SR 12-10-2007Item # 6 ~~, .~- ver MEMORANDUM TO: Mayor and City Council FROM: Lori Johnson, City Administrator DATE: December 10, 2007 SUBJECT: joint Meeting with County Board of Commissioners There is a long list of topics for the joint meeting, many of which are updates that will be made by Sherburne County staff. We axe looking forward to a productive discussion on items of mutual interest. Below are the items formally on the agenda for discussion along with background information on each: 6.1. Update on Government Center Property County Administrator Brian Bensen will give the Council an update on the status of the County's facilities master plan. They are currently evaluating future needs and plans for the government center, the Jackson Avenue public works facility, and the remaining property around the government center. There has been discussion about locating a Veteran's Clinic on the County's property, and Mr. Bensen will provide an update on the status of that project as well. 6.2. County Transportation Plan Public Works Director John Menter will update the Council on the County's transportation plan which has yet to be adopted in final form. Mr. Menter was at the May 7, 2007, City Council meeting and presented an update on the County's draft transportation plan including a draft list of proposed projects. The May information is attached for your review. 6.3. Northstar Corridor Assistant County Administrator Luci Botzek will update the City Council on the Northstar Corridor activities and timeline. Hex update will include any discussions that have taken place regarding public transportation to and from the depot including what role, if any, River Rider plays in providing that service. Also, we have recently discussed the rail authority tax the County currently levies on all property in Sherburne County to pay for rail related costs. Staff is in the process of gathering information on the costs to the City so a policy can be drafted to address how those funds maybe used to reimburse cities for costs incurred for maintaining the depot parking lots. 6.4. Assessor's Update on Property Values In response to the Council's questions about property values reflecting changes in the current market conditions, County Assessor Jerry Kritzeck will provide an update on the adjustments the assessing department has made and expects to make to property values. 6.5. Landfill Update City and County staff have been working together to prepare for the possible submission of a request for a landfill expansion from the Elk River Landfill. The discussion at this meeting will be on the process and City/County roles only. We cannot respond to or comment on anything specific about the expansion as we have not received an application. However, County and City staff agree that if an application is received, the City will proceed with its approvals first because the City must act on a comprehensive plan change before the County can accept a license application. The property proposed for expansion is identified as mineral excavation in the comprehensive plan. 6.6. RRT Negotiations County Administrator Brian Bensen would like to update the City Council on the County's negotiations with RRT, owners of the refuse derived fuel facility. The County's agreement with RRT expires in 2009. 6.7. Fairground Relocation Sherburne County has taken action to relocate the County fairgrounds. At least one Councilrnember has discussed an interest in revisiting this topic with the County Board Attached for your information is a letter prepared by County Attorney Kathy Heaney regarding the land transactions on the fairgrounds property. 6.8. Sherburne County Landfill Legacy Grant The City and County have entered into an agreement awarding the City $1,403,000 for the YMCA project through the Legacy Grant. According to the County's formula, the City is eligible for up to $2 million of grant funds. The current grant award was based on estimated qualifying materials in the project. Recent data from the project construction manager indicates that this estimate is low; there may be eligible materials far in excess of $2 million. According to discussions with County staff, the City will be allowed to amend the grant agreement to increase the amount based on the actual eligible recycled material used in the construction project. If that is the case, the City maybe able to use the entire grant amount for this project. S:\Council\Lori\2007\Joint meeting county board 12 10 07.doc Finally, in response to the Council's questions about communications with the County, as I have indicated to the Council previously, at a staff level the County and City work very well together. I have a very good working relationship with County staff and I communicate frequently with various County staff on many different topics. I believe this is true for other City staff as well. We work together with the County on day-to-day issues as well as discussing bigger issues we know will affect both parties in the future such as transportation. So, needless to say, 1 have a little bit of a historical perspective (plus files in my office to assist with my memory.) 