SEPTEMBER 19TH CITY COUNCIL MEETING At the September 19th City Council meeting, the Council decided to allow Country Ridge Partnership an opportunity to submit to the City a plan illustrating how they would like their property to be developed. Attached is a map submitted by Country Ridge Partnership, illustrating their preferred zoning of the property. Essentially, 13 acres along Highway 10 would be P.O. Box 490. 13065 Orono Parkway · Elk River, MN 55330 · (612) 441-7420 · Fax: (612) 441-7425 . commercial (C3-Highway Commercial) and the balance (15 acres) would be rezoned to Business Park. ANALYSIS According to the zoning proposed by Country Ridge Partnership, it is likely the business park area would have to have access off of Joplin and/or 183rd Avenue. Staff has all along expressed concern with access off 183rd because this will mix industrial/office traffic with residential and would be inconsistent with the design of 183rd which is proposed as a residential street. On the other hand, iftraffic accessing the business park area was limited to the frontage road along Highway 10 or Joplin, a better landscape buffer could be accomplished along 183rd Avenue to separate the light industrial and residential land uses. . Furthermore, according to the business park zoning ordinance, commercial that complements the business park uses is allowed. Therefore, staff is not necessarily opposed to commercial as long as it is done in accordance with the business park standards. The area designated for commercial use should be configured in such a manner that it will not prevent a contiguous extension of the business park area to the west. The proposal by Country Ridge Partnership seems to isolate their 15 acres of business park from the rest of the business park area to the west. Therefore, it may be more appropriate to adjust some of the commercial from the Highway 10 frontage road to a location along Joplin Street, and expanding the business park up toward the Highway 10 frontage road. Attached is the report to the City Council dated September 19, 1994, containing information relative to the proposed rezoning. Please refer to that report as well as the attached Planning Commission report for background information and other analysis regarding the rezoning. SUMMARY In closing, Country Ridge Partnership's property currently has a land use and zoning designation which limits the allowable uses to light industrial with no commercial. The request to rezone the property to BP (Business Park) would allow those same industrial uses including some limited commercial. Therefore, the BP zoning designation will accomplish the following: . expand the opportunity to develop industrial and limited commercial uses; . s:council:zc94-10x . . establish clear develop standards and allowable uses within BP district; . provide the opportunity for the City and involved property owners to develop a high quality mixed use business park; and, . establish a large area with a consistent zoning designation for development that will be compatible with and responsive to the surrounding area. RECOMMENDATION It is recommended that the City Council approve Ordinance 94-_, rezoning approximately 150 acres from PUD (planned Unit Development) and C2 (Office District), to BP (Business Park). . . s:council: zc94-10x . ORDINANCE 94 - CITY OF ELK RIVER AN ORDINANCE AMENDING THE CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTY FROM PUD (PLANNED UNIT DEVELOPMENT) AND C2 (OFFICE DISTRICT) TO BP (BUSINESS PARK) CASE NO. ZC 94-10 The City Council of the City of Elk River does hereby ordain as follows: Section 1. The duly adopted Zoning Map of the City of Elk River is hereby amended to rezone the property described as: See Attached Exhibit A . from PUD (Planned Unit Development) and C2 (Office District) to BP (Business Park) based on the following findings: 1. The BP (Business Park) zoning designation will implement the concept of a BP (Business Park) as discussed in the 1990 Focus Area Study and adopted by the City Council in September, 1990. 2. The rezoning will be consistent with the comprehensive land use plan map. 3. The rezoning to BP (Business Park) will provide for continuity in the zoning map as well as provide for compatible development under the BP (Business Park) zoning standards with the adjacent land uses. 4. Increased development interest in the western part of the City constitutes a change of circumstances and conditions requiring that properties in this area of the City be rezoned to the appropriate zoning district so that development will be compatible with surrounding development and consistent with the City's adopted comprehensive land use plan. 5. The rezoning is consistent with action taken by the City Council on September 17, 1990, whereby Ordinance 90-35 was adopted . Ordinance, ZC 94-10 Page 2 . rezoning properties to Business Park. However, this ordinance was superseded by Ordinance 90-40 establishing a PUD (Planned Unit Development) designation because the City did not have a BP (Business Park) zoning text in place. Section 2. Public Hearina, Case No. ZC 94-10 rc@/PJr Steven Ach, City Planner. stated that the City is requesting a zone change of approximately 150 acres from PUD (Planned Unit Development) and C2 (Office District) fo BP (Business Park) for properties lying soufh of US Highway 10 belween Joplin Street extension and Waco Street. Steve Ach explained that the 1990 Focus Area Study identified a portion of the western area of the community for light industrial with a PUD zoning. Since this designation. the Steering Committee and the Business Park Task Force have identified this property for business park industrial opportunities. with a zoning of Business Park. Steve Ach indicated that a Business Park zoning designation allows for mare land use opportunities than the current zoning designation of PUD and land use of LI. Chris Kreger indicated that the Planning Commission unanimously supported the request to rezone the identified property to Business Park. Mayor Duitsman opened the public hearing. Jay Johnson, of Country Ridge Partnership indicated that a partion of property owned by Country Ridge Partnership is included in the rezoning request. He indicated that he would like the Council to delay the rezoning to give them time to bring forward their own applications for the property. . Stewart Wilson. 17975 Troy Street, indicated he is the owner of a portion of the property proposed for rezoning. He requested that the Council consider moving the proposed rezoning line slightly to the north of his property to allow a larger area for residential development. The southern border of the BP zone would extend directly west of the southwest corner of the County Government property. He further indicated that he is in favor of the business park rezoning. Pat Dwyer. Business Park Task Force Member, indicated that the Business Park Task Force would like to see the Council move forward with rezoning the property to Business Park. There being no further comments, Mayor Duitsman closed the public hearing. Councilmember Holmgren suggested that the three week delay which has been requested by Country Ridge Partnership is not unreasonable considering that they own a portion of the property under consideration for zone change. Council member Scheel indicated she would be opposed to the rezoning because Tony Emmerich owns a portion of the land under consideration for rezoning and he is opposed to the rezoning at this time. . City Planner Steve Ach distributed a letter of support for the zone change to Business Park from the Elk River Area Chamber of Commerce dated September 16.1994. . . . In 1990, a Focus Area Study was completed by BRW, Inc. which identified circulation patterns and land use opportunities in four (4) primary areas of Elk River, including the western area of the community. One of the major land use elements discussed centered on creating a business park, providing for the development of light manufacturing, office, and limited commercial uses. At the time this concept was discussed and adopted by the City Council, the land use designation of LI (Light Industrial) and zoning of PUD P.O. Box 490 . 13065 Orono Parkway. Elk River, MN 55330 . CC, Ordinance - ZC 94-10 September 19, 1994 Page 2 (planned Unit Development) were interim designations the City indicated for the intended land use as a business park. As such, the area identified in the Focus Area Study intended for the business park was rezoned PUD (Planned Unit Development) by the City Council with an underlying land use of 11 (Light Industrial). During the latter part of 1993, the Business Park Task Force participated in drafting a business park zoning ordinance, which was presented to the Planning Commission and City Council for consideration. Subsequently, 011 January 18, 1994, the City Council adopted a Business Park Zoning Ordinance which sets forth allowable uses and development standards for a business park. This ordinance was a follow-up to the Focus Area Study which recommended the City create a business park ordinance to be implemented in those areas Intended for business park. SUMMARY OF PLANNING COMMISSION MEETING The Planning Commission received comments from three parties on this matter. The first was from a resident in Sandpiper Estates who opposed the rezoning because of the possible uses allowed in the Business Park Ordinance. It was pointed out to the resident that the uses allowed in the business park zone are very similar to what could be developed under the present zoning and land use designation. Secondly, a letter from Guardian Angles was received expressing their support for the rezoning as the business park would be a complimentary neighbor to their future development plans. Lastly, Stewart Wilson, who owns approximately 80 acres that is directly affected by this rezoning, expressed his support for the rezoning to BP (Business Park) with one exception. Mr. Wilson asked if the proposed business park zoning line could be adjusted to extend directly west from the southwest corner of the County Government Center's property. This adjustment would provide for a larger area for residential development while maintaining the integrity of the business park district. The Planning Commission discussed the importance of establishing property for industrial development, therefore, unanimously supported the request to rezone the identified property to BP (Business Park) including Mr. Wilson's request to amend the proposed zoning