Ach, City Planner DATE: March 20, 1995 SUBJECT: Request to Vacate Drainage and Utility Easements by Kraus Anderson of Elk River, Inc., Public Hearing, Case No. EV 95-1 Issue Consider Resolution 95- vacating drainage and utility easements within Elk Park Center, Planned Unit Development, to accommodate relocation of utility lines. Similar to a request that was presented to the City Council on October 3, 1994, the developers of Elk Park Center are requesting to vacate certain drainage and utility easements to accommodate the slight adjustment • to the utility improvements within the plat. The location of the easements to be vacated are illustrated on Exhibit A. With the vacation of the described easements, Kraus-Anderson will also be granting to the City the appropriate easements where the utility lines have been installed. These additional easements are shown on Exhibits B and C. Attachments Resolution 95- ,Exhibits A, B, and C, Quit Claim Deeds. Recommendation It is recommended the City Council approve Resolution 95-_ vacating the easements illustrated on Exhibit A with the condition the additional easements shown in Exhibit B and Exhibit C be granted to the City. council:KrausEV ITEM 7.2. Box 490 • Elk River, MN 55330 • (612) 441-7420 • Fax: (612) 441-7425 RESOLUTION 95 - RESOLUTION FOR THE CITY OF ELK RIVER A RESOLUTION FOR VACATING DRAINAGE AND UTILITY EASEMENTS WHEREAS, a majority of the property owners abutting the street, drainage, and utility easement have requested the City Council in a petition dated February 2, 1995, to vacate such easement according to law; and, WHEREAS, a public hearing was held on March 20, 1995, before the City Council at the Elk River City Hall on such petition after due published and posted notice had been given as well as personal notice to affected property owners on March 1 and March 8, 1995, and all persons interested were given an opportunity to be heard; and, WHEREAS, it appears that it will be in the best interest of the City to approve such petition. NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and the street, drainage, and utility easement described in the attached Exhibit A is hereby vacated with the following conditions stated below: 1. This realignment will bring the road further west along the boundary of the cemetery, which will then allow for full left turn movements at the intersection with Jackson Avenue. CML ENGINEERING We have also included iri the change order some construction activities iri the median cross- ENVIRONMENTAL over of the Jackson/193rd intersection with TH 169. We have proposed t0 add these ~NICIPAL activities at this time since the urbanization of that median cross-over will be completed by ~.ANNING adding concrete islands where the center signal installations are, which will be fundable SOIiD WASTE through the Municipal State Aid turnback monies. If this work is not completed now, we STRUCTURAL may lose the opportunity for such funding. Therefore, we are recommending that Change suevEYING Order No. 3 be considered at this time. TRAFFIC TRANSPORTATION The estimated cost of the realignment of Holt Avenue is $46,550.81.
