SUBJECT: Administrative Subdivision Request by
Joyce Mickelson, Public Hearing Case
No. AS 95-04
Request
Joyce Mickelson is requesting an administrative subdivision to divide a 43.63
acre parcel into a 6.18 acre parcel (Parcel A), and a 37.45 acre parcel (Parcel
B). Both parcels have access to public roads.
• Location
South of 217th Avenue, immediately west of County Road 32 (Meadowvale
Road). Part of the west half of the Southwest Quarter of Section 7, Township
33, Range 26, Sherburne County, MN.

Background
The property is zoned R1a which requires a minimum lot size of 2-1/2 acres
with 160 feet of frontage on a public road. The applicant is proposing to
create a 6.1 acre (Parcel A), and 37.45 acre parcel (Parcel B). Each lot will
meet or exceed the minimum requirements in terms of lot size and width in
i the R1a zoning district. There is currently a farm located on proposed Parcel

• B, however, Parcel A at this time is vacant. Parcel A will have access onto
217th Avenue, which is a county road. The Sherburne County Engineer's
office has been notified of this request and they do require an additional 17
feet of right-of--way along 217th Avenue and County Road 32.
Natural Features
The 6.1 acre parcel (Parcel A) has a wetland located on the west half of the
parcel. Please note the attached site plan for the wetland area. There
appears to be adequate room to construct a house and show two septic
locations without impacting the wetland. However, in an effort to protect this
wetland, staff is recommending that a drainage and utility easement be
applied over the wetland area to protect this site and send a clear message to
future owners of the property that a wetland or unusable area is present.
Both Parcel A and Parcel B are, for the most part, open with very few trees
associated with either parcel. Therefore, a tree protection plan is not
necessary with this proposal.
Park Dedication
The Park and Recreation Commission reviewed this proposal at their May
10, 1995 meeting and recommended a cash payment of $500 be added as a
• condition of approval. This park dedication will be applied to the new parcel
being created.
Surface Water Management Impact Fee
In order to remain consistent with past administrative subdivision requests,
the surface water management impact fee of $61.80 for parcels without city
services should also be a condition of approval.
Recommendation
Staff recommends that the City Council approve the administrative
subdivision request by Joyce Mickelson to divide a 43.63 acre parcel into a
6.1 acre parcel and a 37.45 acre parcel, with the following conditions:
1. A drainage and utility easement be granted to the City over the
existing wetland on Parcel A and B.
2. Payment of park dedication fees in the amount of $500 be paid to the
City prior to recording.