line. STEERING COMMITTEE AND BUSINESS PARK TASK FORCE Both of these groups discussed the need to preserve lands within the community for a well balanced mix of light, medium, and business park industrial opportunities. The Business Park Task Force in particular, has zc94-10.council CC, Ordinance - ZC 84-10 September 19, 1994 Page 3 . spent a great deal of time researching opportunities for industrial development within a campus setting. The Task Force has identified the subject area for business park use based on previous reports, including the Focus Area Study prepared by BRW in 1990 and the current zoning and land use designation. At an August meeting, the Business Park Task Force agreed to support the City's request to rezone the identified property to BP (Business Park) to provide for high quality industrial development opportunities along with supporting commercial. ANALYSIS . Currently, the property has a land use designation of LI (Light Industrial) and zonin'g of PUD (Planned Unit Development). The only exceptions to this are the County Government Center, which has a zoning of C2 (Office District) . and underlying land use of P (public), as well as the southeast corner of Waco Street and US Highway 10, which has a land use designation of HB (Highway Business). Those properties that currently have a land use designation of LI (Light Industrial) and zoning of PUD (planned Unit Development) can be developed today as a light industrial PUD (planned Unit Development) very similar to a business park. However, under the present circumstances, no commercial uses are allowed. The adopted' Business Park Zoning Ordinance allows for a broad range of uses ranging from light industrial to a mixture of commercial businesses that would compliment the industrial park. In this sense, the Business Park Zoning designation allows for more land use opportunities than the current designation of PUD (Planned Unit Development) and land use designation of LI (Light Industrial) zoning. The reason to bring this rezoning application forward at this time IS threefold: · To implement the business park concept discussed in the 1990 Focus Area Study and adopted by the City Council. . Rezone those properties that have a underlying land use of LI (Light Industrial) to bring the zoning map into compliance with the land use plan map. . . Establish appropriate zoning designations within the western area in anticipation of the imminent development activity as a result of the current plans to extend City water and sewer into the next phase of the western area. zc94.10.council . . . In 1990, a Focus Area Study was completed by BRW, Inc. which identified circulation patterns and land use opportunities in four (4) primary areas of Elk River, including the western area of the community. One of the major land use elements discussed centered on creating a business park, providing for the development of light manufacturing, office, and limited commercial uses. ZC 94-10 August 23, 1994 Page 2 Council, the land use designation of LI (Light Industrial) and zoning of PUD (Planned Unit Development) were interim designations the City indicated for the intended land use as a business park. As such, the area identified in the Focus i\J:ea Study intended for the business park was rezoned PUD (Planned Unit Development) by the City Council with an underlying land use of LI (Light Industrial). During the latter part of 1993, the Business Park Task Force participated in drafting a business park zoning ordinance, which was presented to the Planning Commission and City Council for consideration. Subsequently, on January 18, 1994, the City Council adopted a Business Park Zoning Ordinance which sets forth allowable uses and development standards for a business park. This ordinance was a follow-up to the Focus Area Study which recommended the City create a business park ordinance to be implemented in those areas intended for business park. STEERING COMMITTEE As part of updating the comprehensive plan, the Steering Committee, on May 25, 1994, discussed industrial development within the City. Several issues, including the benefits and opportunities for industrial development were discussed.. The Steering Committee had some summarizing. comments relative to the need to preserve lands within the community for. a. well balanced mix of light, medium, and business park industrial opportunities. Furthermore, the Committee recognized that the development of industrial property takes a longer amount of time than commercial and the opportunities for industrial should be preserved to allow for the overall proper land use mix of residential, commercial, and industrial. BUSINESS PARK TASK FORCE The Business Park Task Force has been given the challenge to explore industrial development opportunities for the community. As mentioned above, the Business Park Task Force was involved in the creation of the Business Park Zoning Ordinance and had focused for its implementation in the western area of the community upon those properties which are currently zoned PUD (planned Unit Development) with an underlying land use of LI (Light Industrial). The Task Force focused on these areas because of the studies performed by BRW in 1990 and to continue moving forward with implementing a business park concept_ At an August 16, 1994, meeting the Business Park Task Force agreed to support the City's requests to rezone certain properties to the BP (Business Park) zoning designation (see attached memo from Bill Rubin). zc94-10.pc Planning Commis~lOn, ZC 94-10 August 23, 1994 Page 3 ~--._--._-_._--_._.