A RESOLUTION OF THE CITY OF ELK RIVER CITY COUNCIL
A RESOLUTION EXTENDING A MORATORIUM ON THE ISSUANCE OR
TRANSFER OF LICENSES FOR THE SALE OF TOBACCO PRODUCTS.
WHEREAS, the City Council of the City of Elk River, on July 16, 2007, imposed asix-
month moratorium on the licensing of tobacco sales for establishments
where the sale of tobacco products and smoking supplies is the primary
business of the establishment; and
WHEREAS, the purpose of the moratorium was to have City staff research and prepare
fox Ciry Council consideration amendments to the City's ordinance
requirements fox the issuance of licenses fox tobacco sales; and
WHEREAS, City staff has commenced its investigation and research into the issues
identified by the City Council, but will need additional time to prepare
proposed ordinance amendments fox City Council consideration.
NOW, THEREFORE BE IT RESOLVED by the Ciry Council of the City of Elk River,
Minnesota:
• 1. That the moratorium on tobacco licensing shall be extended to and including
July 15, 2008, unless earlier revoked by resolution of the City CouncIl.
2. That during the maratorium period, the City shall not issue any new license
fox the sale of tobacco, nor approve the transfer of any existing license to a new licensee, fox
any establishment where the sale of tobacco products and smoking supplies is the primary
business of the establishment.
3. That the extension of the moratorium shall take effect upon adoption of this
resolution.
