A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION OF THE CITY OF ELK RIVER
AUTHORIZING THE CLOSING OF THE RAILROAD CROSSING ON
173RD AVENUE AND THE PRIVATE CROSSING SOUTH OF 171sT AVENUE
WHEREAS,
WHEREAS,
the City has worked with Burlington Northern and Santa Fe Railway to approve a
new railroad crossing at 171st Avenue; and
Burlington Northern and Santa Fe Railway has made the opening of the new
crossing at 171st Avenue contingent upon closing the existing railroad crossing
on 173rd Avenue and private crossing south of 171st Avenue;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1. At the time that the 171st Avenue railroad crossing is opened to traffic both the 173r~
Avenue crossing and the private crossing south of 171st Avenue shall be closed and the
easement for the 173ra Avenue crossing within the railroad right-of-way shall be vacated.
