Staff is requesting the council adopt the attached ordinance amendments and resolutions.
Background/Discussion
The Heritage Preservation Commission (HPC) and Energy City Commission (ECC) are requesting
ordinance amendments to clean up language under "Meetings and Rules of Procedure" in the Elk River
City Code of Ordinances. The changes are related to dates and times that each commission meets.
These changes would go into effect on January 1, 2008.
The ordinance for the Heritage Preservation Commission was written so they had to meet at least four
times each calendar year.. The HPC has been meeting on a regular basis and would like to have the
ordinance read "... hold one regular meeting each month. The dates, times, and locations shall be
established by city council resolution. Special and cancelled meetings may be held at any time at the
request of the chair or the request of two other commissioners." Other changes include noticing
members and posting at city hall at least three days prior to the meeting. Attached please find the
ordinance with the proposed changes and the original language.
The resolution for the ordinance amendment is also attached for your consideration. The HPC is
proposing to meet on the second Tuesday of the month at 6:00 p.m. at City Hall.
The ordinance for the ECC was written the same as the HPC stating they would meet at least four times
each calendar year. The ECC has been meeting on a monthly basis and would like to have the ordinance
read "... hold one regular meeting each month." Attached please find the ordinance with the proposed
changes and the original language.
The resolution for the ordinance amendment is also attached for your consideration. The ECC is
proposing to continue meeting on the third Wednesday of the month at 1:30 p.m. at City Hall.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 2-215, TITLED "MEETINGS AND RULES OF PROCEDURE"
UNDER DIVISION 2, TITLED "HERITAGE PRESERVATION
COMMISSION" OF THE ELK RIVER CITY CODE OF ORDINANCES
The City Council of the City of Elk River does hereby ordain as follows:

Section 1. Section 2-215 titled, Meetings and Rules of Procedure, of the City of
Elk River Code of Ordinances shall be amended to read as follows:
The heritage preservation commission shall meet hold one reQUlar meeting each
month. The dates, times, and locations will be established by city council resolution a~-IeRS~-
Special and cancelled meetings may be determined at any time at the reduest of the chair or
two other commissioners. Regular, special, and cancelled notices of the commission
meetings shall be communicated to the members; and posted at city hall;
' at least three days prior to the meeting. Except as provided in
this division, all commission meetings shall be governed and operated pursuant to Robert's
Rules of Order, Newly Revised (ninth edition) and open to the public.
Section 2. That this ordinance shall take effect January 1, 2008.

RESOLUTION 07-
A RESOLUTION OF THE CITY OF ELK RIVER
A RESOLUTION ESTABLISHING THE HERITAGE PRESERVATION
COMMISSION MEETING DATES
WHEREAS, the Elk River City Council has previously established an advisory committee
related to issues pertaining to the historical, archaeological, engineering, and cultural heritage
of the City of Elk River; and
WHEREAS, the Elk River City Council previously adopted Chapter 2, Division 2 of the
Elk .River City Code, establishing the Heritage Preservation Commission; and
WHEREAS, Elk River City Code, Section 2-215, titled, "Meetings and rules of
procedure," calls for the City Council to establish by resolution the meeting dates, times, and
locations of the Heritage Preservation Commission.
NOW, THEREFORE, BE IT RESOLVED by the Ciry Council of the City of Elk River
that effective January 1, 2008, the Elk River Heritage Preservation
Commission shall meet on the second Tuesday of the month, at 6:00 p.m., at
City Hall.

Commission to promote the Ciry of Elk River as a hub of energy technology, energy
manufacturing, energy demonstrations, recycling, use of green products, and education; and
WHEREAS, the Elk River City Council previously adopted Chapter 2, Division 8, of the
Elk River City Code, establishing the Energy City Commission; and
WHEREAS, Elk River Ciry Code, Section 2-355, titled, "Meetings and rules of
procedure," calls for the City Council to establish by resolution the meeting dates, times, and
locations of the Energy City Commission.
NOW, THEREFORE, BE IT RESOLVED by the Ciry Council of the City of Elk River
that effective January 1, 2008, the Elk River Energy City Commission shall
meet on the third Wednesday of the month, at 1:30 p.m., at Ciry Hall.
