Background
Riverside Development originally requested a preliminary plat for
approximately 40 acres to be divided into 88 single family lots. This
preliminary plat was approved by the City Council on August 1, 1994, along
with a conditional use permit for a residential planned unit development. The
developer is now requesting to final plat 14 lots as Hillside Estates 4th
Addition. The balance of the preliminary plat will be finalized in future
additions as demand arises.

• Analysis
The proposed Hillside Estates 4th Addition is, for the most part, consistent
with the preliminary plat approved by the City Council. The 4th Addition is
generally located north of 193rd along Auburn Street extending north to the
City's water tower site.
There are three outlots identified in the final plat:
• Outlot A -This outlot is the location of the City's water tower and will be
deeded to the City upon recording the final plat.
• Outlot B and Outlot C -These two outlots provide for future extension of
proposed roads, as well as the platting of two additional residential lots.
These outlots are consistent with the preliminary plat.
Lot 5. Block 3
As mentioned in staff's memo to the City Council dated July 18, 1994, several
lots were identified throughout the preliminary plat which presented some
concern based on either their shallow depth or substandard lot width. Lot 5
of Block 3 in the proposed final plat happens to be one of the lots identified
that will have a lot width less than the minimum Rlc standards. This
particular lot will eventually be a corner lot when Outlot C is replatted;
therefore, the minimum lot width should be 100 feet. Since Lot 5 is located
along a curve in the street, the actual lot width would be determined at the
30 foot front yard building setback. Currently, the lot width at the required
setback is 90 feet, 10 feet less than the 100 foot requirement for Rlc
developments. However, the planned unit development zoning designation
allows for some flexibility to the rigid design standards found in a traditional
zoning district. This flexibility is at the Council's discretion in approving the
final plat.
Street and Utility Improvements
Some of the street and utility improvements have already been completed by
the developer to serve the 4th addition. Construction of the water tower in
the Hillside area provided an "opportunity" for the developer to make
additional improvements along Auburn Street. Although it is not "common"
practice to complete improvements prior to final plat approval, the developer
in this case was willing to make those improvements at their own risk. The
remaining improvements will be secured and covered under a developers
agreement.

Recommendation
It is recommended that the City Council approve Resolution 95-_, approving
final plat for Hillside Estates 4th Addition with the conditions outlined in
Exhibit B.

FINAL PLAT REVIEW
Dear Mr. Ach:
•
As you requested, we have reviewed the final plat for the Hillside Estates 4th Addition.
The plat was prepared by fIakanson Anderson Associates, Inc. Based on our review, we
would offer the following comments.
1. Since the Auburn Street road will be constructed to the north end of this plat, in fact
the curb and gutter and gravel base are akeady in place and paving will take place
Later this spring, we .would suggest that Outlots B and C be provided with a
drainage and utility easement across the front of them. It appears that these lots will
be replatted in the. future as additional lots and extensions of .future streets, -but since
the road is currently being constructed adjacent to them, it would be appropriate to
include the drainage and utility easements at this time.
2. Lot 5, Block 3, is substandard in width. In the future, a road will be constructed
through Outlot C, making Lot- 5 a corner lot. According to the City ordinance, a
.corner .lot needs a frontage of 100 feet. The current width of 74.87. feet is
substandard by over 25 feet.
3. The grading plan for this plat shows rear yard drainage through Lots 1, 2, 3, and
4 of Block 3, which does not follow the rear drainage easement. The grading plan
indicates a flow through the middle backyard area. Either the grading plan needs
to be revised to get this drainage to the rear easement area, or additional easements
need to be provided across these four lots to facilitate this drainage pattern.

