Action Requested
The applicant is requesting a material change to an already approved Conditional Use Permit. The
request is specific only to the change of the material for the window awnings.
Staff and the Planning Commission recommend the City Council approve the Conditional Use Permit
request, as illustrated on drawings dated 11/05/07, with the following conditions:
1. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all
require permits.
2. All window awnings shall be of a metal standing seam material, as shown on revision
sheets "ASI 6 A1" - "ASI G A6"
3. The two north facade artificial windows shall be either metal or fabric.
4. All conditions, as approved on February 20, 2007, shall also be maintained.
Summary
The subject building (CUP and building materials) was approved on February 20, 2007 which included
fabric awnings above the windows. The applicant is requesting they be allowed to substitute the fabric
with metal standing seam roofing.
Planning Commission Discussion
The Planning Commission stated they had no issues with the request and that the metal awnings fit the
character of the building better. They said they were less concerned with the material type (if an
acceptable material) but just that the building had awnings.
The Planning Commission unanimously recommended approval of the request.
Public Comment
No one spoke at the public hearing.

Overview
The applicant is requesting a material change to an already approved Conditional Use Permit. The
request is specific only to the change of the material for the window awnings.
The subject building (CUP and building materials) was approved on February 20, 2007 which
included fabric awnings above the windows. The applicant is requesting they be allowed to
substitute the fabric with metal standing seam roofing. The building occupant would prefer to have
metal standing seam for its longevity characteristics, as fabric awnings would require more
maintenance.
Both fabric and metal are acceptable materials as designated by the design standards, so staff
recommends the Planning Commission recommend approval of the request.

7. Will not endanger, injure or detrimentally affect the use and enjoyment of other properly in the immediate
vicinity or the public health, safety, morals, comfort, convenience orgeneral avelfare of the neighborhood or the
czty.
2. Will be consistent avith the comprehensive plan.
3. Dill not impede the normal and orderly development and improvement of surrounding vacant property.
4. 1-Vill be served adequately by and avill not adversely affect essential public facilities and services including
streets, police and fire protection, drainage, refuse disposal, water and leaver ystems, parks and schools; and
will not, in particular, create tra~c congestion or interference avith traffic on adjacent and neighboring public
thoroughfares.
5. Will not involve uses, activities, processes, materials, equipment and conditions of operation that aarill be
detrimental to any persons or property because of excessive traffic, noise, smoke, fumes, glare, odors, dust or
vibrations.
6. Will not result in the destruction, loss or damage of a natural, scenic or historic feature of major importance.
7. Will fully comply aarith all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license orpermit to establish and operate the proposed use in the city.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the change from fabric awnings
to metal awnings is consistent with all of these standards.
