4.4a. 1992 NAPLES AND 186TH PRIVATE ROAD REQUEST
A few years ago, a number of property owners in the 186th Avenue and
Naples Street area requested that the City consider taking over these private
roads. The City worked with the property owners in an attempt to get the
project underway. We were not successful in having the project move
forward due mainly to the fact that all of the right-of-way necessary for the
project was not being provided to the City. Since this area is in the Western
Area Phase II Improvement Project assessment roll, the Mayor has requested
an update on the status of this project and a discussion on reconsidering this
project. Please see the attached information on this topic. The City Engineer
will be at the meeting to discuss this proposed project with the Council.
4.4b. CONCORD PRIVATE ROAD
The City has been involved with this possible project for a number of months.
This project involves a private road. The property owners are requesting the
City to improve the road and make this private road a public street. A
special Council meeting on this topic was scheduled for last Monday, but this
meeting was canceled. Councilmember Dietz has been in contact with a
number of property owners and should be able to provide the Council with an
update on this project.
4.4c. WACO STREET BRIDGE CONCEPT
A long range planning concept that has been discussed for a number of years
is a bridge over the Elk River at Waco Street. This bridge is needed and
desired for a number of reasons. Also, for a number of different reasons, this
bridge has never been close to being a reality. However, recently a
"floodable" bridge concept has been discussed by MnDOT and the City. The
City Engineer should have an update on this concept for the City Council in

order to determine if this is a real possibility or something that is going to be
very difficult to accomplish.
Regardless of how difficult a bridge at this location may be, it will most likely
happen at some time in the future. Accordingly, the City is still pursuing the
purchase of right-of-way for this project as we have a property owner that is
willing to sell at this time. This area can be designated as future street
right-of-way property and can be financed through Municipal State Aid
monIes.

Dear Mr. Klaers:
As requested, I have reviewed my file regarding the easement acquisition for the Naples
Street/186th Avenue improvement project. Attached is a copy of the latest correspondence
dated August 21, 1992, which was sent to each of the property owners. This letter pretty
well summarizes the process that was gone through on this project. This also is the letter
that indicated a termination of the City's attempt to move forward with this street
improvement at that time. Since the date of this letter, no additional work has been done
with the exception that approximately one year ago, Councilmember Dietz asked for a copy
of all of the easements, which were sent to him. I am not sure what was done with those.
Please let me know if there is additional information or work you would like us to do on
this project.

Dear Mr. Knutson:
Back in August 1990, the residents of the Naples Street and 186th Avenue neighborhood submitted a
petition requesting the City to upgrade and take over the roads in the area. Based on that petition, the
City Council authorized a feasibility study on September 10, 1990, and that report was completed in
November 1990. An informational hearing was then held with staff on March 19, 1991.
On March 25, 1991, the City Council considered the outcome of the informational hearing. The
Council concurred with the staff recommendation that the City provide a free gravel road upgrade in
exchange for the residents providing 60 feet of permanent right-of-way.
_ City staff followed up with acknowledgement of the willingness to grant the easement in the fall of
1991. This spring and early summer, we met with every property owner to distribute the actual
easement document and request a Right of Entry Agreement be signed so the work could proceed. As
of this date, only four property owners have signed the Right of Entry and only one easement document
has been executed and returned.
At this time, it appears doubtful that the neighborhood will provide the necessary easements for this
project to be completed. This information was presented to the City Council on August 10, 1992. At
that time, they concurred with the staff recommendation that the project be removed from the City's
work schedule and directed this letter be sent.

RE: CONCORD STREET EASEMENT STATUS
Dear Mr. Klaers:
This letter is intended to update you once again on the current status of the Concord Street
easements. For clarity, I have attached an exhibit which will indicate the properties that
have given easements and those which have not. As you are aware, there are a total of 14
parcels from which easements are required. These represent 12 different property owners.
As of today's date, we have received a total of eight easements from six different property
owners. Two other easements have been provided to the City but the property owners have
asked for those to be returned. I assume these two individuals would provide their
easements back to the City if the project were to move forward. That leaves four property
owners which have not provided easements nor given any indication whether or not they
plan to do so. One property owner's easement (McCarty) is not necessary for the project
to proceed.
Please let me know how you would like me to proceed with this project.

RE: Waco Street Right-of-Way Acquisition

We are continuing discussion with the Minnesota Department of Transportation State Aid
Office, regarding the use of MSA funds, for the above referenced project. Based on a
right-of-way width of 80 feet, we anticipate that approximately 4 - 6 acres ofland would
be required depending on the proposed alignment. The acquisition of the needed right-of-
way will divide Mr. Gagne's property from a single tract into separate areas abutting the
right-of-way. It is likely that the acquisition price would reflect a higher price due to the
segregation of the property.
In a previous acquisition along Orono Parkway, which is an MSA route, the City was able
to negotiate the acquisition price with the property owner and submit the cost for MSA
reimbursement. It is anticipated that this method will also be available for Waco Street as
we've discussed with the District State Aid Engineer and District Right-of-Way Engineer.
MnDOT has indicated that it is common to pay a higher price for right-of-way when the
acquisition significantly alters the before and after value of the remaining property that is
not purchased. These additional costs are referred to as severance damages.
It is anticipated that the District State Aid Engineer will provide further direction within
the next two weeks. If the City is able to negotiate directly with Mr. Gagne, we will open
a state aid project number, prepare a plan sheet showing the proposed alignment, and
submit the plan for State Aid approval. Following successful negotiation of the purchase
price, the City would acquire the property and submit information to State Aid for
reimbursement. Please contact either Terry Maurer or myself, if you have any questions.
