Summary
The Conditional Use Permit for a Zero Lot Line Development is being requested to construct a retail
space which will be attached to the north end of Home Depot.
Planning Commission Discussion
The Planning Commission unanimously recommended approval of the request.
Public Comment
A business owner expressed concern with having multiple "like businesses" in the city and was concerned
the city could not support two.
The applicant stated that the city has numerous "like businesses" in the city.

Analysis
In October of 1999 the City Council approved the Pinal Plat for Elk River Crossing. The plat had
numerous Oudots that would be subject to final plat approval as they were developed. This
proposal is one of the Oudots. The Pinal Plat for the Oudot was approved by the City Council on
August 20, 2007 (Elk River Crossing 7th Addition).
A Conditional Use Permit (CUP) for a Zero Lot Line Development is necessary as required by the
Elk River Crossing PUD Agreement dated December 21, 1999. During the preliminary work for
the entire development, a structure/business was anticipated to be constructed at this location.
The CUP is being requested to construct a retail space that will be attached to the north end of
Home Depot. As a result, the shared wall of the two structures will also be the property line that
separates the two businesses. This is the same type of request as was in the Elk Ridge Center with
the discount grocery store (CU 06-27). The placement of the lot line has no affect on architectural
design, square footages allowed or orderly development and improvement of surrounding property.
The proposed structure will be within the existing vehicular circulation established on the site. All
parking requirements were anticipated and provided for with the approval of the Home Depot site.

Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
1. Will not endanger, if!Jure or detrimentallY ciffect the use and ef!Jqyment if other proper[)! in the immediate
viciniry or the public health, scifery, morals, comfOrt, convenience or general welfare if the neighborhood or the
ciry.
2. Will be consistent with the comprehensive plan.
3. Will not impede the normal and orderlY development and improvement if surrounding vacant proper[)!.
4. Will be served adequatelY fry and will not adverselY ciffect essential public facilities and services including
streets, police and fire protection, drainage, refuse disposal, water and sewer !)istems, parks and schools; and
will not, in particular, create trqffic congestion or interference with trqffic on aqjacent and neighboringpublic
thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions if operation that will be
detrimental to af!} persons or proper[)! because if excessive traffic, noise, smoke, fumes, glare, odors, dust or
vibrations.
6. Will not result in the destruction, loss or damage if a natural, scenic or historic feature if mqjor importance.
7. Will fullY complY with all other requirements if this Code, including af!} applicable requirements and
standards fOr the issuance if a license or permitto establish and operate the proposed use in the ciry.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
ftndings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as oudined, it appears that the request is consistent with all
of these standards.
