ANALYSIS
This request by Riverside Development is being done in conjunction with a
request to amend the land use plan, rezone and replat a portion of Oak Park
Plaza. The specific area requested to be vacated is approximately 100 feet
wide and parallel to the southeast property line of Oak Park Plaza. This area
also coincides with the requested rezoning application submitted by Riverside
Development.

As outlined in the previous item presented to the City Council, the southeast
property line of Oak Park Plaza is an area that has a natural ridge line along
with a significant stand of trees. Ideally, this natural buffer should be
preserved to maintain an aesthetically pleasing buffer between the
commercial and residential. In addition, there are areas proposed to be
vacated that need to be retained to cover the mitigation area, storm water
ponding and storm sewer extension from Hillside commercial north of 193rd
Avenue. Terry Maurer has indicated that retaining the drainage and utility
easement on Outlot A of Cherryhill Bluffs will allow for full utilization of the
outlot as a regional ponding site. The area of the drainage and utility

easement requested to be vacated is currently zoned residential. A
forthcoming application by Riverside Development is to rezone this area to
commercial. By vacating the easements and rezoning the property, there is
the potential for expansion of the commercial development closer to the
residential area to the east.
RECOMMENDATION
It is recommended that the City Council deny Resolution 94-_, vacating
the drainage and utility easement within a portion of Outlot A, Cherryhill
Bluffs Addition, based on the following:
1. The drainage and utility easement is needed for storm water ponding,
storm sewer improvements and mitigation area.
2. The drainage and utility easement currently protects a portion of the
ridge line from development activity, therefore contributing to
preserving a natural buffer between the commercial and residential
areas.

RESOLUTION NO. 94-
RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
WHEREAS, the property owner abutting the drainage and utility easement have
requested the City Council in an application dated September 9,
1994, to vacate such easement according to law; and,
WHEREAS, a public hearing was held on October 17, 1994 before the City
Council at the Elk River City Hall on such application after due
published and posted notice had been given as well as personal
notice to affected property owners on September 16, 1994, and all
persons interested were given an opportunity to be heard; and,
WHEREAS, it appears that it will be in the best interest of the City to approve
such application.

NOW, THEREFORE, BE IT RESOLVED that such application is hereby granted
and the drainage and utility easement described as follows is
hereby vacated:

That part of Outlot A of the duly recorded plat of CHERRYHILL
BLUFFS, Sherburne County, Minnesota; and that part of the West
Balf of the Southwest Quarter of Section 27, Township 33,
Range 26, said Sherburne County; described as follows:
Beginning at the Southwest corner of Lot 3, Block 1, said
CHERRYHILL BLUFFS; thence North 88 degrees 14 minutes 17
seconds East along the South line of said Lot 3, Block 1, for
a distance of 65.00 feet; thence South 1 degree 45 minutes 43
seconds East for a distance of 241.48 feet; thence South 87
degrees 18 minutes 28 seconds West for a distance of 330.92
