Adopt attached resolution supporting incorporation of Burns Township.
Background/Discussion
Burns Township has decided to seek incorporation as a city. Burns Township is seeking Elk River's
support in this process and would like the City Council to consider the attached xesoludon. Burns
Township expects to file the incorporation petition with the State sometime in late October and would
like to submit the resolution of support along with their application.

Dear Lori Johnson:
After many years of discussion with the residents of Bums Township and after much
deliberation by the Town Board, Bums Township has decided to seek incorporation as a City.
The incorporation process is an arduous process that will require filing a petition with the State
of Minnesota and the submission of a substantial amount of written documentation and oral
testimony.
Bums Township is seeking Elk River's support in this process in the form of the enclosed
Resolution Supporting Incorporation of Bums Township. We would then submit this Resolution
of Support to the State with Burn's petition to incorporate. We expect to file the incorporation
petition with the State sometime in late October.
Can you please place this Resolution of Support on the October 1, 2007 City Council
agenda for consideration by the Elk River City Council? Several of the Burns Town Board
members will be available to attend this meeting to answer any questions that the City Council
may have regarding Burns' desire to incorporate. In the meantime, please feel free to contact me

regarding the proposed incorporation or the Resolution of Support or if you need any additional

RESOLUTION 07-
A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION SUPPORTING INCORPORATION OF BURNS
TOWNSHIP
WHEREAS, Burns Township intends to incorporate pursuant to Minnesota Statutes
Section 414.02; and
WHEREAS, the City of Elk River abuts the "affected territory" of Burns Township
and will be given notice of the proposed incorporation as required by
Minnesota Statutes Sections 414.02 and 414.09; and
WHEREAS, the increased municipal powers that Burns will be able to exercise upon
incoxpoxauon will enhance the health, safety, and welfare of the citizens
of the entire area, including the citizens of Burns Township and the
citizens of the City of Elk River.
NOW, THEREFORE, BE IT RESOLVED by the Elk River City Council that fox the
foregoing reasons, the City of Elk River supports the proposed incorporation of Burns
Township into a city.
