ANALYSIS
A thirty foot drainage and utility easement was dedicated as part of the Oak
Park Plaza Plat. During review of that plat, there was discussion regarding
the natural ridge along the southeast property line. This easement was put
in place to identify a buffer zone and protect the ridge line from development.
Riverside Development is requesting to vacate this easement to accommodate
some concept plans to develop the property with office buildings. Staff has
indicated to the developers that protecting the ridge and wooded area is a
primary concern with developing this site. On the other hand, a development
of office buildings provides a ideal transition between the commercial and
residential area to the east. However, under the present zoning of C3
(Highway Commercial), several uses other than office could be developed on
the property; therefore, the natural ridge should be protected in its entirety.

Riverside Development's immediate plans are to plat one commercial lot at
the south end of the subject parcel. Within that proposed lot is a small
segment of the 30 drainage utility easement. This area could be vacated at

this time to accommodate Riverside Development's immediate plans since the
actual ridge line is not as pronounced at this location as it is further north
and east. Conversely, the remaining portion of the 30 foot drainage utility
easement is within a proposed outlot that will need to be replatted prior to
any development. Therefore, one option could be to leave the 30 foot
drainage and utility easement in place and consider vacating the appropriate
areas at the time a development plan is submitted that respects the ridge
line. Therefore, if this property is ever sold to another developer, a clear
message will be sent that the natural ridge and wooded area should be
preserved to provide a buffer between the commercial and residential.
PLANNING COMMISSION RECOMMENDATION
Although the Planning Commission did not review this specific application, a
preliminary plat was reviewed by the Planning Commission. The
preliminary plat encompasses Outlot A of Oak Park Plaza as well as Outlot A
of Cherryhill Bluffs. During the review of that preliminary plat, the
Planning Commission did approve the plat with the condition that the
drainage and utility easements be retained to protect the ridge along the
southeast property line.

RECOMMENDATION
It is recommended that the City Council approve Resolution 94-_,
vacating only that portion of the 30 foot drainage and utility easement that
extends into the proposed Lot 1, Block 1, of Hillside Crossing South Addition.
The balance of the drainage and utility easement should be retained until a
development plan and replat ofthe outlot is submitted to the City.

RESOLUTION NO. 94-
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
WHEREAS, the property owner abutting the drainage and utility easement have
requested the City Council in an application dated August 30, 1994,
to vacate such easement according to law; and,
WHEREAS, a public hearing was held on October 17, 1994 before the City
Council at the Elk River City Hall on such application after due
published and posted notice had been given as well as personal
notice to affected property owners on September 20, 1994, and all
persons interested were given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such application.

NOW, THEREFORE, BE IT RESOLVED that such application is hereby granted
and the drainage and utility easement described as follows is
hereby vacated:
See attached Exhibit A.
