Wetland Replacement Plan for the City of Elk
River, 221st Avenue realignment
As a follow-up to the Technical Evaluation Committee meeting
held yesterday in your office, the city may wish to pursue
an Army Corp of Engineers permit #3. This permit is
exempted from the Wetland Conservation Act. If the permit
is denied, and since this road work is for safety reasons,
it appears that no feasible or prudent alternative exists to
filling in a portion of the wetland. The city's replacement
plan does appear workable and should meet the goals and
objectives of the Wetland Conservation Act.

The above referenced application was received by the Coordinator's office and
forwarded to me for review. When reviewing it, the following observations were
made:
no legal descriptions included for either site
no aerial photograph included for the impacted site
no soil maps for the impacted or replacement sites
best management practices were not discussed
no alternatives were discussed
permit from the Army Corps of Engineers is not mentioned
a map, photo or written description of land use in the immediate area within
one mile of the impacted site was not included
no monitoring plan was attached
scale drawings showing plan and profile views of the replacement site in
section 28 are not included
Without the above mentioned items, proper review of the proposed project is
difficult. If you have any questions, feel free to give me a call.

RE: WCA Replacement Plan - Riverside Development,
Hillside Estates, Elk River, Sherburne County
Dear Mr. Schmitz:
In regards to the development of Hillside Estates, our comments from the Division of Waters of
DNRare as follows:
According to the Replacement Plan, the wetland to be created will have a bottom, elevation
similar to an adjacent wetland. Elevations on both wetlands should be documented. Also, the
created wetland must be dug deeper to compensate for the eight (8) inches of organic soil that
will be placed on the bottom. The finished bottom elevation should consider the placement of
the organic material.
Division of Wildlife Comments:
The development of Hillside Estates meets with approval; however, wetland mitigation should
focus on restoration instead of creation by excavation.
The DNR appreciates the cooperation of you and your staff in reviewing the wetland replacement
project. Our objective as a reviewing agency is to help ensure that the goals of the Wetland
Conservation Act are met. '

As follow-up to the Technical Evaluation Committee meeting
held yesterday in your office, the wetland replacement plan
submitted by Riverside Development appears to avoid and
minimize the wetland impact. Also, it seems that no prudent
and feasible alternative exits for extending 193rd Avenue.
Based an the information provided, the plan appears workable
and should meet the goals and objectives of the Wetland
Conservation Act.
I would also like to add that it is crucial the side slopes
be mulched, particularly on the east side. Until the
vegetative cover is established, these slopes will be highly
erosive.
