Prepared by Tina Allard, Ci Clerk Reviewed by Lori ohnson, Ci Administrator Reviewed by Action Requested A) Approve solicitor's licenses to twenty-six applicants in Exhibit A from Apx Alarm in order to solicit for security system sales door-to-door with the following conditions: 1. Only one (1) solicitor shall approach one residence and no solicitor can approach the same door again unless invited back by the resident. 2. Hours are limited to Monday through Friday, 11 :00 a.m. to 6:00 p.m. 3. Applicants shall carry the solicitor's license, a driver's license or state ID, and wear a company photo ID proving employment with Apx Alarms while soliciting. 4. The license shall expire two weeks from the date the applicant wishes to begin soliciting door- to-door. 5. Applicants can't knock on any door where there is a sign prohibiting solicitors. Violation of any of these conditions will result in revocation of the individual's license. B) Approve or deny Applicant A and B. Background/Discussion The Council continued this item from the June 18,2007 Council meeting in order for staff to prepare more information on the following items: 1. Determine if Apx Alarm is a legitimate business and provide more information about the company. Apx Alarm is licensed in the following ways: · MN Dept of Labor and Industry as a Technology Systems Contractor · MN Secretary of State as a Foreign Corporation · Utah Department of Commerce as a Domestic Corporation · Member of the National Burglar and Fire Alarm Association (NBF AA), a trade association · Member of the Better Business Bureau of Utah S:\Council\City Clerk\ Transient\2007\Apx Alarm 070207.doc 2. Police Chief comments on this item plus comments he has learned from other communities. Chief Beahen will be at the Council meeting to present his comments. 3. Determine if the number of solicitors from one company can be limited. Peter Beck will be at this meeting to provide more information on this topic. 4. Draft a list of the conditions Council discussed at the June 18 meeting. The conditions are located in the Action Requested section of this memo. Attached is an email from the applicant's representative stating opposition to the condition that limits sales hours. I will not be at this meeting due to a scheduled vacation but Chief Jeff Beahen and Attorney Peter Beck will be available to answer any questions of the Council. The Council had a discussion on whether to issue solicitors licenses to Applicant A and B but there were differing opinions. The staff report providing background information on these two applicants from the last meeting is attached. However we were surprised to hear that one of our biggest competitors (Pinnacle Security) was granted licenses without the same restrictions. It is extremely unfortunate that you would give such a competitive advantage to one of our main competitors in the capitalistic society that we live. Elk River was one of our top reasons for coming to Minnesota this summer and we were planning on providing a great service to the community. APX sells home security systems door to door in almost every city in the US and without exception they have all recognized our working hours to be between 3pm and 9pm Monday through Friday and all day on Saturday. Our target market is working families, and with those restrictions we would be unable to service our target market without being able to talk to them after they get home form work. Up to two solicitors may approach one residence at a time. B. Applicant's shall carry the solicitor's license, a driver's license or state ID, and a company photo ID proving employment with Apx Alarms on them while soliciting in the City of Elk River. Possible Condition C. Discussion should also be held on the hours the solicitors will be allowed to go door-to-door. I was going to originally recommend hours of 8:00 a.m. to 6:00 p.m. daily but a representative for all the applicants called late on Friday and requested the hours be changed from 11 :00 a.m. to 9:00 p.m. 2) Approval of a solicitor's license to Applicant A as he has not been convicted of a crime that is directly related to the license he is seeking. 3) If the Council wishes to deny a solicitor's license to Applicant B, then the Council should make ftndings of fact that support the denial. One ftnding may be that the applicant is not of "good moral character." (due to his misdemeanor conviction). If the license is denied, staff should be directed to contact the applicant to let him know he has a right to present evidence to the Council to rebut the ftndings against him. Background/Discussion Twenty-eight applicants from Apx Alarms would like to solicit door-to-door for alarm system sales. All application materials have been submitted. The Police Chief recommended denial for two applicants due to their application and background checks. Applicant A In April, Applicant A was arrested in the City of Blaine for soliciting without a license. According to state law, city ordinance, and previous court cases, there are not enough ftndings of fact to deny Applicant A a solicitor's license because his arrest is