INTERSECTION

Please see the attached memo from the City Engineer on the possible
construction timetable for this project. I believe that this construction
timetable is very optimistic and will be very difficult to accomplish. The City
Engineer indicates the same in somewhat softer terms at the end of his
memo.

The City Council authorized a frontage road study in September just prior to
consideration of the development proposal for the northeast corner of Elk
Hills Drive and Highway 169. This development proposal is scheduled to be
back before the Council on 11/21/94. We may want to see if this development
project is moving forward this year before we spend City street funds on this
street project.
If the development project moves forward, it will be important to determine
the financial participation of the developers in this street improvement
project. This will determine, in part, the City's level of participation in this
overall project. On Monday, 11/7, we just learned that the total cost of the
improvements are in the $550,000 range and the City Council has not
discussed our participation level (or our funding source) for this project. In
order to meet a spring construction deadline, we have to initiate survey work
while we are still doing a preliminary feasibility study. This is because we
have to go out for bids by the end of January. (The survey work needs to be
authorized on 11/14, but the plans and specifications can wait until 11/28 to
be authorized).

The source of the City participation is going to have to be mainly, if not
entirely, MSA funds. The level of our participation appears to be in the
$275,000 or more range. We do not know what the exact status of our MSA
funds are as we have just assessed out the Elk Park Center and the Western
Area Phase II projects and the actual cost won't be determined until 1995.
Also, MSA money for this Elk Hills project will not be received until 1996 and

1997, so we will need to obtain a loan or do some internal financing in order
to fund this project in 1995. At this time, I am sure if we do this project in
early 1995, we will not have any other MSA money available for any other
project in 1995 or 1996. We won't know if any MSA money is available for
street projects in 1997 until we have finalized the Elk Park Center and
Western Area Phase II projects in 1995.

POTENTIAL CONSTRUCTION SCHEDULE
Dear Mr. Klaers:
As requested by the City Council at their last meeting, I have prepared the following
proposed schedule for the improvement of 5th Street, Dodge Avenue, and the intersection
of Elk Hills Drive and TH 169. Based on discussion at the City Council meeting, the
schedule shows initiating a project at the November 14th City Council meeting and starting
construction early in the spring of 1995, with the project being completed at least through
the first lift of bituminous surfacing by Memorial Day 1995, in an effort to minimize
disruption to traffic along this commercial area. The schedule I would propose is as
follows:
November 14, 1994
- Order feasibility study.
- Initiate plans and specifications.
November 28, 1994
City Council accepts feasibility study and orders
public hearing.
December 1994
- Staff holds informational hearing with affected
property owners.
- City Engineer works with committee of business/
property owners on the design of the project.
January 23, 1995
- Hold public hearing.
- Approve plans and specifications and authorize
advertisement for bids.
February 16, 1995
Open bids.

hearing

- Hold assessment hearing.

As you can see, this is a very aggressive schedule and assumes that many things will fall
into place, such as public support and involvement in the design process, lack of assessment
appeals, and weather for early construction. If the City Council would like to initiate work
on this project, I have attached a resolution which authorizes the preparation of a feasibility
study. I would also request that the City Council give direction to initiate work on plans
and specifications. This would allow us to begin the survey work prior to snowfall and
begin preparing base plans which can be utilized for informational meetings and design
meetings with a committee of property and business owners.

A RESOLUTION OF THE CITY OF ELK RIVER
ORDERING A PRELIMINARY FEASffiILITY REPORT
IN THE MATTER OF THE
ELK HILLS DRIVE, DODGE STREET, DODGE AVENUE, AND 5TH STREET
IMPROVEMENT OF 1995
WHEREAS the City has determined that it should consider improving certain property by
upgrading 5th Street, Dodge Avenue, Dodge Street, and Elk Hills Drive (the
improvement); and
WHEREAS Council must first secure a preliminary feasibility study in order to consider
making the improvement;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River,
Minnesota:
This matter shall be referred to MSA, Consulting Engineers, who is requested to provide
to the City Council a report advising, in a preliminary way, whether the proposed
improvement is feasible and whether the improvement should thus be made as proposed
or in connection with some other improvement and the estimated cost of the improvement
as recommended.
