Staff and the Planning Commission recommend the City Council approve an Interim Use Permit (CU 07-
26) for the City of Elk River Public Works, 19000 Elk Lake Road to permit two temporary office
structures, as shown on plans dated 8/21/2007, subject to the following conditions:
1. The structures meet necessary building and fire codes,
2. The structures shall be removed by December 31, 2010, or an extension granted by
the City Council.
Summary
The City of Elk River is requesting an Interim Use Permit (IUP) to utilize two temporary office trailers at
the public works facility, one for public works, and the other for parks. The trailers would be no larger
than 12 x 44 and provide offices for two people, plus meeting space. The trailers would allow the City to
complete its analyses of its space needs for the public works department. The IUP, if approved would
allow the trailers for three years, or until December 31, 2010.
Planning Commission Discussion
The Planning Commission had no concerns with the proposal, other than to make sure that the
conditions were consistent with other requests made by private interests.

The City of Elk River's Public works and Parks administration facilities are reaching their capacity.
While the City undergo an evaluation of it's space needs for the future, the City desires to utilize
temporary trailers to satisfy the needs short term.

Overview
The City of Elk River is requesting a IUP to permit the installation of temporary trailers for offices,
to allow the City to plan for potential future expansion.
Applicable Reaulations
Standards for Issuance of a Conditional/ Interim Use Permit (Section 30-654)
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location;
1. Will not endanger, injure or detrimentallY a.ffect the use and enjqyment of other propertY in the immediate
vicinity or the public health, safety, morals, comfort, convenience or general weifare of the neighborhood or the
city.
The trailer does not appear to negatively impact the surrounding properties.
2. Will be connstent with the comprehensive plan.
The Comprehensive Plan guides the existing use at Light Industrial. The addition does not
represent a change from the original use.
3. Will not impede the normal and orderlY development and improvement oj surrounding vacant propertY.
The temporary trailer does not appear to impede the orderly growth of adjacent properties.

4. Will be served adequatelY by and will not adverselY a.ffect essential public facilities and servzces including
streets, police and fire protection, drainage, refuse disposal, water and sewer systems, parks and schools; and
will not, in particular, create traffic congestion or interference with traffic on a4jacent and neighboring public
thoroughfares.
The trailer should not significantly increase pressure on adjacent roadways.
5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be
detrimental to a1'!Y persons or propertY because rif excessive traffic, noise, smoke, fumes, glare, odors, dust or
vibrations.
It does not appear that the noise, traffic, smoke, etc causes negative impacts to the
surrounding property.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of mqjor importance.
To staff's knowledge, there are no natural features in danger with the addition.
7. Will fullY complY with all other requirements of this Code, including a1'!Y app!zcable requirements and
standards for the issuance of a Izcense or permit to establish and operate the proposed use in the city.
It is expected that the applicant will comply with all other requirements, including the Fire
Code, Plumbing, and building code.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the addition is consistent with all
of these standards.
Analysis
The applicant is requesting a conditional use permit to permit the placement of two 12' by 44' office
trailers, one on the east side of the building, and the other on the north side of the building. The
trailer ~ould each house two 'permanent' offices, and meeting space for employees. The trailer
would be placed in the property for 3 years, allowing the City Council and public works staff to
evaluate their space needs.
The trailer would be located on existing green space adjacent to the building.

Recommendation
Because the request is consistent with the Standards for a Conditional Use Permit, Staff
recommends the Planning Commission approve the conditional use permit as noted above.

PROJECT DESCRIPTION:
The City of Elk River is proposing to locate a 12' by 44' portable office trailer in front of
the Public W or1es garage at 19000 Elk Lake Road to provide temporary office space for
the Street Superintendent and Assistant Street Superintendent.
Normal office hours are from 7:00 am to 4:30 pm, Monday through Friday. The office
will be open 24 hours per day during snow events and emergency responses.
The portable.office contains two offices and will be occupied by two individuals with an
occasional meeting of not more than 12 persons. The parking consists of24 regular
parking stalls and one handicap stall. There will be no additional persons added to the
Street or Park Department s1:a.fI: so there is no need for additional parking stalls.
Since the office trailer is temporary until the building expansion, there is no screening
proposed. The portable office has vertical grooved wood siding on the exterior and the
skirting will be of like materials. There are no changes proposed for exterior signage on
this site. In addition, there is no exterior storage involving this portable office trailer.
The site for the trailer location involves an area of 24' by 65'. A low retaining wall was
removed and will be replaced. In addition, 3 small trees and 6 bushes were also removed.
The site was leveled to accommodate the trailer. There was minimal site impact.
This interim use permit is for a period of 3 years.
