SUBJECT: MODIFICATION TO EDA ENABLING
RESOLUTION
Based on City Council action at its meeting on November 14, 1994, revisions
to the proposed resolution to modify Resolution No. 87-63 have been made
and are offered to the City Council for action on November 21, 1994.

If approved, the resolution provides for the Mayor, three additional members
of the City Council, and three residents of the City of Elk River who are not
members of the City Council to serve on the EDA. In addition, the terms of
the Commissioners who are members of the City Council shall coincide with
their term of office, unless a Commissioner resigns earlier to accept the
position of Vice Mayor. Commissioners who are not City Councilmember
serve six year terms.
Action Reauested
The City Council is asked to adopt Resolution No. 94-_. This resolution
modifies Resolution No. 87-63, a resolution establishing an Economic
Development Authority for the City of Elk River, Minnesota. This
modification adds one more resident of the City of Elk River who is not a
member of the City Council to the Elk River EDA.

RESOLUTION 94-
A RESOLUTION FOR THE CITY OF ELK RIVER
RELATING TO THE SOLID WASTE FEE STUDY
BY THE MINNESOTA OFFICE OF ENVIRONMENTAL ASSISTANCE
WHEREAS, Minnesota Statute Section 115A.921 allows cities to use seventy-
five percent (75%) of the surcharge monies collected from landfills
for general fund purposes; and
WHEREAS, the City of Elk River, in reliance on this Statute, has obligated these
monies for future payments on public buildings; and,
WHEREAS, the City Council of the City of Elk River feels it is appropriate that
the current portion of landfill surcharge monies that are allowed for
general fund purposes continue to be used to help offset negative
affects of having a landfill located in the community; and,

WHEREAS, the Elk River City Council has reviewed the Minnesota Office of
Environmental Assistance (OEA) Solid Waste Fee Report, which
includes a recommendation that all landfill surcharge monies
collected by cities be used only for solid waste activities.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
River that the City of Elk River is in strong opposition to OEA's
recommendation to eliminate landfill surcharge monies from going
to general fund purposes.
Passed and adopted by the Elk River City Council this 21st day of November,
1994.
