Item Description
Request by Waste Management for a Conditional Use Pennit for
an Expansion to an Existing Shop/Office building, Case No. Reviewed by
CU 07-18, Public Hearing
Action Requested
Staff and the Planning Commission recommend approval of the request, as illustrated on drawings dated
July 7, 2006, with the following conditions:
1. All comments of the Plans Examiner memo dated June 5, 2007 shall be addressed.
2. The improvements shall meet all applicable building and fire codes, including
comments from Fire Chief dated June 5, 2007.
3. The existing storage building shall be resided with a material color consistent with
the gas plant.
4. The existing storage building shall be removed by December 31, 2009 or approval of
a conditional use permit for a new HHW building be obtained.
5. The proposed addition should be sided with a material color consistent with the gas
plant.
6. A letter of credit in the amount of $50,000 shall be submitted prior to the releasing of
the building permit. The Letter of Credit may be used to secure completion of all
improvements, including, but not limited to parking lot, striping, landscaping,
establishment of disturbed areas, payment of city incurred expenses, and the removal
of the storage building in by December 31, 2009.
7. This approval of the Conditional Use Permit shall expire after 2 years, unless the
substantial completion is shown or the owner or owner's agent has received an
extension.
Backlround/Discussion
On June 19, 2006, the City Council granted a conditional use pennit to Waste Management for the
construction of a new garage/ office building at the land fill, immediately west of the gas reclamation
plant. All construction in the Solid Waste Facility (SWF) overlay zoning district requires a Conditional
Use Pennit.
As part of that approval, one of the conditions was that an existing red metal skinned building was to be
removed in its entirety.

The applicant is requesting CUP approval to do the following:
-Build a 32 x 12 foot steel addition onto the north side of the building that was approved in
June of 2006.
-Retain the western 3,100 square feet of the red skinned storage building. The building
would be resided in metal to match the gas plant and the other building.

Conditional Use Pennit
The issuance of a Conditional Use Pennit can be ordered only if the use at the proposed location:
,. Will not endanger, injure or detrimentallY affect the use and enjoyment of other propertY in the immediate vicinity or
the public health, safety, morals, comfort, convenience or general welfare of the neighborhood or the city.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderlY development and improvement of surrounding vacant propertY.
4. Will be seroed adequatelY f?y and will not adverselY affect essential public facilities and services including streets, police
and fire protection, drainage, refuse disposal, water and sewer {Ystems, parks and schools; and will not, in particular,
create traffic congestion or inteiference with traffic on a4jacent and neighboring public thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to
a'!Y persons or propertY because of excessive traffic, noise, smoke, fumes, glare, odors, dust or vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor importance.
7. Will fullY complY with all other requirements of this Code, including a'!Y applicable requirements and standards for the
issuance of a license or permit to establish and operate the proposed use in the city.
If denial of such a pennit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in Section
30-654.
In the review of the standards for CUP as outlined, it appears that the request is consistent with all of
these standards.
Analysis
The land use is consistent with the land use plan and the pattern of development in that area. The need
for service and office buildings is customary to the approved use. The Building department, in their
review, has raised some issues, including the need to complete the CO on the recendy approved building,
and the drawing of the plans by a licensed architect.
The primary focus of staff and the Planning Commission was the building materials used for the new
addition and storage building. The Planning Commission and Council had earlier tried to create a campus
concept in the land fill area, having all buildings match the gas plant. Because the new addition (on the
north side of the building, away from the entrance drive) would not be readily visible to the public, the
Planning Commission felt that metal would be acceptable, so long as the color was consistent in color to
the gas plant. At the Planning Commission meeting, the Commission learned that the applicants wants to
use the storage building for a short period of time, 2 years, until a new house hold waste (HHW) building
is approved and built. With the information, the Planning Commission felt that metal on this building
would be acceptable, given the time frame suggested. The Fire Chief has suggested a meeting to so that
the applicant can fully understand the Fire Code requirements.
Comprehensive Plan
The use of the land is consistent with the Comprehensive Plan.
Landscapinl
In the previous approval, a condition was stated that 5 additional shade trees be added. These trees
should still be added, as well as some foundation plantings around all buildings. It is suggested that staff
approve the landscaping plan.

Waste Management - Conditional Use Permit for Bldg. Addition
Upon reviewal of the submittal package for the Elk River Landfill Waste
Management Conditional Use Permit for a building addition, I would offer the following
comments:
1. A building permit is required for this project. Two sets of plans signed by a
licensed architect and structural engineer from the State of Minnesota will be required.
2. There has not been a fmal inspection completed or a Certificate of Occupancy
issued for the office/shop building that this addition is proposed to be attached to.

The site plan review committee met on Tuesday, June 5, 2007 and I would like to make the
following comments:
1. River Park-Site Plan Review changing product type
The Fire Department has no concerns.
2. Waste Management - Conditional Use Permit for building addition
The Fire Department requests that Waste Management meet with Fire Marshal Cliff
Anderson on any International Fire Code related questions.
3. Aggregate Industries - Conditional Use Permit for building addition
The Fire Department requests that Aggregate Industries meet with Fire Marshal Cliff
Anderson on any International Fire Code related questions.
4. Elk River Utilities - Conditional Use Permit for accessory structure
The Fire Department has n? concerns.
S. Conoco Station 169/Main - General Planning Permit for seasonal sales
The Fire Department has no concerns.
6. Snap Fitness - Conditional Use Permit
The Elk River Fire Department requests Snap Fitness representatives meet with Fire
Marshal Cliff Anderson to address any and all locking devices for this security card
accessed facility. Snap Fitness representatives shall also discuss additional fire
extinguisher locations as necessary and any other International Fire Code related
issues with the addition of Snap Fitness to the Landmark Plaza.

RE: 12' X 32' addition on to the Office/ Shop building and re-skinning of the
Appliance shed
Elk River Landfill proposes to have J. Schroeder Construction build an 12' X 32'
add-on to the exiting Shop/Office building. The purpose of this building will be for
storages of oil tanks and compressor. We also are proposing the re-skinning of the
appliance building, which is just south of the Office/shop to match colors, and
complement the Shop/Office, Gas Plant and new addition.
The hours of operation will not change with this addition, the current hours of
operations 7 AM- 5 PM weekdays and 7 AM- 1 PM Saturday. The personnel will not
change due to this addition, current office personnel who use the existing Shop/Office is
5 to 8 people. Existing parking will be used which consist of 15 spaces of parking room.
The proposed addition building material will be steel roof and wall sheeting. The
material for the wall will be colored match with the existing building and the appliance
building. The addition will be attached to the Office/shop building on the North side of
the Office/shop building.
At this time, there are no Ordinance Amendments, Easement vacation or Zoning
changes requested.
