Staff recommends adoption of the resolution approving the Simple Plat for Pintail Estates 1" Addition,
subject to the following conditions:
1. This final plat approval shall expire one year from the date of this resolution if the final plat
is not recorded within that time.
2. Future construction of principle structures on the properties shall require replatting oflots.
3. The following fees shall apply:
a. Water and Sanitary Sewer Trunk fees shall be paid at the time the Final Plat is
released for recording. This fee shall be at the rate applicable at the time the
Final Plat is released.
b. A Surface Water Management fee shall be paid at the time the Final Plat is
released for recording.
c. Park dedication based on fair market value of 10% of the platted property.
4. All required subdivision/park information shall be provided in an electronic format
(.dwg file) as required by the City Ordinance and Land Use Application prior to
recording ofthe plat.
Background/Discussion
The property owner request platting and subdivision of their property to be known as Pintail Estates.
The property is located north of County Road 12, north of Kliever Lake Fields residential subdivision,
and south of Trott Brook east of the Johnson, Co Rd 12 intersection. The 39.03 acre site would be split
into 2 two lots, including an outlot A.
The platting is necessary for the development of the proposed Spectrum High School. No public streets
are proposed, and the only utility work proposed is for service extensions for the school. An
administrative subdivision is appropriate for this request.

Analysis
The applicant requests approval to subdivide the subject 39.03 acres into two lots:
Lot 1, Block 1 20.06 acres
Outlot A 18.97 acres
Comprehensive Plan
The proposed subdivision is consistent with the Comprehensive Plan.
Parks
Park dedication is based on 10% of the market value of the land. City policy has been to require park
dedication on only platted parcels, not outlots. For the platted 20.06 acres, the park dedication would be
the fair market value of 2.006 acres. Using a value of 50,000 for estimation purposes, the fair market
value would be $100,300. Park and Recreation staff and the property owner are working on an

agreement that would provide for the improvement of land and the ability to share the land. If no
agreement can be reached, the responsibility would be as stated above.
Transportation
Streets - No new streets ate proposed or necessary with the plat as presented.
Trails - No trails or sidewalks are proposed as part of the plat.
Utilities
No new utility mains are proposed, although service connections will be extended to serve the proposed
school.
Grading/Drainage
No grading is proposed as patt of the plat.
Landscaping
No Landscaping is proposed or recommended for the lot split.
Recommendation
Staff recommends approval of the Administrative Subdivision by Simple Plat, subject to the conditions
outlined above.

RESOLUTION NO. 07-
CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
Pintail Estates 1 sf addition
Case No. P 07-06
WHEREAS, application has been made for final pht approval, pursuant to Section
1008.08 (l)(c) of the Elk River City Code of Ordinances, of the property legally described on
attached Exhibit A and hereinafter referred to as "the Property"; and
WHEREAS, the proposed final pht complies with each of the conditions set forth
by the City Council in its approval of the final pht of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as follows:
A. The proposed subdivision is consistent with the Zoning Ordinance and
conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general and
specialized city, county, and regional phns including, but not limited to, the City's
Comprehensive Development Pho.
C. The proposed subdivision makes adequate provision for water supply, storm
drainage, sewage transportation, erosion control and all other services, fucilities and
improvements otherwise required herein.
D. The proposed subdivision will not cause substantial environmental
damage.
E. The proposed subdivision will not conflict with easements of record or with
easements established by judgment of a coutt.
F. The proposed subdivision will not have an undue or adverse impact on the
reasonable development of neighboring hod.
2. Final pht approval is hereby gtanted for the Property, subject to the conditions set
forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set forth in
Exhibit B are met and complied with, to sign the final plat for the Property and to
issue a certified copy of this Resolution giving final approval of the plat.
4. The owner of the Property is authorized to record the final plat as required by law
and shall file proof of said recording with the City. No building permits will be
issued for the Property until the final plat is recorded.
S. This final plat approval shall expire one year from the date of this resolution if the
final plat is not recorded within that time.
