SUBJECT: MODIFICATION TO EDA ENABLING
RESOLUTION
INTRODUCTION
.
On Monday, October 17, 1994, the Elk River City Council will be asked to
schedule a public hearing to consider a modification to the Resolution which
created the Economic Development Authority for the City of Elk River. The
proposed modification relates to the initiative of adding at least one more at-
large Commissioner at the expense of reducing the number of City Council
members on the EDA.
BACKGROUND
The current composition of the Elk River EDA is that of a seven member
Board of Commissioners; five of which are City Council members and two of
which are non-elected residents who serve in an at-large capacity. A seven
member EDA is the statutory maximum. Further, State Law provides that
at least two of the seven Commissioners must be members of the City
Council. This requirement helps ensure a checks-and-balance system.

Minnesota Statutes addresses how an Enabling Resolution can be modified.
It requires that a City Council conduct a public hearing on the proposed
modification, after the notice of the public hearing is published once a week
for two consecutive weeks. The first publication must appear not more than
thirty days from the date ofthe public hearing.
With that background, the following timetable is offered:
October 17. 1994 - City Council meeting - City Council sets public
hearing date on proposed modification to the Enabling Resolution

October 26. 1994. and November 2. 1994 - Hearing notice is published
two consecutive times in the Elk River Star News
November 7. 1994 - City Council conducts public hearing on proposed
modification
November 8 - December 31. 1994 - Solicit candidates for Mayoral
appointment (with Council approval) to the Elk River EDA
January 9. 1995 - EDA annual meeting; Election of officers, etc.
ACTION REQUESTED
The Elk River City Council is asked to set a public hearing for November 7,
1994, to consider a modification to the EDA's Enabling Resolution whereby at
least one more non-elected, at-large Commissioner would be added to the
EDA - thereby reducing the number of City Council members on the EDA.
