A RESOLUTION OF THE CITY OF CITY OF ELK RIVER
A RESOLUTION REGARDING A TRAIL
EASEMENT FOR A PEDESTRIAN BRIDGE PROJECT.
WHEREAS
WHEREAS
WHEREAS
the City of Elk River has developed plans to construct'State Project 204-107-05,
a pedestrian bridge over Trunk Highway 169, using State and Federal funds; and
the approach trail and sidewalk to the bridge on the west side of Trunk Highway
169 traverse property owned by the City of Elk River; and
the Federal Highway Administration requires a dedicated trail easement for such
projects;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Elk River, Minnesota:
1. The land encompassing the sidewalk and pedestrian/bicycle path constructed on parcel
number 75-127-4302, owned by the City of Elk River, as shown on attached Exhibit A, is
hereby dedicated as a pedestrian easement.
2. Such trail dedication shall remain in effect until such time as mutually agreed upon by
the City of Elk River and the Federal Highway Administration or its authorized
representatives.
3. The City of Elk River reserves the right to make future modifications to said trail or
sidewalk locations provided such new locations continue to meet Minnesota Department
of Transportation and Federal Highway Administration standards, provide adequate
access to said bridge and be covered by a trail easement.
