HUNTING COMPLAINTS ON THE MISSISSIPPI RIVER
This memo is to inform the City Council that for
years we have been receiving complaints of
Mississippi River near the downtown Elk River
attempted to deal wit this problem with negative
the past several
hunters on the
area. We have
results.
The current ordinance in effect for our city bans hunting on the
Elk River side of the Mississippi River, but not the Otsego side.
Otsego currently does not have an ordinance that addresses hunting
and/or discharge of dangerous weapons. I have discussed this
problem with Otsego Mayor Norm Freske to see if the otsego city
Council might consider regulating the hunting and/or discharge of
dangerous weapons on the Mississippi River. My recommendation was
from the eastern line of Otsego Park, easterly to Highway 101.
Mayor Freske's initial response was that he thought this may be
workable.

I indicated to him that I would request that our City Council pass
a resolution requesting that the hunting and/or discharge of
dangerous weapons would be banned in the area mentioned above.
I am, therefore, requesting that the Elk River city Council pass a
resolution requesting the Otsego City Council to pass an ordinance
regulating the hunting and/or discharge of dangerous weapons from
the eastern line of Otsego Park, easterly to Minnesota State
Highway 101.

A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION REQUESTING THE OTSEGO CITY COUNCIL TO
CONSIDER ADOPTING AN ORDINANCE TO REGULATE HUNTING
ON CERTAIN AREAS OF THE MISSISSIPPI RIVER
WHEREAS, the City of Elk River ordinance bans hunting and the
discharge of dangerous weapons on the Elk River side of the
Mississippi River; and
WHEREAS, the City of Otse'go currently Has no ordinance banning
hunting or the discharge of dangerous weapons on the
Mississippi River; and
WHEREAS, for the past several years the Elk River Police Department
has received numerous complaints in regard to hunting on
the Mississippi ;River near do\yntown ~lk River; and
WHEREAS, complaints relating to hunting and the discharge offrrearms
are mainly near the downtown area, at a location where the
Elk River enters the Mississippi River easterly to Highway
101; and
WHEREAS, due to the close proximity of the Mississippi River to
downtown Elk River, hunting and/or discharging of
dangerous weapons in this area could be harmful; and
WHEREAS, because the hunting is taking place on the Otsego side of the
Mississippi River, the City of Elk River has no jurisdiction
over the situation.
NOW, THEREFORE, BE IT RESOLVED that in order to control the
possibility of harm due to the discharge of firearms on the
Mississippi River near the Elk River downtown area, the
City Council requests the City of Otsego to consider the
adoption of an ordinance to regulate the hunting and/or
discharge of dangerous weapons on the Mississippi River
from the eastern border of Otsego Park, easterly to
. Minnesota State Highway 101.

Passed and adopted by the Elk River City Council this 17th day of October,
1994.