still pending and he has not yet been convicted. If the Council wishes to deny this application, the city needs to make fIndings of fact for the denial. Federal courts further emphasize the need for due process in licensing so the applicant should be given an opportunity to rebut the fIndings against him. Grounds for Denial · Does not comply with the provisions of the ordinance. · The applicant is not of "good moral character." A judgment of guilt in a criminal prosecution may be used as evidence in the determination of moral character if the crime relates directly to the license the applicant is seeking. · Granting a license would be a menace to the safety, health, morals, and welfare of the public. · There has been a material misrepresentation in the application. Due to Applicant B's misdemeanor conviction, the Council could deny his license request based on the applicant not being of "good moral character." The story reported the instance of Linda Husted, who had been approached by an APX employee. "He didn't give me any 10," Husted told WMC-TV 5. "He said he didn't have any brochures that I could look at." Husted added that the sales staff came back three times, not accepting her "not Interested" as a final answer. National companies allege that some competitors are misrepresenting who they are, Geoff Kohl, editor Secur/tylnfoWatch. com All is not well in the world of residential alarm sales. SecurityInfoWatch.com has been tracking stories coming out of Arizona, Tennessee, Nevada and the state of Washington, where alarm competition has created mischievous sales techniques. Repeatedly at the center of the stories is a company named APX Alarm, which is an alarm company based out of Provo, Utah, and which the Better Business Bureau reports is doing business as Apex Alarm, Apex Monitoring, Apex Security and Apx Alarm Security Solutions. The company has been the subject of a number of news reports for suspect sales techniques from Nevada to Memphis. Consumer news reports from various city media outlets such as Carson City, Nevada, and Memphis, Tenn., allege that the company has used dogged techniques like sending out employees who have been "pushy" and not properly identified themselves as to which alarm company they are with. Jack Inbar, vice president of operations for APX, says his sales staff are "certainly assertive," however, he says that the media accounts are likely untrue and "distorted". According to Inbar, his company's employees receive seven months of training and wear APX shirts and always carry APX identifications and brochures. "Our employees are door to door. But they are very well trained and very well disciplined," said Inbar, who noted that those employees who don't follow company policy are reprimanded and/or let go. Misrepresentation at the Door In Seattle, local news broadcaster KOMO News reported in July that the wave of door-to-door sales had hit Brink's Home Security, with some residents even claiming that tricks have been used such that sales agents are representing themselves as companies other than they are with in the hopes of stealing customers from companies like Brink's. According to Dave Simon, the senior manager of industry and public relations for Brink's Home Security, they've heard from around 50 customers who have been hit by misrepresentation. Simon said the usual methodology is that the competitor will scour neighborhoods for signs from other alarm companies and then will knock on the doors of those customers under the auspices of upgrading their alarm systems. Then, says Simon, they'll try to change their monitoring contract. HSM's Stern reported seeing similar instances where a door-to-door competitor has told the homeowner that he or shee needed to change out the panel and to add a back-up communicator. He said that the equipment changes weren't because of a malfunction, but were simply a way to recruit accounts away from their existing service and monitoring contracts. Brink's has responded, says Simon, with messages to its customers advising them of such scams and to be aware of such ploys and to always ask for identification from sales persons. Brink's, like most national alarm companies, requires Its employees to carry proper credentials identifying them, and many of the top national companies which have fallen prey to these scams say they do not use the door-to-door techniques themselves. Similar tactics have hit HSM customers, reports Dennis Stern, HSM's executive vice president and general counsel. "There are a bunch of guys that sell this way. There are companies that don't correctly represent who they are and what they're doing," says Stern, who notes that APX is by no means the only company whose door-to-door sales tactics could tarnish the alarm Industry's image. Stern says that he has heard from others at Guardian Protection, Protection One, ADT who say they also have been hit by similar sales tactics. "They're knocking on doors, and misleading to people that they're from Brir1k'S," explains Brink's Dave Simon. "Then they're getting in the door and recommending changes to alarm systems that really don't