Case No. CU 07-25 - Public Hearing Reviewed by Action Requested After the Planning Commission public hearing, Stoneworks recognizes that there are concerns related to the sandblasting operation, in addition to the already understood noise and hours of operation concerns. Stoneworks desires to fully understand Councils concerns before proceeding with plans to address those recently raised. Stoneworks has requested the Council table formal action on the request after the public hearing and Council discussion, with the intention of coming back to the Council in October. Summary Stoneworks is requesting a CUP to memorialize and confIrm the operations of their business. In 2005, a CUP was granted allowing the business to operate. Over the last several months, staff has received a number of complaints from one property owner regarding noise and hours of operation. The CUP does not specifIcally regulate the hours of operation, nor does it say whether or not work can be performed outdoors. While discussion during the meetings did include the location of outdoor functions, there was no condition imposed. The Planning Commission recommended approval for the Conditional Use Permit memorializing the operations parameters for Stoneworks: Hours: general operation 6a to 6p, 7 days per week Hours: outside operation 7a to 6p M-F, 8a to 5p S/S Outside operation to include cutting, sandblasting, power washing. Outside operations shall be completed in an enclosed area to meet or exceed regulatory standards. And subject to 2 conditions: 1. Payment of application and review fees 2. All other conditions as previously imposed: 1. The existing access from Highway 169 can not be utilized by this facility. The proposed connection to the existing driveway shall be eliminated from the site plan. 2. All comments of the City Engineer shall be addressed. The eXlsting residence be allowed to remain provided that the occupants are employees of Plaisted Companies or JT Land Company and their job is that of caretaker of the mining pit and or production facility. 4. Public Comment Public comment was received noting concerns with the noise, hours of operation, and dust that were all part of the business. There are two property owners primarily affected, both were in attendance at the meeting, in addition to a renter of one of the properties. One of the property owners provided information that suggested that sandblasting operations be located in a controlled environment. A copy of this information is attached. Other residents commented on the general noise that is a part of the sandblasting operation. Planning Commission Discussion The Planning Commission received the public comments, and discussed appropriate conditions to protect the adjacent residents. Although not a part of the recommendation, the Commission suggested that the hours of operation be consistent with those hours recently imposed on Tiller (7-7 M - F, and 7- Noon on Saturday) The Commission also discussed moving the operation to another location within the site, but ultimately required an enclosure and necessary modifications to ensure the operation meets or exceeds regulatory standards. OSHA publishes Minnesota Noise Standards for residential areas, establishing allowable noise levels for residential areas. These levels are measured at the property line near residences, and are as follows: Daytime (Minnesota standards defme daytime as 7 a to 10 p) 6S decibels, and nighttime is SS decibels. Attachments . It was not noted what functions would occur outdoors. Over the summer, City staff received complaints from an adjacent resident regarding the noise and dust from the sandblasting operation. This operation is staged north of the main building. Additional complaints received from the same resident regarding the hours this business is operating, and a concern with the business using the 211 ths private road as an access, in violation of their Condition Use Permit condition. \X7hile the CUP does not explicitly prohibit work outdoors, or the hours of operation, staff has asked that the business approach the Planning Commission and City Council to memorialize the appropriate actions, and to provide the affected property owners an opportunity to provide input. Analvsis As noted above, the concerns with this type of use are generally related to noise and traffic. Recognizing that the use is an industrial use, and prone to higher levels of nolse, dust, and traffic, it is necessary to find an appropriate balance bet\xTeen the permitted zoned business and adjacent residential, which may be transitory, as the area receives development and redevelopment pressure. Staff has no suggestions to change the proposed hours of operation. The Commission could discuss requiring the relocation of the sandblasting area to lUcrease the distance from the adjacent residential structures. Comorehensive Plan The existing and proposed land use is consistent with the Comprehensive Plan. Transoortation Streets - Access to the site is via the Plaisted property from the south. No access is permitted from 169 