1 am enclosing for your edification copies of the following: a. The Order for Judgment and Judgment on the Elk River Fairgrounds, b. Affidavits of Service on the same. c. A copy of the conservation easement on the then Cox property (now known as the Oak Savannah) for Parcel C (unexecuted -the recorded document is on file with the Recorder's Office). d. Copy of deed from the Sherburne County Agricultural Society to Sherburne County. For historical reference and per documentation from our file, !note: 1949 -- The Wigness family conveyed the Elk River Fairgrounds property to the Elk River Athletic Association by warranty deed; 1949 -- Elk River Athletic Association conveyed the lands to the Village of Elk River by deed to hold in trust. The .uses enumerated in the deed were: "As a municipal park, as an athletic field, and for other public purposes not inconsistent herewith,..ln the event that said land shall ever cease to be used for such purpose...land shall revert back to the (Athletic Association.)" Sherburne. mn. us www. co. sherburne. mn. us Sherburne County Board of Commissioners Sherburne County Fair Board November 13, 2007 Page 2 River Athletic Association is a defunct legal organization per the Secretary of State's Office when I did the research on the quiet title action. 1957 -- The Village of Elk River conveys the fairgrounds land to the Sherburne County Agricultural Society by quit claim deed. The deed states that the basis for the conveyance is: "premises shall be used for the purposes relating to the operation and conducting of a county fair, or any other purpose incidental to or consonant with the activity of an agricultural society." 1994 -- The Sherburne County Agricultural Society conveys the land to Sherburne County by quit claim deed. August 1996 -- Dave Loch and the undersigned began discussions with the Cox family on the donation of the lands and the establishment, inter alia, of the fairgrounds at the Becker site. 1997 -- Conservation agreement is entered into by the Cox family and the Minnesota Land Trust. The lands were split up into parcels. On Parcel C's conservation agreement, paragraph 7 provides: "The Protected Land shall be used for any of the following uses: farming, fairgrounds or wildlife habitat/native vegetation restoration....Buildings and other improvements reasonably necessary to serve the use permitted on the Protected Land (such as demonstration/exhibit buildings, restroom facilities, office/storage space, etc.) shall be allowed on the Protected Land." August 4, 2004 -- A copy of the Summons and Complaint for the Quiet Title action was conveyed by first class mail to Ms. Carole Iten, Sherburne County Fair Board Secretary, and Mr. Peter Beck, City Attorney for the City of Elk River. The notice of the action was also published in the Elk River Star News for a period of three weeks. 1 do have the 09.09.04 minutes from the Fair Board which state: "Deed to Land: The County Attorney's Office is in the process of cleaning up the deed and title to the fairgrounds property in Elk River. The Secretary was served with a Summons and Complaint in a Quiet Title matter. This is being done in order to have a clear title in the eventuality of a sale of the land." In a letter dated November 18, 2004, the County Attorney's Office served both the Secretary of the Fairgrounds and the City Attorney with a Notice of Motion and Motion for Default on the Quiet Title action. (Copies of the affidavits of service on the Fair Board and the City of Elk River Sherburne County Board of Commissioners Sherburne County Fair Board November 13, 2007 Page 3 are attached.) This matter was heard before the District Court on December 23, 2004, and the attached order was granted. You will note in the Order from the District Court on the quiet title action for the Sherburne County Fair lands that the County holds this land in fee, subject only to the lease agreement. Given the fact that the County Board has made its determination on the moving of the fair from its Elk River site to Becker, discussion of the lease agreement becomes moot. 1 do hope that this assists in answering some of the questions raised in the process. 1 have attached the salient documents that 1 believe would be helpful. Environmental Administrator Rebecca Haug stated the two locations in the City where a permanent Household Hazardous Waste Facility could be located would be at the Elk River Landfill and NRG. County Solid Waste Officer Dave Lucas answered questions stating that a permanent faality could be located at the landfill and the cost would be dependent on the local fire chief's interpretation of State codes. Ms. Haug stated that she has been working with Cliff Anderson of the Fire Department. Mr. Lucas answered that the money source could be structured into the RFP and thought that abatement money could be used. Chair Schmiesing stated that the County has only just begun discussions and there is the issue of whether a building should be built at the landfill site. It was felt to do on piecework basis with private industry rather than getting into the business and providing staff. Mr. Lucas stated