The City Council is requested to consider adopting the attached Resolution Authorizing Eminent
Domain and the Acquisition of Real Property in Aqcordance with Minnesota Statute Chapter 117
for the 193rd Avenue Transportation Corridor and 4-dopting Approved Appraisals of Value.
Background/Discussion I
On February 20,2007, the City Council adopted R~solution No. 07-24, Authorizing Eminent
Domain and the Acquisition of Real Property in Al'cordance with Minnesota Statute Chapter 117
for the 193rd Avenue Transportation Corridor.
Also at that meeting, the City Council considered nhnor modifications to the road alignment,
moving it slighrly to the north on the west side of Tyler Street in order to minimize impacts to the
werlands in that area. This minor movement of the roadway corridor made a change in the
Galvin's Parcels No.3 and 5 from the descriptions that were adopted. This modification on the
Galvin property actually moved the road further away from the Galvin home. Attached are
descriptions and exhibits showing each of the parcels included in the 193rd Avenue
Transportation Corridor, The only two parcels that changed from the area described in the
February 20,2007 resolution are the Galvin parcelsi (parcels 3 and 5).
Also at this time, the Council is being asked to adopt the approved appraisals of property for five
parcels listed in the table below. Because the appraisals are rather lengthy, we did not produce a
copy for each Councilmember, however, we do have a CD with all of the appraisals should the
Councilmembers want to view them electronically or we can produce paper copies, should they
be desired. A summary of the appraisals and the dollar amount is as follows:

There are three other parcels that the city is dealing with directly, due to the much smaller impact
the Transportation Corridor has on these properties. These include the Brandt property, the
Riverside Development property, and the Gaddes property.
As discussed previously with the City Council, once: the appraisals are approved, the eminent
domain law requires copies of the appraisals to be provided to the property owner and a period of
negotiations to take place. Based on our attorney's tecommendation and City Council approval,
staff proposed to retain the services of the SRF Consulting Group to carry out the negotiations
with the property owners of the five parcels for which appraisals have been completed.
Financial Impact
As the City Council will recall, the land acquisition l?ortion of this project is proposed to be
funded with Municipal State Aid monies.

A RESOLUTION OF THE CITY COONCIL OF THE CITY OF ELK RIVER
AUTHORIZING EMINENT DOM~IN AND ACQUISITION OF REAL
PROPERTY IN ACCORDANCE WITH MINNESOTA STATUTES
CHAPTER 117 FOR THE I 93rd N.W.AVENUE TRANSPORTATION
CORRIDOR AND ADOPTING APPROVED APPRAISALS OF VALUE.
Whereas, on February 20,2007, the City Council adopted Resolution No. 07-24,
Authorizing Eminent Domain and Acquisition of Real Property in Accordance with
Minnesota Statutes Chapter 117 for the 193rd N.W. Avenue Transportation Corridor.
("Resolution Authorizing Condemnation");
Whereas, the Resolution Authorizing ~ondemnation described certain real property
to be acquired by the City for the 193rd Avenut:! Extension Project. ("Property");
Whereas, City staff has determined that it is necessary and advisable to make certain
minor changes to the Property to be acquired ior the 193rd Avenue Extension Project.
Whereas, the City staff has also obtained appraisals to estimate the just
compensation due and owing to the owners ob the Property described in the Resolution
Authorizing Condemnation;
NOW, THEREFORE, BE IT RESO~VED by the City Council of the City of Elk
River.
1. The City of Elk River staff is hereby authorized and directed to take all
actions and to execute all documents and contracts necessary to acquire the
Real Property identified on Exhibit A ("Revised Real Property").
2. All references in the Resolution Authorizing Condemnation to the term
"Real Property" shall be deemed to mean Revised Real Property.
3. The City ratifies all previous fmdings, resolutions and provisions in the
Resolution Authorizing Condemnation.
4. The City hereby adopts, as its approved appraisal of value for the Revised
Real Property the appraisals of Patchin Messner and Dodd dated June 29,
2007.

A strip of land 100.00 feet in width over! that part of said Northeast Quarter of the
Southeast Quarter, the centerline of which is described as follows:
Commencing at the Southwest corner of the! South Half of the Northeast Quarter of said
