OVERVIEW
.
Dovolis Johnson and Ruggieri are the architects hired by Taco Bell to
complete the plans and specifications for City approval. The proposed Taco
Bell is approximately 2,000 square feet in area and will have a drive-through
window. The restaurant will have approximately 700 square feet of sit-down
dining area. The building proposed by Taco Bell is the prototype that is most
commonly constructed throughout the metro area.

HOURS OF OPERATION
Taco Bell has not specifically indicated their hours of operation. However,
they did indicate that their hours would be similar to other restaurants in
the area (i.e., McDonalds). Taco Bell has been known to have restaurants
that stay open 24 hours a day. Typically hours are 10:00 a.m. to midnight.
Given the location within Elk Park Center PUD and not adjacent to any
residential, hours of operation should not be a concern. Therefore, a condition
relating to limited hours has not been recommended.
SITE PLAN REVIEW
All of the development that occurs in Elk Park Center Planned Unit
Development is required to obtain a conditional use permit for site plan
review. The revised plan submitted by Dovolis Johnson & Ruggieri addresses
all of the issues outlined in staffs report to the Planning Commission. Some
of the notable changes include the following:
.
. The grading plan has been revised to include an additional catch basin.
. The swale between the drive-thru lane and primary parking area has
been increased in width to help facilitate drainage.
. One of the parking stalls directly in front of the building has been
converted to a striped pedestrian lane, allowing easy access to the
southerly entrance of the building.
. Some medium-sized shrubs have been provided along the east side of the
drive-thru lane to help soften the appearance of this vehicular use area
from Highway 169..
PLANNING COMMISSION RECOMMENDATION
The Planning Commission unanimously recommended approval of the
request for a conditional use permit for a Class II restaurant with a drive-
thru in Elk Park Center based on the following:
-Findings outlined in staffs memo dated November 22, 1994;
- The revised plans submitted on November 22, 1994;
- The sign details included in the Planning Commission packet;
- That a different method of pedestrian access to the building be ,
rather than moving the handicap parking stalls
- That the storm drainage plan be accepted as adequate, with the
addition of sidening the drainage flow through area to 3.5 feet.

RECOMMENDATION
It is recommended that the City Council approve the conditional use permit
request by Dovolis Johnson & Ruggieri, Inc. for site plan review of a Class II
restaurant with a drive-thru in Elk Park Center PUD with the following
conditions:
1. All comments mentioned in the report to the Planning Commission
dated November 22, 1994 be incorporated into revised plans and
submitted for staff review prior to issuance of a building permit.
2. All comments mentioned in Terry Maurer's memo dated November 11,
1994 also be incorporated into the revised set of plans.

SITE PLAN REVIEW
Since this restaurant is located in the Elk Park Center Planned Unit Development, all
standards approved for that development will need to be met. The concept review
committee has conducted a review of the proposed development plans and offer the
following comments:
A. Site Plan
.
1.
All building and parking areas have been designed to meet the required
setbacks as set forth in the approved development plans for Elk Park
Center PUD.
B. Parking and Circulation
1. A total of 32 parking stalls are required per the ordinance. This is based
on one parking stall per every 25 square feet of dining area. Proposed
plans provide a total of 58 stalls, therefore, no additional stalls are
required.
2. The handicap stalls and striped walkway should be adjusted to align with
the southerly entrance to the building. This will allow easy access for
customers as well as unobstructed exiting in the event of an emergency.
3. Entrance drive off Freeport should align with the driveway to Target
which lies west of Freeport. This will improve turning movements and
minimize conflicts that typically occur with offset driveways.
4.
The width of the proposed entrance drive should be reduced to 32 feet
and striped for two-way traffic. Larger curb radius can be maintained
to allow easy accessibility.

5.
Curb in front of trash enclosure should be depressed to allow easy access
to the dumpster area.
C. Pedestrian Circulation
1. Sidewalk adjacent to the northerly parking area will need to be a minimum
of six feet in width. This can be accomplished by reducing the parking
stall length to 19 feet and adding one additional foot to the sidewalk area.
2. The sidewalk along the south side of the building should be extended to
connect with the sidewalk along Freeport A venue. This connection will at
least provide a continuous pedestrian system between the commercial
businesses and sidewalk system along Freeport.
D. Landscaping
1. Any existing trees along the south side of the property should be preserved
and incorporated into the development plans.
2. Some of the proposed conifers along the south side should be relocated to
the north to provide a "balanced" landscape.
3.
Underground irrigation is required throughout all landscaped areas. This
should be noted on the final development plans.

Lighting
1. A detail of all lighting standards should be submitted along with the
revised set of plans and reviewed prior to issuing a building permit.
Parking lot lighting should include standards which complement the main
shopping center lights.
All of the above comments should be incorporated into the revised set of plans and
submitted for staff review prior to issuance of a building permit.
RECOMMENDATION
It is recommended that the Planning Commission recommend approval of the conditional
use permit request by Dovolis Johnson and Ruggieri, Inc. for site plan review of a Class
II restaurant with a drive-thru in the Elk Park Center PUD, with the following conditions:

RE: TACO BELL SITE PLAN REVIEW
Dear Mr. Ach:
As requested, we have reviewed the information provided for the proposed Taco Bell. The
proposed development is on Lot 3, Block 4, of Elk Park Center, which is the free standing
lot located along Freeport Avenue immediately north of the water tower. The information
we reviewed was submitted by Dovolis Johnson Ruggieri, Incorporated. The submitt3.I. was
dated October 20, 1994. Based on our review we would offer the following comments:
1.
The site plan on Page AI-A shows a 36' wide driveway accessing on Freeport
A venue. It is proposed to have three lanes, two exiting, and one entering. The
driveway is offset approximately 50' to the south from the main entrance to the
Target store. We would strongly recommend that the driveway location be moved
northerly to be immediately across from the Target entrance. This will require the
relocation of a fIre hydrant, and a pedestal which will support one of the future
street lights. The street light has not yet been installed. We would also question
whether or not the Taco Bell requires a 36' wide driveway. It may be more
appropriate to have a driveway supporting only two lanes of traffic, one entering,
and one exiting. This may help to reduce conflicts at peak traffic times between
Taco Bell traffic and Target traffic.
2.
The grading plan shown on sheet AI-B indicates one catch basin located internal to
the site near Freeport Avenue. The entire site, approximately one acre of
impervious surface, will then sheet drain to this catch basin location. We have
contacted Maliah Miller of Dovolis Johnson Ruggieri, Incorporated, and indicated
to her that this would meet City requirements of not draining out onto Freeport
Avenue, but we would suggest they re-evaluate their internal drainage, and consider
installation of at least one additional catch basin in the drive thru lane. This would
allow them to eliminate the drainage curb cut-thru between the main parking lot and
the drive thru lane. We have seen numerous other instances where these types of
curb cut-thru's do not work properly. A small amount of debris, leaves, or icing
will cause water to stand in the drive thru lane.

3. We would recommend that silt fence be extended along the easterly side of the
project site adjacent to Highway 169, prior to initiating grading operations.
4. There are two parking stalls indicated directly in front of the trash receptacle
location. This potentially could cause a coordination problem for orderly trash
pick-up.