via 211 th private road. However, it should be noted that that drive may not be closed to preserve necessary emergency access. Recommendation. Staff recommends that the Planning Commission recommend approval as outlined above. There is currently a residence, three accessory buildings and a silo on the property. The residence is occupied by employees of Plaisted Companies; they are caretakers of the mining pit during off hours. The property shares an access from Highway 169 with two adjacent residences. The site is a mix of woods and open area. The northwest corner of the site is wooded. The properties to the south and west are part of the Plaisted mining operation; the properties to the east and north are large lot residences. Proposal Operations The business will operate from 6AM to 6PM seven days a week. All production will take place inside the building. The applicant has indicated that there will be six employees per shift. Building The applicant is proposing to construct a 12,000 square foot concrete product manufacturing facility. The building will be 80' X 150'. The exterior of the building will be pre-finished metal panels, which are on the acceptable materials list for the 12 district. There are three loading doors, one on the south, north and west sides, and a service door on the north side. There will be a 10 foot wide concrete pad around the building. There Virill be some downcast lights on the outside of the building. No other site lighting is proposed. Access. Parking and Storage Access to the site will be from the south through the Plaisted mining pit. The applicant and the City have had conversations with ~1)OT regarding using the existing residential driveway as a commercial access to this facility. The existing driveway from the north, off of Highway 169, can not be used by this facility. Per MNDOT, the access can only be used by the current single family residences. The site plan will have to be revised to eliminate the connection to the existing driveway from Highway 169. The area around the building will be used for storage of products and employee parking. There is sufficient room available to accommodate parking for the anticipated 6 employees per shift. There are 11 aggregate bins located north of the building. Bobcats ",1.11 be used to transport aggregate from the bins to the inside of the building. Grading. Drainage and Utilities Grading, drainage and utilities are addressed in the City Engineer's m~mo. He discussed the site conditions, hours of operation, building design, parking, circulation, and the existing resident. Chair Anderson opened the public hearing. The really dangerous stuff is so tine you can't see it Breathing air containing this fine dust can damage your lungs. You must always wear a helmet when sandblasting and there is only one type of helmet that will protect you. The type of , helmet you must use is a helmet that is supplied with clear air. The helmet must be a good fit and in good working condition. . A damaged helmet is dangerous. Do not use equipment that has parts missing or damaged. . The helmet must also fit well so that dangerous dusty air does not leak into the helmet while you are working. . The air supplied to your helmet must be dean and free of dangerous dust. To be sure that the air is clean a filter must be fitted in the line between the compressor supplying the air and the helmet. . Your employer is required, by law, to provide you with the forced air full face helmet and the clean air supply to go with it. He is also required to train you how to use it and how to maintain it and keep it clean. . Your employer must check the dust levels in the area where sandblasting is being done. . At least once every three years, your employer Is required to provide you with a medical check~up. including an x-ray, to make sure that your lungs are not damaged. If you are working in a sandblasting area, even if you are only cleaning up, you must also wear a respirator. Remember, THE DANGEROUS DUST IS INVISIBLE. Cleaning up can make the dangerous dust airborne and breathable again. If the job site can be wet down you should we down before startlngclean up. The dangerous dust can get into your clothes and can continue to get airborne as you move. Don't try to blow it off with compressed air; this only stirs it up worse. lf you can, change into clean clothes before going home. Do Not Forget! . Invisible dangerous dust is made when sand blasting with silica sand. . You must wear an air supplied helmet when sandblasting, . Your employer knows the equipment and traIning you require. One of the main reasons is the high concentration of Quartz or other high crystalline silica content minerals in the abrasive sands used In sandblasting operations. Roughly 5 percent, or 100,000, of the workers in the United States that are exposed to crystalline silica dust on the job are employed as sandblasters. Many other occupations involve sandblasting on a pan-time basis. Sandblasting is typically used to clean or remove anything from automobile paint to sand from foundry castings.
