RE: WEST TRUNK HIGHWAY 10 FRONTAGE ROAD CONCEPT
COOPERATIVE AGREEMENT WITH MnDOT
Dear Council Members:
During our annual City bus tour in June 1994 with MnDOT District 3 personnel, the
proposed development of the western part of the City was discussed relative to its impacts
on TH 10. Since that time, MnDOT has proposed a corridor study of both TH 10 and
TH 169 through the City of Elk River. The study would determine the existing conditions
and analyze future traffic growth to the highway system. The City of Elk River agreed to
assist MnDOT with this corridor study. It is anticipated that preliminary findings from the
study will be available within the next 30 days.
Also on our spring tour in June, MnDOT indicated that they were willing to participate in
the funding of frontage road construction if a benefit to the trunk highway system could be
proven.
Based on this input from MnDOT, we have been working closely with them to develop a
concept for frontage roads in the western area of the City which could be submitted for
inclusion in the Cooperative Agreement process. As you are aware from the improvement
made several years at TH 169 and Main Street, the Cooperative Agreement process will
participate in the funding of improvements on City streets and trunk highways which are
deemed to be of benefit to the entire system.
Attached for your review is a layout on Exhibit 1 which shows the concept for frontage
roads in the western area of the City. It includes a frontage road on the south side of
TH 10 running from Joplin Street to Waco Street with a short extension east of Joplin to
tie in Orono Road. It also includes an extension of the frontage road on the north side of
TH 10 to the Joplin Street intersection. In the long term, we would envision possibly four
signalized intersections, those being Joplin at TH 10 and at the south frontage road, and
Waco at TH 10 and the south frontage road. We will be requesting that MnDOT
participate in all portions of these improvements with the exception of Joplin I s construction
and the south frontage road between Joplin and the Gagne property. We have indicated to
MnDOT that there are development proposals underway which will require these roads

to be built in 1995. MnDOT also indicated that they do have access control across the
Emmerich property and would find difficulty in participating in a Cooperative Agreement
for that section of road. They also indicated that the City's proceeding with the initial
construction phases indicates that the City is serious about the construction of these roads
and the timing for their extensions.
Monday evening, there will be four items for the City Council's consideration and
recommendation. They include the following:
1. Review of the attached concept for frontage roads in the western area of the City.
This needs to be reviewed and approved or modified such that it can be submitted
to MnDOT.
2. MnDOT has indicated they have a signal programmed for the intersection of TH 10
and Upland, and that these monies could be reprogrammed for a signal system at
Joplin and TH 10. The City Council should consider whether or not they would
like to request MnDOT move this funding such that a signal at Joplin and TH 10
could be constructed sooner.

3.
We need to review with the City Council those items which we can indicate to
MnDOT as a benefit to the trunk highway system. The clearest and best benefit
would be providing access control along the entire south side of TH 10 from the
Gagne property to the west City limits.
Other items would include potentially closing medians which are no longer needed
if frontage roads are constructed, or possibly changing full access medians to right-
in/right-out only. I will be prepared with an aerial strip map of the area to discuss
this in more detail. The size of that map did not allow for it to be included with
each individual Council packet.
4. After the above three items are discussed, there is attached a draft resolution which
we would ask City Council to consider and adopt. This is necessary for submittal
to MnDOT's Cooperative Agreement Program.

Once our submittal is reviewed by MnDOT, it will be ranked low, medium, or high. High
ranking would assure funding in the next cycle. MnDOT has indicated that the next time
they will have Cooperative Agreement monies available in any substantial amount would
be Fiscal Year 1997, which begins in July 1996. If our project is ranked in the high
category, the City Council will be asked to consider whether or not you would like to
proceed with plans and specifications, anticipating funding in July of 1996, which would
allow construction to begin immediately. We anticipate that the review of our packet will
take approximately three months, so it will likely be late spring or early summer before we
have any response from MnDOT relative to the ranking.

RESOLUTION 95 -
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION REQUESTING MINNESOTA DEPARTMENT
OF TRANSPORTATION TO ENTER INTO A
COOPERATIVE AGREEMENT FOR IMPROVEMENTS TO
WEST TRUNK HIGHWAY 10 FRONTAGE ROADS.
WHEREAS, the City of Elk River is requesting the Minnesota Department of Transportation
to participate in certain improvements along a portion of Trunk Highway No. 10
located in the City of Elk River in Sherburne County; and
WHEREAS, MSA Consulting Engineer representing of the City of Elk River has met with
MnDOT District 3 in the planning of said improvements; and
WHEREAS, said improvements will eliminate several median crossing and access points; and
WHEREAS, said improvements will limit access to designated street intersections with Trunk
Highway 10; and
WHEREAS, said improvements will improve the level of service of through traffic along
Trunk Highway 10;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Elk River, Minnesota:
1. That the State of Minnesota, Department of Transportation is requested to enter into an
agreement for improvements on the aforesaid portion of Trunk Highway 10 consisting
of the south frontage road along Trunk Highway 10 between Waco St. and Hudson St.,
the north frontage road along Trunk Highway 10 between Waco St. and Joplin Ave.,
Joplin Ave. from Trunk Highway 10 and south frontage road, Waco St. from Trunk
Highway 10 and south frontage road, and the north frontage road between Hudson St.
and Gary St. in which the State will share in the cost.
BE IN FURTHER RESOLVED that following approval by the Minnesota Department of
Transportation of plans and specifications for said improvements of said trunk highway and
before a contract is awarded for the construction of said improvements:
1. The State shall enter into an agreement with the City which shall provide that the State
pay its share of the cost of the requested improvements as determined by the State in
keeping with the latest edition of MnDOT Policy Guidelines (a copy of which has been
received for the Minnesota Department of Transportation's District Engineer); and

2.
If the City lets the construction contract, the State will deposit with the City, upon
demand after execution of this agreement and before the start of construction, a sum
equal to an estimate of the State's share as prepared by the Minnesota Department of
Transportation.
3. The City shall, in addition to paying its proportionate share of the cost of the proposed
work, obtain at its sole cost and expense, all necessary right-of-way easements and
construction permits for the work to be performed outside the limits of the trunk highway
or established City streets and roads, together with all drainage outlet rights where
necessary. Such easements, permits and rights shall be obtained and certified copies of
them furnished the Department of Transportation before and contract for the proposed
work is awarded.
