This would require some land being purchased or donated in the northwest corner of the fairgrounds property. If this were to take place, then other parking provisions and issues regarding the fair need to be addressed. The Land is needed by the City for the construction of • ~ the planned intersection of Orono Road and the new Joplin Street approximately 300 feet south of the entrance of Joplin Street to Trunk Highway 10. According to the Fair Board, the impact of the loss of the acreage is serious because it diminishes the area used for the midway carnival, one ~of the main attractions at the Fair. The Fair Board will need to accommodate their carnival contractor with a different layout for the midway or discontinue the event. Furthermore, the gate at that corner of the Fairgrounds serves at the main entrance,. both for the carnival vans and for all other functions at the Fairgrounds. Accordingly, the County Board respectfully submits the , following provisions for consideration by the City Council in reaching an agreement mutually acceptable to ail parties. 1. The County sells the 1.75 acres to the City at a fair market price, through a mutually acceptable appraisal, so that the intersection can be constructed in 1995. Special assessments will be paid by the City upon closing of the transaction and will not be deducted from the purchase price. 2. The City removes the fence west of the Fairgrounds/ball field parking area so that . the space for the midway is regained (by using the existing parking area). Parking for the ball fields is relocated. See below. 3. .The City provides fill, regrading, and seed cover for the parking area and,. the low ' area north of the grandstand and Fair office to prevent water paneling. The City allows the Fair Board to use the 4.74 acres at the old E and O Tool site for parking during Fair time from 1995 through 1999. Temporary lighting for security purposes is also provided during Fair timer S. The City allows the Fair Board to use the triangular shaped land parcel on the • southeast corner of the ball fields for parking during Fair time and for access to the parking area south of the belt fields from 1995 through 1999. 6. The County allows the City to use the Fairgrounds property south of the ball Selds for parking during ball games. 7. The County provides the City an opportunity to match any offer to purchase Fairgrounds property west and south of the Fairgrounds when the entire Fairgrounds parcel is placed on the market for safer 8. The City allows access to the Fairgrounds from the south (Orono Parkway), from • ~ the west (Joplin Street), from the east (see #5 above) and the entrances on the north not taken for the Orono Road connection are allowed to remain. 9. The City covers the cost of moving the fences and gates. This provision does not include cost of tabor. The existing fence can be reused, but some parts may need to be purchased. A budget will be established. 10. The City and County place the mutually acceptable stipulations in writing for future Councils or Boardsr 11. The City agrees that no further assessments are levied against the Fairgrounds property 12. The City and the Park Board agree that no ball tournaments will be scheduled during Fair time through 1999 without Fair Board concurrence. The above provisions are predicated on a future decision by the County that would accomplish one of the following alternatives: A. Before the conclusion of 1997, the County approaches the City with terms and conditions that would allow the Fair to continue at its current location indefinitely. B.
