Terry Maurer met with a number of the property owners on Tuesday, 10/4/94, and I believe everyone along Concord Street now has a better understanding of the scope of the project and some of the difficulties in getting this project accomplished. At the 10/17/94 City Council meeting, Terry should have more information to present to the Council on the number of easement documents that have been received. P.O. Box 490 Elk River, MN 55330 RE: CONCORD STREET EASEMENTS Dear Mr. Klaers: As directed by the City Council, I have attempted to contact each of the property owners on the Concord Street project. As you are aware, this is the private street in the northern part of the City where the residents have submitted a petition asking for the City to upgrade the road to a bituminous surface and take over the ongoing operation and maintenance. We are currently in the process of trying to obtain the right-of-way easements from the 14 parcels involved. The 14 parcels are represented by 12 different property owners. Two property owners own two parcels each. On Tuesday, October 4, I attended a neighborhood meeting at the Ostien property at 20842 Concord Street. Properties represented at that meeting included Palmer, Haaland, Smith, Ward, Madden, Ostien, and Schaefer. There were a number of questions asked relative to acquiring the easements, construction activities, drainage improvements, assessments against 12 versus 14 parcels, timing of the project, and whether or not the City would pursue condemnation should the majority of easements be granted and a minimal number outstanding. I did my best to try to answer the questions based on the information available. At the close of the meeting, Grace Ostien gave me her signed easement, Kathy Smith indicated she would sign her easement, Derek Ward was noncommittal whether or not he would grant his. I indicated that we would wait another 7-10 days and then report back to the Council as to the status of easements. After the meeting, I stopped at the Sohns residence and talked with Julie. She indicated that her husband was handling this issue. I left a business card and asked that he give me a call just to indicate whether or not he was in favor of proceeding and granting the easement. As of this time I have not heard from Mr. Sohns. I also stopped at the Robert Johnson property. They have recently purchased the Lehn property. Mr. Johnson had not previously been sent a deed because it was sent to the previous owner's attention. On Tuesday, I did drop off a cover letter and an easement document. No one was at home at that time and as of yet I have not received any calls from Mr. Johnson. I also stopped at the Zehowski property and . Mr. Pat Klaers October 5, 1994 Page Two talked with AI. He had numerous questions which I attempted to answer. He seemed to be somewhat negative toward the project, but indicated he would discuss it with his wife and decide whether or not he would submit the easement.' The only other property owners that were not contacted on Tuesday were David Carlson and the Nelson property, both of which have previously submitted signed easement documents. It would be my perception from the individuals I have talked to that there may be two to four property owners that will not submit signed easement documents for one reason or another. I would recommend that we wait approximately 7-10 days and see how 'many easement documents are submitted. At that poL.t, it may be appropriate to'report back to the City Council on the status.