CITY OF ELK RIVER
A RESOLUTION GRANTING FINAL PLAT APPROVAL FOR:
HILLSIDE ESTATES 4TH ADDITION
WHEREAS, application has been made for final plat approval, pursuant to
Section 1008.08 (1)(c) of the Elk River City Code of Ordinances, of the property
legally described on attached Exhibit A and hereinafter referred to as °the
Property'; and
WHEREAS, the application for preliminary plat approval has been referred
to the Planning Commission which has given its advice and recommendation to
the City Council; and
WHEREAS, a preliminary plat of the Property was approved by the City
Council on August 1, 1994; and
WHEREAS, the proposed final plat is consistent with the preliminary plat •
as approved by the City Council; and
WHEREAS, the proposed final plat complies with each of the conditions
set forth by the City Council in its approval of the preliminary plat of the Property;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ELK RIVER, as follows:
1. It is hereby determined by the City Council for the City of Elk River as
follows:
A. The proposed subdivision is consistent with the Zoning Ordinance
and conforms with all of its requirements.
B. The proposed subdivision is consistent with all applicable general
.and specialized city, county, and regional plans including, but not
limited to, the City's Comprehensive Development Plan.
C. The physical characteristics of the site, including ,but not limited •
to, topography, soils, vegetation, susceptibility to erosion and
• siltation, susceptibility to flooding, and drainage are suitable for the
type and density of development and uses contemplated.
Q. The proposed subdivision makes adequate provision for water
supply, storm drainage, sewage transportation, erosion control and
all other services, facilities and improvements otherwise required
herein.
E. The proposed subdivision will not cause substantial. environmental
damage.
F. The. proposed subdivision will not conflict with easements of record
~or with easements established by judgment of a court.
G. The proposed subdivision will not have an undue or adverse impact
on the reasonable development of neighboring land.
2. Final plat approval is hereby granted for the Property, subject to the
conditions set forth in attached Exhibit B.
3. The officers of the City are hereby authorized, once the conditions set
• forth in Exhibit B are met and .complied with, to sign the final plat for the
Property and to issue a certified. copy of this Resolution giving final
approval of the plat.
4. The owner of the Property is authorized to record the final plat as required
by law and shat! fife proof of said recording with the City, No building
permits wilt be issued for the Property until the final plat is recorded.
5. This final plat approval shall expire two years from the date of this
resolution if the final plat is not recorded within that time..

EXHIBIT B
1. A Developer's Agreement be prepared and executed prior to releasing the

2. Comments from City Engineer's memo dated April 26, 1995 be
incorporated into the f=inal Plat
3. Payment of park dedication in the amount of $7,000 be paid prior to
releasing the Plat for recording.
4. Street lights be provided throughout the. Plat as required by Elk River
Utilities.
5. Payment of storm. drainage impact fee in the amount of $1,730.40 prior to
releasing Final Plat for recording.
6. Payment in the amount to be determined by the City Engineer be made to
the City to cover the cost of sealcoating the streets.
7. A complete development plan be submitted for City review and approval
prior to issuance of any building permits.
8. Outtot A (water tower site) be deeded to the City.
9. The necessary drainage and utility~easements be provided throughout the
plat as recommended by the City Engineer.
10. On those lots which are wooded, a tree protection plan be submitted
along with each building permit.
11. The conditions for granting the Planned Unit Development be

City Planner Steve Ach indicated that Riverside Development has requested to
.rezone approximately 40 acres from R 1 e single family residential) to PUD
(Planned Unit Development). The .location of the proposed rezoning is between
193rd Avenue and 197th Avenue east of the Baldwin Street alignment. Steven
Ach indicated that the request to rezone the property to a PUD is consistent with
the land use map for the surrounding area. He further stated that the Planning
Commission reviewed the request and recommended approval.
Vice Mayor Farber opened the public hearing
Scott Darsie, neighboring resident, questioned why the area was being rezoned
from residential to a PUD. He further questioned the future plans for the property
south of the proposed rezoning. Mr. Darsie questioned the definition of a PUD. He
indicated he felt it would be bes# to develop a plan for the entire area. Mr.
Darsie further indicated that he had a concern with the size of lots being created
in the PUD as the lot lines wiN not line up with his lot line and. he may have more
than one neighbor abutting his lot.
Steve Ach explained the definition of a PUD. He further indicated that the City
cannot rezone the parcel south of the proposed parcel being rezoned until a
reques# for rezoning, along with plans for development, is submitted to the City.
Dave Burrandt, indicated support of the new development. He further stated he
was encouraged to hear that there will be no multiple housing with the PUD.

Vine Mayor Farber questioned the amount of land that wilt be dedicated foc park
dedication to the City.
Many Clines stated that the proposal is to dedicate 3.9 acres of land to the City
for park. purposes and further to deed an easement to the City.

