via
the railroad hiking trail. The proposed park would make a logical extension
of Woodland Trails Park.

The Park and Recreation Commission reviewed this request and is
recommending the City accept the 50 acre parcel as park. They also
recommend the City try to negotiate a purchase agreement on the area
identified as high priority. The Park and Recreation Commission's
recommendation was based on the proposed park land being a significant
natural area that makes a logical extension of Woodland Trails Park.
Shiely Company currently own 938 acres within the City limits. The Park
and Recreation Commission felt comfortable that enough additional land
could be required of Shiely in the future to satisfy any additional park needs
that may arise on the remainder of their property.
The Planning Commission also reviewed this request. They concurred with
the recommendation of the Park and Recreation Commission and
recommended that the City Council direct staff to start negotiations with
Shiely so that there might be a resolution prior to Shiely's' conditional use
permit for mineral excavation being considered by the City Council on
September 19th.

SUBJECT: Shiely Company Mine Proposal
The Shie1y Company has been approached about participating with the city in the development of
a park along the southerly and possibly the westerly boundaries of the company's property in Elk
River. We are very interested in this type of cooperative venture in all of our communities.

As you may know, we have already volunteered use of our property for the local biathlon training
course. This is something that we have done through the auspices of the Boy Scouts of America
and the local chapter of the U.S. Biathlon Association. This arrangement has been a winner for all
parties involved. We would like to continue this type of community involvement.
In light of the very keen interest in preserving the old growth oak forest in the southwesterly
comer of the company's property, the Shiely Company would like to donate 50 acres in that area
for parks purposes. We propose that the city take this acreage in lieu of park dedication at the
time of development. This donation would be credited against the requirement for 10% land
dedication at the time of development, taking the 900 acres as a whole. In other words, an
additional 40 acres remains for dedication on the nonhero property.
In addition to this current donation, if there is interest in expanding this park area. we would be
happy to consider other ways in which the city could acquire additional park space.