______...a..______..______ . ANALYSIS Currently, the property has a land use designation of LI (Light Industrial) and zoning of PUD (Planned Unit Development). The only exceptions to this are the County Government Center, which has a zoning of C2 (Office District) and underlying land use of P (public), as well as the southeast corner of Waco Street and US Highway 10, which has a land use designation of HB (Highway Business). Those properties that currently have a land use designation of LI (Light Industrial) and zoning of PUD (planned Unit Development) can be developed today as a light industrial PUD (planned Unit Development) very similar to a business park. However, under the present circumstances, no commercial uses are' allowed. The adopted Business Park Zoning Ordinance allows for a broad range of uses ranging from light industrial to a mixture of commercial businesses that would compliment the industrial park. In this sense, the Business Park Zoning designation allows for more land use opportunities than the current designation of PUD (planned Unit Development) and land use designation of LI(Light Industrial) zoning. . The reason to bring this rezoning application forward at this time IS threefold: ".7:.;~' . .., . . To implement the business park concept discussed in the 1990 Focus Area Study and adopted by the City Council. ':';::..: . Rezone those properties that have a underlying land use of LI (Light Industrial) to bring the zoning map into compliance with the land use plan map. . Establish appropriate zoning designations within the western area in anticipation of the imminent development activity as a result of the current plans to extend City water and sewer into the next phase of the western area. For the most part, the Planning Commission and City Council have not taken action on rezoning requests that may have an impact on the outcome of the Comprehensive Plan update. The BP (Business Park) zoning designation will implement the concept of a BP (Business Park) as discussed in the 1990 Focus Area Study and adopted by the City Council in September, 1990. 2. The rezoning will be consistent with the comprehensive land use plan map. 3. The rezoning to BP (Business Park) will provide for continuity in the zoning map as well as provide for compatible deve10pment under the BP (Business Park) zoning standards with the adjacent land uses. 4; Increased development interest in the western part of the City constitutes a change of circumstances and conditions requiring that properties in this area of the City be rezoned to the appropriate zoning district so that development will be compatible with surrounding development and consistent with the City's adopted comprehensive land use plan. 5. The rezoning is consistent with action taken by the City Council on September 17, 1990, whereby Ordinance 90-35 was adopted rezoning properties to Business Park. In mid-1993, the Elk River Economic Development Authority (EDA) established a Business Park Task Force" to "examine the community's inventory of improved, industrially-zoned property and to bring forth "" recommendations on how to best e>"lland upon this inventory for future users. . One product of the Task Force has been the development of a B-P: Business Park Ordinance for inclusion in Elk River's zoning code. This Ordinance was subsequently adopted by the City Council in January, 1994. The TaskForce has also looked. at various development options which range from the private sector' taking the lead ill owning and marketing the" next industrial parklbusiness park to the EDA developing a business park area as a public endeavor. Financing these options has also been explored by the Task Force. At its meeting on August 16, 1994, the Task Force discussed the proposed rezoning of various sites in the western part of the community to reflect the" B.P, Business Park designation. BACKGROUND In 1990, a Focus Area Study was completed by BRW Inc., which identified circulation patterns and land use opportunities for the western area of the community. One of the major land use elements discussed centered on creating a business park. At the time this concept was discussed, the land use designation of LI (Light Industrial) and zoning of PUD (planned Unit Development) were interim designations the City had to indicate the intended land use as business park. As such, the site associated with the Focus Area Study was zoned PUD (planned Unit Development) with an underlying land use of LI (Light Industrial). On January 18, 1994, the City Council adopted a Business Park Zoning Ordinance that could be implemented for the western area business park (see attached). This ordinance basically provides for light manufacturing, office, and limited commercial uses. . The requested rezoning to business park for those properties identified on the attached map will be consistent with the adopted comprehensive land use plan designation of LI (Light Industrial).