City Planner Steve Ach indicated that Riverside Development is requesting a
preliminary plat to subdivide approximately 40 acres into 88 single family lots. He
stated that Riverside Development is also requesting a conditional use permit to
develop a residential Planned Unit Development. The PUD is an extension of the
.Hillside Estates residential development along 193rd Avenue. Steve .Ach
indicated that the property has some physical constraints including utility •
easements and wetlands. He further stated that an EAW Environmental
Assessment Worksheet) is being prepared for the plat.
Discussion was held regarding park dedication for the plat. It was indicated by
Dana Anderson, Park and Recreation Commission representative, that the
Commission has recommended a trail system in the plat. Discussion wtls held by
the Council regarding the issue of the trails located along the back of the .lots as
recommended by the Park and Recreation Commission.
Councilmember Scheel and: Vice Mayor Farber indicated their desire to see a trail
along the roadway as opposed to back yard trails. Councilmember Scheel
indicated that back yard tails were an invasion of privacy and could lead fio
burglary. Vice Mayor Farber stated he felt that trails along major roadways. would
be used more than trails along back yards. Discussion was held as to whether or
nqt a trail along the roadway would require additional right-of-way or if it would
be considered as park dedication.
Dan Tveite, Planning Commission Representative, stated that the Planning
Commission recommended approval of the conditional use permit and
preliminary plat.
There being no further comments from the public, Vice Mayor Farber closed fihe
public hearing.

7.5. Consider Preliminary Plat request for Country Crossing 2nd Addition by Country
Ridge Partnershigj PH. Case Np. P 94-08
City Planner Steve Ach indicated that Country Ridge Partnership has. requested a
preliminary plat to subdivide approximately 41 acres into 59 single family lots and
two outlots. The location of the proposed plat is the northwest corner of County
Road #30 and the Joplin Street extension. Steve Ach indicated that the City staff
has reviewed the plat and recommends approval with 14 condi#ions. ,
Vice Mayor Farber opened the public hearing.
Discussion was held by the Council regarding the pond and whether or not it
should be fenced. Councilmember Scheel s#ated she felt that the pond should
be fenced #or safety reasons. Councilmember Dietz indicated that he was
concerned that perhaps a fence could be more of a .hazard than no fence.
Councilmember Holmgren indicated he would prefer to see trees rather -than a
fence.
After further discussion regarding fencing, it was the consensus of the Counci! that
the developer and staff work on the issue of fencing and .that the issue be
.addressed in the final plat.
There. being no further comments from the public, Vice Mayor. Farber closed the
public hearing.

City Planner Steve Ach stated that the City Council reviewed the conditional use
permit and preliminary plat at the July 18, 1994, City Council meeting. At that
meeting the Council discussed the appropriate park, trail and sidewalk needs for
Hillside Estates 4th Addition. Following Council discussion at that meeting, the
issue was tabled to ollow the Park and Recreation Commission to further review
the park and trail issues. He .further stated that the Park and Recreation
Commission met to discuss this issue on July 26, 1994, and have made the
following recommendations:

Ths Planning Commission and City Council require future plats in the sewer
pnd water district to contain sidewalks. and bicycle lanes for safe non-
motorized transportation on streets that carry other than neighborhood
traffic.
.The City assume ownership of the Northern Natural Gas line easement and
the NSP power line easement in Hillside Estates Development.
Auburn Street from the south plat boundary to 196th Avenue, 196th
Avenue from Auburn Street to Zane Street, and Zane Street from 19bth
.Avenue to 197th Avenue have a 7Q foot right of way with a 6 foot wide
diamond lane for bicycle traffic added to the street width between the
curbs on the east side of Auburn Street, the south side of 196th Avenue,
and the east side of Zane Street, in lieu of the rear yard trail previously
proposed paralleling Auburn Street.
The dedicated.. park area described in the 6/27/94 Park and Recreation
minutes remain as previously requested should the 33 foot wide trail on the
east side of the Northern Natural Gas fine easement
Mayor Duitsman opened the public hearing.
Mayor Duitsman indicated that he does.not support a 70 foot right-af-way.
Jeff Gongoll, indicated that he agrees with Staff's recommendations listed in the
Staff report.
• Councilmember Holmgren questioned whether the park dedication requirement
would be satisfied. Steve Ach indicated that the requirements for park
dedication are satisfied through the 3.9 acre of park. land and the corridor along
the eastern portion of the plat.
Dana Anderson, Park and Recreation Commission Representative, explained the
reasoning for recommending a trail along Auburn which connecfs to the 3.9
acres of park fond. He indicated that this trail would move the people within the
plat to the park.
Manly Glines of Riverside Development, indicated that the proposed trails in the
plat are consistent .with the City's 1988 Growth Management Plan. He further
indicated that the plan eliminates the need to cross any driveways in the plat.
There being no further comments from the public, Mayor Duitsman closed the
public hearing.
The City Council discussed the park, trail, and sidewalk options.. It was concluded
that Riverside Development satisfy their park dedication requirements by
dedicating 3.9 acres for park land and a trail comdor along the east limits of the
plat.
