A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELK RIVER
AUTHORIZING EMINENT DOMAIN AND ACQUISITION OF REAL
PROPERTY IN ACCORDANCE WITH MINNESOTA STATUTES
CHAPTER 117 FOR THE 193'" N.W.AVENUE TRANSPORTATION
CORRIDOR AND ADOPTING APPROVED APPRAISALS OF VALUE.
Whereas, on February 20, 2007, the Ciry Council adopted Resolution No. 07-24,
Authorizing Eminent Domain and Acquisition of Real Property in Accordance with
Minnesota Statutes Chapter 117 fox the 193rd N.W. Avenue Transportation Corridor.
("Resolution Authorizing Condemnation");
Whereas, the Resolution Authorizing Condemnation described certain real property
to be acquired by the City for the 193`d Avenue Extension Project. ("Property");
Whereas, City staff has detem~ined that it is necessary and advisable to make certain
minor changes to the Property to be acquired fox the 193`d Avenue Extension Project.
• Whereas, the City staff has also obtained appraisals to estimate the just
compensation due and owing to the owners of the Property described in the Resolution
Authorizing Condemnation;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk
1. The City of Elk River staff is hereby authorized and directed to take all
actions and to execute all documents and contracts necessary to acquire the
Real Property identified on Exhibit A ("Revised Real Property").
2. All references in the Resolution Authorizing Condemnation to the term
"Real Property" shall be deemed to mean Revised Real Property.
3. The City ratifies all previous findings, resolutions and provisions in the
Resolution Authorizing Condemnation.
4. The City hereby adopts, as its approved appraisal of value fox the Revised
Real Property the appraisals of Patchin Messner and Dodd dated June 29,
2007.
'The motion fox adoption of the foregoing resolution was introduced by
Councilmembex Morin and duly seconded by Counciltnember