that when he learned that the Stearns County Mobile HHW Collection Unit will no longer be able to participate in Elk River that he was in the process of scheduling events and included making these events open to the Citq of Elk River residents. Mr. Lucas stated that he has RFP's from other counties and with the Board's approval will be working with the County Attorney to draft for Sherburne County. He will continue to work at setting up regional events including the cities of 7.immerman, Big Lake, and Becker and will have something to satisfy the needs of Elk River residents. The County is looking for a business entity that meets the requirements of the State, falls under the umbrella of Tri-County and would not be owned, operated, and staffed by the County. Currently the Elk River Landfill is not under the State contract but would not have a problem with honoring those agreements. 4.2 Sherburne County Government Center Expansion Plan and Surrounding Land Devel~ment Plan Using a map of the Government Center and surrounding area, County Administrator Brian Bensen informed the group of possible expansion plans. He stated that there are 18 acres with a hiking trail and fencing and the area is located south of the frontage road, east of Waco Street and north of County Road 30. He illustrated the remaining undeveloped land purchased from the Wilson family. He stated that Union Street may be a potential future access. He indicated the possibility of the following projects: a joint project with the City of Becker for a public works facility; to add on to the existing Government Center building or build a free standing office (in approximately 4 years) -currently experiencing storage issue; in the future look at building a veteran's clinic (currently have a van going daily to VA Clinics and Hospital); with the remaining property have a complex similar to Target with possibly a restaurant (something to go back on the tax rolls); and the need for overflow parking (on court days parking is a challenge). It vas felt that there would not be a need for expansion in the future for additional jail fadlity. He indicated that the three court rooms are to be remodeled and the second floor may be expanded as court related. City Council Minutes November 14, 200 4.3 Veterans Clinic Page 3 Chair Schmiesing stated that there is not a budget pet for the veteran's clinic project and that Elk River is a potential site. He stated that the County and City need to continue to work, together and that the VA knows that these two entities wish to have this facility built here. Discussion followed regarding Allina's interest. Commissioner Engstrom stated that both the County and City passed resolutions of support to have this facility in our community and that these resolutions are on file in Washington. It was the consensus of the group that we need to continue tracking and to continue our joint efforts and move forward. 4.4 YMCA Recently, the City Council requested and subsequently reviewed data on the tax impact of funding S3 million or up to one-third of the construction of the YMCA either through a voter approved bond issue or through a lease purchase agreement. It has been the Council's understanding that the City's contribution is contingent upon County participation, as contributions from both are needed to fund the project. Mayor Klinzing stated that the i~Torthstax Community YIvICA ~vants a cooperative adventure and the City is willing to contribute one-third but that this would be towards construction costs and not in the form of endowment money. Bill Helliwell from the YMCA stated that two plans have been presented to the County Board and he apologized for not coming back and updating the City and that now he was asking for direction. Also present representing the YMCA were Tom LaSalle and Anita Lancello. Highlights of the discussion: ^ City's original premise was contribution of one-third from the City, one-third from the County, and one-third from the YMCA; ^ The County has not revisited this item since their work shop -contribution of ~12M plus land is a big investment; some reluctance and this is structured to have ongoing-annual expenses; ^ Scale would be based on membership; ^ If the City contributes one-third into brick and mortar that would cut down on the County's portion of ~~12M; ^ City feels there is a limited ability on their part to make this work and feel they are holding this project back and don't want to do that; ^ County feels they need to come up with a polity in order to be consistent and offer to the other cities; ^ ~4M plus land would be County's portion if cost is~~12M; ^ Concern if a referendum is done by the CitsT won't voters be confused if County doesn't go to referendum; ^ City of Elk River cannot afford S4M vrithout a referendum and contingency of County and YMCA coming forward; ^ County needs to discuss further since what was presented to them by the YMCA is different than discussed tonight; ^ Having a YMCA by the Government Center could also be used £or sodal services use and other benefits for the Count37; Cits~ Council Minutes November 14, 2005 Page 4 ^ The County