Prepared by Sheila Cartney, Senior Planner Item Description Request by Thomas and Janet Weishalla for an Administrative Subdivision (Acorn Woods), Case No. AS 07-05 - Public Hearing Reviewed by erem Barnhart, Plannin Reviewed by Action Requested Staff recommends that City Council approve the Administrative Subdivision (Acorn Woods) to create two lots from an existing lot (75-121-4420), with the following conditions: 1. All comments from Sherburne County Public Works memo dated September 12, 2007 and May 24, 2007 shall be addressed. 2. The development shall meet all applicable fire codes. In addition to the easements shown on the preliminary plat, the following easements shall be provided: a. A 15 foot trail easement along the entire length of Proctor as it adjoins the subject plat b. A shared driveway easement 3. Park dedication shall be provided in the following manner: a. In the form of cash for 1 lot at the rate applicable at the time of final plat, 2007 rate is $3,300.00 4. All required subdivision/park information shall be provided in an electronic format (.dwg file) as required by the City Ordinance and Land Use Application prior to recording of the plat. Background/Discussion The subject site is 5.63 acres and is zoned R1a. The applicant is proposing to subdivide the lot into two lots. There is an existing home on what will be Lot 1 Block 1. The site is heavily wooded with significant topography. Applicable Regulations Subdivision These findings are necessary for the City Council approval of the preliminary plat and the final plat: (1) The proposed subdivision is consistent with the zoning regulations (article VI of this chapter) and conforms in all respects with all requirements of this Code, including the zoning regulations and this article. (2) The proposed subdivision is consistent with all applicable general and specialized city, county, and regional plans, including, but not limited to, the city's comprehensive development plan. (3) The pf?ysical characteristics of the site, including but not limited to topograpf?y, soils, vegetation, susceptibility to erosion and siltation, susceptibility to flooding, and drainage are suitable for the type and density of development and uses contemplated. (4) The proposed subdivision makes adequate provision for water supplY, storm drainage, sewage transportation, erosion control and all other services, facilities and improvements othenvise required in this article. (5) The proposed subdivision will not cause substantial environmental damage. (7) The proposed subdivision will not have an undue and adverse impact on the reasonable development of neighboring land. (8) The proposed subdivision is not premature. A subdivision is premature if a'!)! of the following exists: a. Lack of adequate stormwater drainage. b. Lack of adequate roads. c. Lack of adequate sanitary sewer .[Jstems. d. Lack of adequate offsite public improvements or support .[Jstems. In the review of the standards for fInal plat as outlined, it appears that the request is consistent with all of these standards. Analysis An Administrative Subdivision by Simple Plat is permitted when the existing property has a metes and bounds description, where the result will be four or fewer lots, and does not require dedication of public right-of-way for purposes of gaining access, and the property has not been previously subdivided. The subject site meets this criterion; the applicant is requesting approval of an Administrative Subdivision to create two lots that are consistent with zoning and the Comprehensive Land Use Plan. Comprehensive Plan The Comprehensive Plan designates this lot as Urban Residential. The Urban Residential is intended for low density residential. The proposed subdivision is consistent with the Comprehensive Plan. Lots / density - According to the Comprehensive Plan, Rural Residential is for low density development with a gross density of 1 unit per acre. As proposed Lot 1 will be 2.5 acres and Lot 2 will be 2.6 acres, both consistent with the Comprehensive Plan. Natural Resources Natural Resources Inventory (NRI) - Indicates Forest Communities. The site is heavily wooded with signifIcant topography. The applicant should try to preserve as many trees as possible. Parks A 15 foot trail easement along Proctor Road is recommended. Mr. Weishalla has been in contact with our office; in May 2007 he applied for and was granted an access permit for the property to the north, but I had not reviewed any of the details. At that time he indicated his desire to subdivide the larger lot, which would become Acorn Woods, so our permit person covered the County's conditions for subdividing. Our conditions are that the existing access will remain unaltered and serve as a shared driveway. Easements satisfactory to the City are required. The County requires 50' of dedicated right of way. The mylars shall have the limited access symbol applied to the drawing. The owner is required to purchase swing away mailbox standards. The owner is required to improve sight distance from the access by cutting trees to satisfy the May permit. The final plat drawing along with payment of plat checking fees must be presented to the County Surveyor along with a recent title commitment for final plat check before releasing the document for mylars. The limited access symbol must also be applied to the drawing, please allow a 30 foot opening for the residential access. Please call their office with any questions or comments (763-241-7004). The access must be constructed to conform to the standards of the Sherburne County Public Works Department. Per our meeting at your site (5/23/2007) you will need to construct the access perpendicular to CH 77 at the site agreed upon (near the cedar tree). To meet current county standards you are responsible to grade the driving top of the access as to not allow any drainage onto CH 77. A 15" minimum diameter corrugated metal culvert will be required in the right of way under your access. To match the existing ditch section and to accommodate a 15 foot driving top the culvert must be 40 feet long from end of safety apron to end of safety apron. The safety aprons must be 1:6 (vertical: horizontal) and have safety grates installed. The slopes of the new access must be constructed at the 1:6 slope also and have seeded topsoil in place. Per our discussions at the site there will be required right of way clearing, mainly consisting of trees leaning into the right of way. Please notify our department two weeks in advance for installation of the mailbox setting. Enclosed is the original Access to County Highway Permit Application. Please carefully read the requirements on the backside of the permit. All requirements must be met for final inspection approval. After construction is completed, date and sign the bottom portion of the application and return it to the Sherburne County Public Works.
