Background/Discussion
The Council approved the attached ordinance and resolution changes at the November 5, 2007 meeting.
This item is on the Consent agenda in order to formalize the changes and have the ordinance published
and codified in the correct format for the City Code.
A resolution is also needed amending the parking hours downtown. Elk River Code Section 74.96, "No
Parking, Stopping, or Standing Zones" requires a resolution in order to change the hours for on-street
parking.
Financial Impact.
There will be costs to publish the ordinance as required by law in the official city newspaper.

CITY OF ELK RIVER
AN ORDINANCE OF THE CITY OF ELK RIVER AMENDING
SECTION 74-97, "NIGHTIME PARKING," SECTION 74-99, "PARKING IN
MUNICIPAL PARKING LOTS," AND SECTION 74-102, "SNOW
REMOVAL PARKING" OF THE CITY CODE OF ORDINANCES
The City Council of the City of Elk River does hereby ordain as follows:

Section 1. Section 74-97 tided, Nighttime Parking, of the City of Elk River
Code of Ordinances shall be amended to read as follows:
(a) No vehicle shall be parked between 2:00 a.m. and 6:00 a.m. on Lowell and Jackson
Avenues between Highway 10 and Main Street, on Main Street between Lowell
Avenue and Highway 10, on Jackson Avenue between Highway 10 and 5th Street,
and on Railroad Drive.

.(b {E} Violations of this section are punishable as provided in section 74-91.
Section 2. Section 74-99 titled, Parking in Municipal Parking Lots, of the City of
Elk River Code of Ordinances shall be amended to read as follows:
(a) The municipal parking lots along the Burlington Northern Railroad are designated
for either commuter or public parking. No permits axe required to park in these lots.
Where posted, time limits are enforced.
(b) The posted employee parking area within the King Avenue parking lot requires
employee vehicles to display parking permits as issued by the police chief or his
designee. Employee parking permits are issued for an annual fee as listed in the city
fee schedule. and allow employees to park in the designated employee parking area
on a first come, first served basis between 8:00 a.m. and 6:00 ~.m., Monday through
Friday. The residents of the "Special District" may also purchase a total of nine
business permits. The Special District includes residences in the Brick Block, the
Cinema Block, and the Houlton Block.
After 6:00 p.m. and unti18:00 a.m. Monday through Friday, and all day on weekends,
the King Avenue parking lot is open to an~and all~arking. (With the exception of

The north section of the King Avenue lot shall have twenty-six (26) posted spots
designated "Designated Snow Removal Parking Only,, Nov. 15-April 15, 6:00 p.m.-
8:00 a.m." These same spots will also be posted "Employee parking only-permit
required, M-F 8:00 a.m.-6:00 p.m."

Section 3. Section 74-102 titled, Snow Removal Parking, of the City of Elk River
Code of Ordinances shall be amended to read as follows:
(a) Parking restrictions. Public safety requires the rapid and efficient removal of snow or
ice from city streets, public highways or other thoroughfares. No person shall stop,
stand, or park any vehicle or permit it to stand on any street in the city between the
hours of 2:00 a.m. and 6:00 a.m. on any day between November 15 and April 15.
,~b~ King Avenue Parking Lot Restrictions. Except for the signed and designated snow
removal parking on the north side of the lot as described in Section 74.99~subd. d~
no other vehicle shall park in this lot between the hours of 2:00 a.m. and 6:00 p.m.

hereby authorized in accordance with MN State Statute 169.041 as may be amended
from time to time, to remove such vehicle from the street or public parking lot and
to store the vehicles for the owner thereof. The removal and storage charge shall be
paid by the owner of such vehicle.

RESOLUTION 07-
A RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION APPROVING CHANGES TO THE DOWNTOWN
PARKING LIMITS FOR ON-STREET PARKING
WHEREAS, the City of Elk River regulates by resolution the time limits restricting on-
street parking in the downtown area. (City Ordinance 74.96); and,
WHEREAS, to have enough on-street parking for customers and clients of downtown
businesses;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the Ciry of Elk
River, Minnesota:
1. Current restrictions or limits fox on-street parking in the downtown area of Elk River
will be removed.
2. All on-street areas in the downtown Elk River area will be posted to restrict all on-
streetparking to no more than three hours.
