SUBJECT: BUDGET WORKSESSION
The City Council must approve a number of motions and resolutions at this
meeting in order for staff to prepare the necessary material for certification
to the County by 9/15/94. Please see the attached memo from the Finance
Director regarding these motions and resolutions.

The 8/29, 8/30, and 9/6 City Council budget worksession minutes outline how
the City budget has gotten to its current status. In review of my 9/1 memo
and Council decisions on 9/6, and excluding any use of City cash flow monies,
excluding the proposed $10,600 cut in the Council Contingency fund (page 5
of the 9/1 memo), and excluding any increase in Utilities contribution to the
City, then the gap that we are dealing with between proposed expenditures
and available revenues is $117,500.
Most of the budget balancing techniques that have been used by the Council
include use of equipment reserves in 1994, reducing some reserve and
Council contingency requests, financing items through the 1994 General
Fund Budget, delaying the hiring of new employees in 1995, shifting
expenses to the EDA, raising "growth" related revenues and increasing liquor
store transfers.
It should be noted that no capital outlay items have been cut from the budget
but some capital outlay items have been financed in 1994 to reduce the
budget gap. Also, $15,000 in smaller cuts throughout each individual
department has been accepted by the Council. These cuts will be made
mainly in the supplies, contractual services and conference categories.
I believe it will be necessary for the City to obtain additional revenues, to
make substantial cuts, or to raise additional tax revenues in order to balance
the budget. By raising additional revenues I am specifically referring to an
increased contribution from the Utilities Commission. If the Council is not
united in this Utilities request, then we should be prepared to make
. additional cuts or raise additional tax revenues, or use the cash flow reserve.

Anything short of a united Council request to the appointed Utilities
Commission is not likely to be successful.
Discussion has taken place regarding reducing the surface water
management levy, and, if this does take place, some of this reduced levy
amount could be shifted into the general fund to support City services. At
the end of my September 1, 1994, memo to the Council, I outlined additional
options for the Council to look at in order to balance the budget. These
options may still be viable and should be reviewed by the Council.
One scenario for the $117,500 gap looks like this:
$36,000........ increased Utilities contribution
$25,000........ additional tax revenues
$22,500........ use of cash flow funds
$10,600........ cut in Council contingency
$15,400........ cut in capital outlay/reserves requests
$ 8,000........ cut in sealcoating program

As the City Council is aware, it can approve a budget that is not balanced by
approving the expenditure level and adding cash flow reserves to the
revenues to match this amount. If this takes place, then budget adjustments
will be necessary after the September certification date and before the
December Truth in Taxation hearing.
One adjustment staff would like to recommend to the Council relates to the
police VCR camera. On 9/6/94, the Council authorized this purchase through
the use of undesignated equipment reserves. Last year, a VCR police camera
was authorized through the use of the self-insurance reserve fund and it is
suggested that we again use this fund for this camera rather than further
reducing the undesignated equipment reserve fund.

As you know, the maximum tax levy must be certified to the Sherburne
County Auditor on or before September 15. That means that at Monday
night's meeting there are several action items that the Council must take.
1. Debt Service Levies - Each year each of the debt service funds is
analyzed in order to determine whether the scheduled tax levy
needs to be adjusted either up or down. For taxes payable in
1995 there are three debt levies which require adjustment.

. 1991 Equipment Certificate . the scheduled levy of
$23,822 can be reduced by $5,000 to $18,822 as
adequate cash is available due to the 5 percent over
levy and a lower than anticipated interest rate on the
certificate.
. 1986 Improvement Bond - the scheduled levy of
$12,250 can be canceled as sufficient cash is available
from prepaid assessments.
. 1992C Improvement Bond - the scheduled levy of
$12,509 can be canceled as sufficient cash is available
and a Letter of Credit is in place to cover any potential
shortfalls.
2.
Truth in Taxation Public Hearing Date - The City is required to
hold its Truth in Taxation hearing and continuation hearing
between November 29 and December 19. There must be at least
five but no more than 14 business days between the initial and
the continuation hearings. Staff is proposing that the initial
hearing be scheduled for 7:00 p.m., on Monday, December 5, and
the continuation hearing, if necessary, on either December 12 or
December 19. If a continuation hearing is not necessary, it
would be appropriate for the Council to adopt the final levy and

budget at that meeting as those must be adopted at a separate
hearing. They cannot be adopted at the initial hearing.
· The Council is asked to make a motion setting the
initial and continuation budget public hearing dates in
order to comply with the Truth in Taxation Law.

Tax Levv Resolutions - There are three tax levy resolutions
which must be adopted prior to September 15. Two of those
levies are for the HRA and EDA, both of which have been
approved by their respective governing bodies prior to being
presented to the City Council. Both of the levies are at the
maximum amount allowed by law. The third resolution is the
resolution approving the proposed 1995 General Fund budget
and the maximum 1995 tax levy. The amount approved on this
resolution is the amount that will appear in the Truth in
Taxation notices. Also, the Council is reminded that it cannot
increase the levy above the maximum amount certified.
However, reductions can be made prior to adoption of the fmal
budget and tax levy.

Attached are copies of each of the resolutions which need to be
approved in order to certifY the 1995 tax levies. The City levy
resolution is based on the proposed amounts previously
discussed by Council. This resolution will be adjusted as
necessary based on Council decisions made prior to adoption of
the resolution.
In conclusion, motions on the debt service levies, a motion setting the Truth
in Taxation hearing dates, and adoption of the three attached resolutions
must be acted on by the City Council on Monday.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION AUTHORIZING THE PROPOSED TAX LEVY FOR
CALENDAR YEAR 1995
WHEREAS, the Elk River City Council has reviewed the City's
anticipated expenditures for all funds in 1994; and,
WHEREAS, the Elk River City Council has considered projected revenues
for all funds in 1995; and,
WHEREAS, revenues from sources other than property taxes are
sufficient to meet anticipated expenditures of all funds.
NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of
Elk River that the following amounts be levied as property
taxes payable in 1995.

A RESOLUTION APPROVING THE HOUSING AND
REDEVELOPMENT AUTHORITY 1995 TAX LEVY
WHEREAS, the Housing and Redevelopment Authority in and for the City of
Elk River has passed Resolution 94-1 authorizing a levy of
.0131% of the taxable market value of the City for various
redevelopment activities; and,
WHEREAS, the City Council of the City of Elk River has consented to this
levy.
NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of
Elk River that the Housing and Redevelopment Authority in
and for the City of Elk River certifY a levy of .0131 % of the
taxable market less Homestead and Agricultural Aids of 5605.00

ECONOMIC DEVELOPMENT AUTHORITY
WHEREAS, the City Council of the City of Elk River has received a request
from the Economic development Authority to levy a tax for the
benefit of the Authority in the amount of .01813% oftaxable
market value oftaxable property in the City for the year of
1995.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Elk River as follows: The City Council of the City of Elk River
proposes that a tax in the amount of .01813% of the taxable
market value in the City less Homestead and Agricultural
Credit Aids of 12061.00 be levied in the year 1995 for the benefit
of the City of Elk River Economic Development Authority to be
used for Economic Development Authority purposes as provided
under Minnesota Statute 469.090 et. sea.

The attached Utilities contributions information certainly does not tell the
whole story as each Utility has a unique relationship with its host
community. Also, not all of the highlighted Utilities are in a growth mode
such as what exists in Elk River. Nonetheless, this information from the
Minnesota Municipal Utilities Association offers some insight as to the
. amount offunds successful Utilities contribute to their host city. The Elk
River data on page 2 includes the DARE house contribution, labor, street
lighting expenses, electric donations for city facilities and cash.
