SUBJECT: UPDATE ON THE STATUS OF THE
221ST AVENUE PROJECT

City Attorney Peter Beck, is preparing the easement documents necessary to
complete a new alignment of 221st Avenue. Mr. Beck is also preparing a 10
foot utility easement, requested by the Elk River Municipal Utilities, to put
in a new 3 phase power line. Staff is hopeful that we will have these
easements executed so that the 221st Avenue project can be advertised for
bids this week or next.
Mr. Beck is also preparing agreements for Class V to be donated by adjacent
property owners. Originally, Midwest Asphalt indicated that they would give
2,000 tons of Class V. Barton Sand and Gravel said they would match this
offer. Midwest may renege on their offer, but Barton Sand and Gravel has
generously offered to supply the entire 4,000 tons, if necessary. Staff will
also need to get this resolved prior to bids being advertised.
Staff anticipates this project being completed this year. However, we are
going through the Wetland Conservation Act process because the new
alignment of 221st Avenue necessitates filling part of a wetland. If the
wetland process is appealed by someone, or some agency, it could delay
finishing the project until next year. Weather could also delay the
completion ofthis project.
As indicated in the attached memo from Terry Maurer, City Engineer, the
project will be designed so that the existing roadway may stay in use until
spring of 1995. After the project is complete, the old alignment of 221st
Avenue would be vacated to the adjacent property owners.
In summary, Staff feels this project should be started this year. Barring
issues out of the City's control, we are hopeful it will also be finished in 1994.

RE: 22lST PROJECT STATUS UPDATE
Dear Mr. Rohlf:
As your aware, the resolution of the wetland issue relative to 221st Street improvements is
well underway. The local governmental unit has met to discuss that, and the permit
application is in. As I understand from you, that permit could be issued as early as late
October. Anticipating that, we have proceeded to advertise the plans and specifications for
bids. The estimated bid date is October 12, 1994.
As you are also aware, City Attorney Peter Beck has received the legal descriptions for the
necessary easements, and is in the process of preparing the easement documents. Assuming
those can be signed within the next few weeks, we would anticipate a contractor could start
the work at the east end, staying away from the wetland until the permit is actually
authorized. Given reasonable fall weather, it is realistic to believe that the work would all
be completed by winter of 1994. We have set up the plans and specifications such that, in
the event that the wetland mitigation permit is held up, or weather prohibits the completion
of the project, the existing roadway would stay in use until spring of 1995, when the project
would then be completed.

RE: CONCORD STREET EASEMENT STATUS
Dear Council Members:
There were a total of IS easement documents sent to individual property owners on the
Concord Street project. Two property owners received two easement documents each.
There was also one individual who has a large parcel of property which only touches
Concord with a corner. It is questionable whether an easement is actually needed from this
individual. As of yesterday, only six easement documents have been signed and returned to
the City.
Yesterday, I met with Grace Ostien regarding the status of these easements. Grace reviewed
the file with me and recorded the names of the individuals who have not submitted their
easements as of yesterday. She indicated she would contact each of these individually to
determine the status. This morning I received a call from Sally Palmer, one of the
individuals who has previously submitted her easement. She asked if she could receive her
easement back. She was somewhat afraid that not all individuals would give their easements
and hers would be recorded without any road improvement being made. I directed her to
Sandy Thackeray, and told her she could either get the easement back or discuss the issue
with Sandy, because I believe the City will not record the easements unless the project is to
move forward.
At this point in time, staff is in a holding pattern waiting to see what happens with the
remainder of the easements. If you have any questions regarding this issue or the status of
the project, I will be in attendance at Monday evening's City Council meeting.

SUBJECT: UPDATE ON EDISON STREET;
RESIDENTS REQUEST FOR
RESURFACING
In late July, the City reviewed an informal petition from the residents of
Edison Street, Fillmore Street, and 153rd and 154th Avenues requesting a
street improvement. I prepared a preliminary cost estimate for the Council
on a two inch thick bituminous overlay and Class 5 shoulders.
On September 22, 1994, Terry Maurer and I will host an informal meeting
for the residents and give them the following information:

Such projects, in the past, have been assessed.
Assessments will be in the $1,500.00 range.
This project would be done in 1995.
A public hearing would be held by the City Council prior to the project
or assessments.
I will report the results of the informational meeting back to the Council in
about two weeks.

RE: GATES AVENUE I mIRD STREET INTERSECTION
Dear Mr. Klaers:
As you are aware, Councilmember Holmgren has previously suggested that the City investigate
cul-de-sacing Third Street east of Gates Avenue to at least temporarily improve the safety of
the intersection. With the increase of traffic, the offset nature of Third Street as it meets Gates
Avenue has become more of a concern. The City Council directed me to investigate the
opinions of the various people that would be affected by such a closure. In doing so, I
contacted Police Chief Tom Zerwas, Carol Mills (Executive Director of Guardian Angels), and
Cliff Skogsted, Fire Department member.
All three individuals were opposed to any closure of Third Street east of Gates A venue. Both
Chief Zerwas and Cliff Skogsted indicated that emergency vehicles utilize this route in
accessing both the Guardian 'Angels facilities and the apartments located on Third and Evans.
Both felt that during peak traffic times, to route emergency vehicles along Main Street to access
Evans Avenue would add significantly to the response time and possibly add a more dangerous
route for the emergency vehicle. Carol Mills was very opposed to the closure of Third Street
because it provides an access for elderly drivers to Main Street. Carol felt that it was just as
dangerous, if not more so, for an elderly driver to try to access Main Street via Evans Avenue.
All three of the individuals I contacted strongly suggested that the City pursue the realignment
of Third Street at Gates Avenue. As you are aware, this would require the acquisition of a
small amount of property on the north side of Third Street and would include the removal of
a large diameter tree.
At this point, I have not pursued with the property owner the potential of acquiring the amount
of land nece~sary for the realignment. Please let me know if you would like me to pursue this
issue further.