employs 550 employees some residing in Elk River and some outside of Elk River; need to have equity for other areas of the County; ^ Felt it should not be a NO to Elk River; one-third of the County's population is here in Elk River with the other communities being served but also do need to continue to serve Elk River; ^ Need a polity that is equitable; ^ City also has land on the east side of toa7n if the County does not wish to donate land; ^ Future discussion needed as to the land portion and where to locate; ^ Suggested to have a timeframe; ^ The County will have on their agenda for discussion over the next 60 days; ^ YMCA will provide structuring information -how to service the bond, taa-exempt financing, how to collectively finance each third and pay off, etc. 4.5 Update on~oint Communication Projects Sheriff Bruce Anderson, Fire Chief Bruce West, and Police Chief Jeff Beahen gave an update on the progress of ongoing joint communication projects. Sheriff Anderson stated that money was available at one time from the government to fund the 800 megahertz radio system throughout the State, however, due to 9-11 and other catastrophes, this money has been pulled and distributed to the metro area. Three counties currently have this system. The counties of Stearns, Wright and Sherburne are working with MnDot and looking at the costs involved. Costs would be dependent on the number of towers and how many mobiles. They are working on a way to get this system without having to go to the taxpayers for funding but feel at this time that more facts are needed. Councilmember Farber stated that he is familiar with this system with his work for the City of Fridley and that he has never heard a negative comment. He stated that the radios can be used anywhere, can use any channel without static, and that it is the best system that he has seen in 26 years. Chief West stated that Northstar Line has aFire/Life Safety Committee which has started to meet to discuss the commuter rail. It is the committee's goal to have the 800 megahertz radio system in the County by the end of 2007 and that it is important with the Northstar Corridor Rail being built. Chief Beahen stated that as a member of the Northstar Corridor Rail we will be required to . be on megahertz by 2008 or that there could be the problem that we can't have commuter rail in our County. Sheriff Anderson disagreed stating that we will have portables that are megahertz. Discussion followed regarding lack of communication between the entities and that discussions need to take place prior to problems versus after problems exist. 4.6 Transportation Commissioner Leonard stated that she had been called by Mr. Miller in regards to County Road 33 expansion project and suggested that he attend this meeting. City Council Dlinutes '_voyember 14, 2005 Page 5 l~Ir. Miller explained that he has concerns thai with this expansion this road will be even more dangerous. He feels the people travel this road too fast now and that people ~vho are being affected aren't in the loop. He stated the only reason he is aware of what is going on is because cf a letter received in regards to right-of-way. County Attorney Heaney explained that because of litigation the County has to do reconstruction of roads up to State standards and these are the same issues with every road. She stated that as soon as the plans are finalized, a letter is sent. This is on a short timeline in order to get that road safe and to meet State timelines. She stated that concerned citizens should call her. County Public Works Director Menter stated that MnDot dictates the speed ]imits. Police Chief Beahen stated that he is pleased that the County is doing two feet of gravel on the shoulder and two 12 foot lanes with 8 foot shoulders and flattening end slopes. Councilmember Farber stated that he is glad that the County is addressing shoulders on the roads which make them safer. City Engineer Terry Maurer and County Public Works Director John Menter reviewed the following joint projects: Placement of bituminous trails within the county's roads right-of--way -the county will give as much lead time to the City as possible about upcoming County road construction projects; will put trail into their right-of--way or adjacent to right-of- u=ay; and if the trail cannot be accommodated at that time the County will still include a trail in their bid if the City secures additional right-of-way or easements. County Highway 40 reconstruction arith rural roadway construction funded entirely by the County; both entities desire to have a joint powers agreement to include public improvements in this project consisting of a=atermain, sanitary sewer, a detached trail, and a pedestrian culvert. City's responsibility will be to provide the design and project specifications for inclusion in the County Highway project and funding the cost of the improvements and associated overhead. Councilmember Dietz inquired as to what had happened with the turnback discussions and the plan to build an urban section. Commissioner Engstrom stated that the former county engineer had applied for additional federal funds, missed