Box 490 Elk River, MN 55330 RE: WESTERN AREA STORM SEWER Dear Mr. Klaers: Over the past several weeks, numerous accusations have been made regarding the storm sewer facilities in the western area of the City. These accusations are based on gross exaggeration or blatant untruths regarding the storm sewer. Thus far, I have chosen to ignore these issues, hoping that they would go away on their own. But now, I feel that it is appropriate that I respond in writing to the accusations that have been made directly to me or that I have heard. The following is a summary of the issues that I have heard and my response to each of these. 1. The trunk stonn sewer system on Orono Parkway should have been five feet deeper to provide service to a larger area. The water depth in the western portion of Lake Orono where the trunk storm sewer discharges is fairly shallow. Eighteen to twenty feet out from the outlet pipe, the water depth varies from 1.4 to 0.7 feet. Thirty feet out from the outlet pipe, the water depth is just barely over 2 feet deep, and fifty feet out from the outlet pipe, the water depth is still only 3 feet deep. It would have been physically impossible to lower this pipe 5 feet as has been suggested. The pipe possibly could have been lowered 0.5 to 1.0 feet more than it was. The elevation that the pipe is set at is the normal high water level for Lake Orono; thus, no Department of Natural Resources permit was required for this installation. During the design phase, we met and discussed with representatives of the DNR the potential elevation of the pipe. Given the small amount of lowering that we could have achieved, it was determined that it was better to set the pipe elevation at the normal high water level and not apply for a DNR permit which we may not have been granted. 230f223.190S.sep . Given the elevation of the trunk stonn sewer line in Orono Parkway, the pipe is too large and will never flow full; thus, extra monies were spent on pipe capacity which will never be used. Dave Nyberg of MSA, Consulting Engineers, and Jon Bogart of John Oliver and Associates have jointly worked through the design, Dave from the perspective of the overall City concept, and Jon from the perspective of the Tony Emmerich Country Crossings Development. These two have worked through the modeling of the storm sewer system in the Western Area and both have concluded that the pipe will not only provide adequate capacity for the Country Crossings single-family residential developments, but also will have additional capacity for the Sandpiper Estates area and minimal capacity for property lying north of Orono Parkway. They also agreed that the pipe will flow full in the lOO-year storm event. In fact, the actual outlet near Lake Orono will be slightly surcharged in the lOO-year event. 3. Flow from the southeastern portion of the Country Crossings First Addition is directed southerly through the Mississippi Oaks stonn sewer system because the stonn sewer pipe in Orono Parkway is too shallow. . Item #1 has previously discussed the depth of the storm sewer pipe in Orono Parkway. The City's Comprehensive Storm Drainage Plan has always showed a small portion of property north of County Road 30 being directed southerly through this trunk line to the Mississippi River. In fact, when this trunk line was put in, the cost of it was prorated against Mississippi Oaks, Heritage Landing, and the area north of County Road 30. The distribution was 29% to Mississippi Oaks, 49% to Heritage Landing, and 22 % for the area north of County Road 30. 4. The flow from north of County Road 30 is a 24-inch pipe outletting into a 24- inch pipe in Mississippi Oaks. The question which arises is whether there is adequate capacity for all this flow. There is, in fact, a 24-inch pipe being connected from Country Crossings First Addition. However, the pipe south of County Road 30 is 27 inches in diameter. The flow in a pipe is dependent not only on its size, but on the slope of the pipe. The 24- inch pipe exiting Country Crossings is relatively flat. The 27-inch pipe in Mississippi Oaks has approximately 2% times as much slope as the pipe from the north. There is adequate capacity in this pipe system to handle the flow from north of County Road 30. . 2301223.1905.sep -- . . . Mr. Pat Klaers September 19, 1994 Page Three 5. Country Crossings has not paid their Cair share to connect stonn drainage into the system flowing south to the Mississippi River. There has been a change in City policy as to the funding of storm sewer improvements since the time that this line was installed. At the time the line was installed, the City's policy was to assess these costs out. Since that time, the City has been exploring policies utilizing storm sewer impact fees, surface water management fees, and possibly tax levies. The new policies have been applied to Country Crossings First Addition. It should be noted that at the time that this pipe was originally installed, the City funded the portion of the cost attributable to properties north of County Road 30. If, in fact, there were to be an assessment to Country Crossings First Addition for their fair share, this would not result in a rebate to either Mississippi Oaks or Heritage Landing. It would, however, make the City whole for some of the costs that they have been carrying. 6. The stonn sewer policy change has placed Country Crossings at a competitive advantage versus Heritage Landing and Mississippi Oaks. In analyzing the cost of both Country Crossings and Heritage Landing, I believe the results indicate quite the opposite. Heritage Landing First and Second Additions are contained within a parcel property which is approximately 35.5 acres. The total trunk sanitary sewer and water cost assessed to this parcel was $134,227.69. Dividing this into the 86 tota110ts in the First and Second Additions, the trunk cost per lot is $1,560.79. The Lakoduk property, which consists of Country Crossings First Addition, is 40 acres in area and was assessed $150,860 for trunk sanitary sewer and water. After park dedication, 73 lots were platted. The total cost per lot is $2,066.58 for trunk improvements. Heritage Landing First Addition internal improvements with overhead resulted in an assessment of $8,551. 