RE: MAIN STREETIEVANS AVENUE INTERSECTION DRAINAGE IMPROVEMENTS Dear Council Members: As you may be aware, the Sherburne County Board approved the City's petition to outlet CIVIL ENGINEERING into County Ditch 10 at their regular meeting on Tuesday, March 7, 1995. Approval of ENVIRONMENTAL this petition was necessary for the drainage improvements on both the east and west sides MUNICIPAL of TH 169. Plans and specifications for the improvements on the east side generally NNING draining the County Road 12/13 area have previously been prepared and bids opened. 't'hat ~IOwASTE contract was awarded contingent on this final petition approval; therefore, that project is sTRUauaAE ready to move forward. SURVEYING TRAfF"~ The plans and specifications for improvements on the west side, which consist of the TRANSPORTATION draining of the Main Street and Evans Avenue intersection easterly to County Ditch 10, have not been authorized at this time. Previously, a study was prepazed indicating how this ELECTNICAE/MECHANICAL ENGINEERING: drainage could be accomplished, but no plans were authorized due to the need for the HVAC petition from the County. Since this petition has now been approved, the City is at a point PowER rnsTRleurloN where you can move forward with these improvements at this time. Therefore, attached SCADA for your consideration is a resolution which would authorize the preparation of plans and SYSTEM CONTROLS specifications for these drainage improvements.. Steve Rohlf has spent time over the last several months working with Mr. Earl Hohlen and his attorney, John McGibbon, discussing the potential realignment of County Ditch 10 on the Hohlen property. It appears that Mr. Hohlen is prepared to provide the City with easements and all other necessary cooperation to accomplish these improvements. If the City Council adopts the attached resolution authorizing plans and specifications for these improvements, we would be prepazed to continue negotiating and working with Mr. Hohlen to get the realignment of County Ditch 10 accomplished on his property. Minnesota: 1. The Main Street/Evans Avenue Intersection Drainage improvement is hereby ordered as recommended in the Preliminary Design Report dated October 20, 1993. 2. MSA, Consulting Engineers is hereby designated as Project Engineer for this improvement. The Project Engineer is directed to prepare plans and specifications for the • making of the improvement and the solicitation of competitive bids. Passed and adopted this 20th day of March, 1995. N The 2.67 acre parcel (Parcel A) has a wetland located in the middle of the parcel. Please njote the attached site plan for the wetland area. There appears to be ade~uate room to construct a house and show 2 septic locations without impacting the wetland. However, in an effort to protect the wetland, staff is recomme ,ding that a drainage and utility easement be applied over the wetland area'',to protect this site. In addition, the easement will send a clear message to Future owners of the property that a wetland or "unusable" area is present. Both Parcel A and Parcel B are, for the most part, open with very few trees associated with either parcel. Therefore, a tree protection plan is not necessary w,`ith this proposal. The Park and Recreation Commission reviewed this proposal at their March 8, 1995, meeting end recommended a cash payment of $450.00 be added as a condition of approval. • Surface Water ll~anagement Impact Fee In order to remain consistent with past administrative subdivision requests, a surface water management impact fee of $61.80 for parcels without city services should al~o be a condition of approval. Fees Due to the fact th'~at both parcels are currently vacant the City does have the option of charging park dedication fees and surface water management fees on both parcels. ',The City has not done this in the past for administrative subdivisions where a home is located on one of the parcels, however, the option does exist if the Council feels it is warranted due to the fact that both parcels are vacant. Staff recommends that the City Council approve the administrative subdivision request by Art Peterson to divide a 18.96 acre parcel into a 16.29 acre parcel and a ~~~.67 acre parcel with the following conditions: C] s:council:as95-02 • 1. A drainages and utility easement be granted to the City over the existing wetland on Parcel A. 2. Payment of park dedication fees in the amount of $450 be paid to the City prior tp recording. 3.
