Analysis
Subject property (Outlot A) was originally platted as an outlot through the
plat of Hillside Estates 3rd Addition. Outlot A was encumbered with
drainage and utility easements around the entire perimeter, even though the
outlot is an unbuildable parcel due to the outlot status. Riverside
Development is proposing to plat Hillside Estates 4th Addition immediately
to the north of the subject site. A component of platting Hillside Estates 4th
Addition is to add land from Hillside Estates 4th Addition to outlot A of
Hillside Estates 3rd Addition to create a buildable parcel. Through platting
Hillside Estates 4th Addition, drainage and utility easements will be placed
back on the buildable parcel to maintain the necessary easements around the
• subject property.

• Recommendation
It is recommended that the City Council approve the vacation of drainage
and utility easements on Outlot A of the Hillside Estates 3rd Addition.
Attached is a resolution specifying the easements to be vacated.

RESOLUTION 95 -
• RESOLUTION FOR THE CITY OF ELK RIVER
A RESOLUTION FOR VACATING DRAINAGE AND UTILITY
EASEMENTS
WHEREAS, a majority of the property owners abutting the drainage and utility
easement have requested the City Council in a petition dated
February 21, 1995, to vacate such easement according to law; and,
WHEREAS, a public hearing was held on May 15, 1995, before the City Council
at the E!k River City .Hall on such petition after due published and
posted notice had been given as well as personal notice to affected
property owners on April 27, 1995, and .all persons interested were
given an opportunity to be heard; and,.
WHEREAS, it appears that it will be in the best interest of the City to approve
such petition.
NOW, THEREFORE, BE IT RESOLVED that such petition is hereby granted and
the drainage and utility easement described as follows is hereby
vacated with the fo lowing conditions stated below:
Outlot A, Hillside Estates 3rd Addition
1. The necessary drainage and utility easements be re-
established and made part of the Hillside Estates 4th
Addition Plat.
Adopted by the Elk River City Council this 15th day of May, 1995.