75 per lot. Country Crossings First Addition is being fmanced privately by the Developer, so it is difficult to project the overhead. If you assume this same 28 % overhead that was applied to Heritage Landing First Addition, the cost per lot for the internal improvements being currently constructed by C. W. Houle, is $9,571.30. This is after a trunk credit is applied for sanitary sewer, watermain, and storm sewer constructed by the Developer in Orono Parkway. In addition to these costs on Country Crossings First Addition, the development is being assessed $30 per foot for the construction of Orono Parkway and is obligated to pay one-half the cost for the construction of Joplin street and storm sewer from County Road 30 to Orono Parkway. The other half of this cost will be paid by Country Crossings Second Addition. The combination of half the cost of Joplin and $30 per foot for Orono Parkway results in an additional assessment of approximately $150,000. There were 230/223-1905."", . I believe it is clear from these numbers that Heritage Landing is not at a competitive disadvantage when the cost per lot for the various improvements is measured and compared. Box 490 Elk River, MN 55330 RE: WESTERN AREA DRAINAGE PLAN Dear Mr. Klaers: As you are aware, there have been some questions raised about the design of the trunk storm sewer system along Orono Parkway. This system is the primary means of storm drainage for the existing and proposed developments both north and south of Orono Parkway. Construction of the trunk storm sewer is part of the Western Area Phase II Improvements contract. During the past several weeks, we have been working with Jon Bogart, P.E., of John Oliver & Associates to both clarify our design intentions and to reach an agreement on drainage of future developments in the Western Area. This process is now complete. We offer this correspondence as a summary of the agreed-upon drainage plan for the Western Area. DRAINAGE AREAS The drainage plan includes areas from the City Hall property, Country Crossing First, Second and Third Additions south of Orono Parkway, Sandpiper Estates, Orono Third Addition, and also a portion of the properties north of Orono Parkway (see Exhibit). A hydrograph of each area was generated with the TR-20 computer program. Table I shows the internal peak flow generated from each area. Table 1. East 10 First South 28 First West 7* Third 44* City Hall Property 44 Orono Third Addition North 13 * The peak discharge from area 6 is attenuated by a storm drainage pond in the northeast comer of the Country Crossing First Addition. Likewise, the peak discharges from areas 2, 9, and 10 will also be attenuated by the large proposed storm drainage pond in Country Crossings Second Addition. Area 8, the southern portion of Country Crossing First Addition, drains through a separate storm sewer system. This system conveys stormwater to the south, away from the Orono Parkway trunk storm sewer. FUTURE DEVELOPMENT AND FLOW REGULATION . The areas north of Orono Parkway may develop in the future. Development would increase both the volume of runoff and peak discharges to the Orono Parkway trunk storm sewer. These areas include the Sherburne County property across from Country Crossing First Addition and also the future Country Ridge Partnership commercial property to the north of Country Crossing Second Addition (areas 3,5, and 7). The increased peak discharges and runoff volume will be attenuated through implementation of sedimentation! detention ponds that will reduce the outflow from each area to the discharges listed in Table 2 below. Drainage from Sandpiper Estates is included in the design of the trunk storm sewer. However, the proposed storm sewer collection system for Sandpiper Estates was recently deleted from the Western Area Phase II contract. Continuing to include the area in the design of the trunk storm sewer will enable Sandpiper Estates to be connected into the system in the future. Also included in the design of the trunk storm sewer is the discharge from the Country Crossings Second Addition proposed pond. This pond will receive stormwater from areas 2, 9, and 10 shown on the exhibit. Preliminary design of Country Crossings Second and Third Additions is complete at this time. TRUNK STORM SEWER DISCHARGES The peak discharge at the outlet of the 88" span arch pipe to Lake Orono is 136 cfs for a 100- year, 24-hour storm event. The downstream segment of the 88" span arch pipe, from the Police garage driveway to Lake Orono, has a slope of :1:0.09% with a capacity, under gravity full flow conditions, of :1: 108 cfs. Surcharging of the trunk storm sewer will occur along this segment for a lOO-year event. The upstream ponds at Country Crossing First and Second Additions, along with the future ponds in the areas north of Orono Parkway, have all been checked for acceptable high water levels based on the hydraulic grade line capacity of the trunk storm sewer. Although the trunk storm sewer is surcharged at the outlet, each pond functions correctly, providing adequate freeboard below the proposed homes surrounding each pond. CONCLUSION The above information provides proper guidance for continued development of the areas tributary to the Orono Parkway trunk storm sewer. Preliminary design of the areas south of Orono Parkway is already complete. However, planning has not yet started, or has recently started on the areas north of Orono Parkway. As the areas north of Orono Parkway develop, the allowable peak discharges listed in Table 2 provide the framework to begin storm drainage planning for each of those areas.
