Background/Discussion On July 17, 2007 the City Council made a motion to establish a moratorium on issuing tobacco licenses to shops whereby tobacco sales is the primary purpose of the business. Council requested staff research what options the city has related to drug paraphernalia, more stringent restrictions on tobacco shops for tobacco sampling, the Freedom to Breath Act, and zoning issues. This request is taking more time than anticipated and staff is requesting an extension of the moratorium in order to complete this process. WHEREAS, the City Council of the City of Elk River, on July I6, 2007, imposed asix- month moratorium on the licensing of tobacco sales fox establishments where the sale of tobacco products and smoking supplies is the primary business of the establishment; and WHEREAS, the purpose of the moratorium was to have City staff research and prepare fox City Council consideration amendments to the City's ordinance requirements fox the issuance of licenses for tobacco sales; and WHEREAS, City staff has commenced its investigation and research into the issues identified by the City Council, but will need additional time to prepare proposed ordinance amendments for City Council consideration. NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Elk River, Minnesota: 1. That the moratorium on tobacco licensing shall be extended to and including July 15, 2008, unless earlier revoked by resolution of the City CouncIl. 2. That during the moratorium period, the City shall not issue any new license for the sale of tobacco, nor approve the transfer of any existing license to a new licensee, fox any establishment where the sale of tobacco products and smoking supplies is the primary business of the establishment. 3. That the extension of the moratorium shall take effect upon adoption of this resolution. Passed and adopted the 13`" day of November, 2007. Stephanie A.