need to be made and then trying to switch the monitoring over to them." According to Simon, the tactics don't fall in line with what Brink's has for standards. "We don't go door-to-door, and we don't come In with a service technician to say you need to have work done. If a technician needs to be there, then either the customer has contacted us or we've contacted them and set up an appointment." Simon added that while the events have been isolated, they seem to flare up in the summer (Inbar says APX does have a summer program that uses college students). At Brink's says Simon, the issue of mispresentation has come to a point where the company has contacted APX Alarm and requested they cease the business practices. APX's Inbar, however, denies that his company's sales staff misrepresents itself. "We even make sure that our customers known that while we are a dealer of Honeywell equipment, we are not part of the Honeywell corporation," says'Inbar. Being Proactive Simon says that any alarm companies experiencing unethical operations in their markets will need to be proactive. He offered the following tips that his company has been doing as suggestions for any alarm company being plagued by a competitor that is misrepresenting itself. "Make sure that their people, when they perform any type of service visit, identify themselves," says Simon. They should give them the technicians name and specify a time they would be out there to service the equipment. You have to be very clear about who you are and why you are coming out. "It's best to get your customers informed in every way you can, and notices in a letter or bill is a good way to do that. The other way we do that Is through an automated voicemail system that can call our customers and advise them of the situation. Email will also work well If you've collected your customers' email addresses. " An Industry Ethics Problem But even with proactive efforts from the "stand-up" companies In the industry, the alarm industry may not be immune to ethical problems. "It's an entrepreneurial environment, where if you want to start an alarm company tomorrow, you can do it, and how you operate that company would be based on your personal ethics," says Simon. "The challenge there is the demarcation between the different companies. You have some companies with firmly established standards, but not everybody adopts those kinds of high standards. So how do you reach those high standards? "It can be education. It can be peer pressure. It can be pressure from association leadership and from national leadership, and ultimately it would be good to create some sort of enforcement mechanism. Overall, for the alarm industry, enforcement of any type of regulation or standard seems to be very difficult." Nonetheless, APX's Inbar maintains that problems of ethics and standards don't affect his company. He says APX is one of few companies that makes it clear to customers what is being done, and actually follows up with their customers in two surveys, before and after the actual equipment Install to make sure everything is upfront. But asked how it is that a company that has such seemingly standard ethics has become the black sheep of the alarm industry according to both their competitors and according to so many local community news outlets, Inbar said it was only because the company was big and steadily growing. "We're a lot larger than a lot of them," said APX's Inbar, "and as a result, we're on the radar." Related Links . The solicitation permits for APX Alarm, of Provo, Utah, were denied Friday after residents flooded the sheriffs office with complaints this week. Sheriff Kenny Furlong said Friday that 18 alarm sales people were working in Carson City this week before their solicitation permits and business permit had cleared. "I think they were falsely representing their company," he said. "They were being overly aggressive with our residents, and I chose to revoke all the solicitors' permits, which causes them to lose their ability to go door-to-door." Furlong said callers complained the sale people were "overly persistent" to get inside homes. He said the office received 15 complaints on Thursday. An APX official said it was his sales people that were harassed by the sheriffs department. "It seems the only people harassed here are our employees, most of whom are college students working their way through school," said Alex Dunn, APX Alarm vice president of business development. Furlong said his name was even brought into the sales pitch. "There was a complaint that they were representing that I had purchased the product, which is not true," the sheriff said. Furlong said it's unusual to deny solicitation permits even before they've been issued. If any APX sales people continue to operate in Carson City, they will be cited. Dunn said all company sales people were pulled from Carson City after receiving the sheriffs call Friday afternoon. "We're happy to remedy any situations we hear about, but the sheriff wouldn't allow that," he said. APX operates in 37 states and is expected to install 100,000 home security systems nationwide.