obtaining those funds and without those funds the County couldn't construct the urban section. ' Mr. Maurer stated that we went through 18 months of planning for the City to take this road back, applied for additional funds but had agreed to a formula for cost participation including federal funds that the County had already received and then split remaining costs between the City and County. He stated that he did minutes from each meeting that were distributed to the City Council and former county engineer but he felt these minutes were never distributed to the County Board. Chair Schmiesing stated that communication wasn't R=hat it should have been and that the County didn't have a policy in place regarding this issue. City Council Minutes November 14, 2005 Page 6 County Administrator Bensen stated that there had been bad communication -felt justification in not having had the full knowledge in that the Board was not comfortable; when turning a road back it's because it's a low use road; and when the City wished to build this road into an urban road this became a contradiction to the Board. Mr. Maurer stated in the future he is confident that the Counts= will communicate better with the City and inquire whether there will be a change from rural to urban and use their polity to determine who pays for the road. Sherburne County has let a contract to Bauerly Companies for the reconstruction of County Highway No. 1 from County Highway 32 to the north City limits. Parks and Recreation Director Maertz is working to include a detached trail in this right- of-way. ~ Sherburne County is working on the plans and specifications fox the ounty Highway 33 and 77 improvements. This is the area of County Highway 33 that is to be realigned through the gravel mining areas and then continuing along the existing alignment westerly to County Highway No. 1. One unresolved issue is the land acquisition costs for the portion of County Highway improvements between the railroad trail and County Highway No. 1. City staff was unaware until recently that this portion of County Highway 33 was included in this project. Discussion on the potential for future repayment of the costs of this right-of--way acquisition to be discussed at a quarterly Transportation Committee meeting. County Engineer Rhonda Lewis will continue with the land acquisition ofright-of--way to keep this project on schedule. The City will be working with the County on the design and both entities will look at a Joint Powers Agreement for city improvements in Counts= right-of--way. ~ Sherburne County has undertaken the project to reclaim and overlay the surface of COUntP H~hwav 44 from approximately Trunk Highway 10 to County Highway No. 1. City staff to determine the potential for a city-constructed detached trail within or adjacent to the County Highway 44 right-of-way. Mr. Maurer stated that the Parks and Recreation Commission would like to see a detached trail on all County roads within the City. ~ Sherburne County has asked the City to take back portions of existing County Highway 33 and County Highway 77 after the newly constructed road is completed in 2007. The roadways in question have had their surfaces reclaimed and have been newly overlaid in 2005. The City of Elk River will receive a small increase in Municipal State .Aid funding by the turnback of these roadways. The Council agreed to consider the turnback agreement at an upcoming Council meeting. ~ Sharp curves on County Highway 33 east of TH169. Police Chief Beahen distributed photographs taken of vehicles traveling over the line on these curves. The County Engineering staff has a conceptual layout of how County Highway 33 could be realigned in the future to meet up with County Road 22 in Anoka County reducing the traffic using these roads. Working with County staff and with Council direction, staff will submit a project request to eliminate these sharp curves. If the County is successful in obtaining Federal funds, the City will still be expected to acquire the necessary right-of-way. It was stated that amulti-jurisdiction application for federal funds with the number one issue of safety carries more weight with MnDot. • Easement agreement for access to the Jackson Avenue Fire Station -Due to the expansion of the Jackson Avenue Fire Station to allow for expanded ambulance City Council Minutes November 14, 2005 Page 7 service, the City does not have a ~vay to get into the ambulance bay without driving on County property. Sherburne County Engineering staff has agreed that this issue should be clarified. At present the City owns a piece of land behind a County building. An easement agreement will be drafted with the possibility of looking at an exchange of property to clean up lot lines of the two parcels. Quarterly Transportation meetings -both entities would like for these meetings to stazt up again monthly. Dates will be looked at after the first of the pear. Commissioner Leonard thanked Police Chief Beahen and Fire Chief ~Uest for their participation in obtaining funds for the Boys and Girls Club by remaining on the roof of Coburns until their goal for funds was reached. 5.
