East 1/2 of the NE 1/4, of Section 14, Township 32, Range 26, Sherburne County, Minnesota. A general description is immediately east of the NSP RDF facility on the south side of 165th Avenue. In conjunction, Cargill is also proposing to produce approximately 600 additional "feeder pigs" (pigs under 501b.) per year (about 200 one time capacity). However, the overall number of pigs on site will decrease due to a substantial decrease in the number of finishing pigs (pigs 501bs. - 2501bs.) Feedlots are considered a conditional use permit in the R1A zoning district. Cargill has not obtained a conditional use permit for their existing feedlot, because they were not aware it was required and have never been approached by the City as to this requirement previous to now. The conditional use permit would bring their existing facility into conformance with city code. The Cargill Animal Nutrition Center was established in Elk River in 1958. Cargill currently owns approximately 980 acres of land around the farm complex. The animal nutrition center is used by Cargill to provide research capabilities for animal nutrition including swine research, dairy research, beef research, and also feed ingredient preservation research. The Cargill Animal Nutrition Center currently employs approximately thirty-five people to conduct research, care for animals, maintain facilities and harvest crops. The details of this request are in the attached Apri125, 1995 memo to the • Planning Commission. Planning Commission Meeting At the April 25, 1995 Planning Commission meeting, the Commission concurred with staff's findings and recommended approval of the conditional use permit for their existing feedlot operation. Recommendation Staff and the Planning Commission recommend approval of the conditional use permit by Cargill to expand their existing swine research capabilities and for their existing feedlot with the following conditions: 1. That the applicant meet all the requirements as set forth in the feedlot permit from the Minnesota Pollution Control Agency. 2. That trees be planted along 165th Avenue near the security fence to act as a visual enhancement to the farm site. 3. Analysis As I mentioned earlier, Cargill is proposing to upgrade their swine research capabilities. The improvements will consist of removing seven buildings and replacing those buildings with six new buildings which will be compacted in a more defined area and connected by a covered walk-way system. The following paragraphs will highlight the key issues related to this request. Existin~/Proposed Buildings The existing buildings used to accommodate the swine research area are a mixture of building types constructed between 1958 and 1976.. Some of the buildings are open on one side, which does little to contain odors. The proposed buildings will be fully enclosed modern facilities, which will better contain odors as well as providing an optimal year round animal environment. The six proposed buildings will be located approximately 30 - 70 feet apart from one another and will be interconnected by an enclosed corridor. The entire swine complex will be fully fenced to provide additional safety. The new buildings are proposed to be low profile, one story, metal skin buildings. If this proposal is approved, a condition should be added that the buildings be painted to match the recently constructed laboratory. The buildings will consist of a farrowing area, office, nursery, finisher, breeding/gestation, and feed dock. • cu95-05-planning/pc • • Memo to Planning Commission April 17, 1995 Number of Animals Page 3 With the proposed updating of the swine buildings, Cargill is also proposing to decrease the overall number of pigs kept at the facility. The following table highlights the proposed changes. Cargill has already received approval of the upgraded feedlot permit from the Minnesota Pollution Control Agency. Through the permit the MPCA does set conditions on the application rate of manure to the surrounding property and for general environmental conditions such as release to public waters, etc. Waste Management In conjunction with the improved swine facilities, Cargill is also proposing to upgrade their waste management system. Currently, manure is handled through three systems. Approximately 25% of waste is handled as a solid and is spread on the fields weekly. Approximately 25% of the waste is handled as a liquid pumped from pits under some of the swine buildings. The remainder is handled as a liquid drained from the buildings to three lined earthen basins. The proposed system would enable all the manure to be handled as liquid through the earthen basins. The upgrade would reduce the frequency of land spreading, thus, better odor control with less agitating of the waste. Earthen basins also allow for better timing of when to spread the liquid waste, thus eliminating spreading of any swine waste on frozen ground. Rainwater caught in the basins would also assist in dilution of waste, further reducing the odor potential. Due to the fact that the number of swine will actually be decreasing with this proposal, staff feels comfortable that the proposed earthen basin upgrade will be sufficient to handle the manure load. cu95-05-planning/pc Memo to Planning Commission April 17, 1995 Landscaping Page 4 Although the Cargill Animal Nutrition Center is isolated at this time, growth is expected to occur in the surrounding area. In an effort to plan for the future growth staff would recommend that if this proposal is approved a condition should be added requiring that trees be planted along 165th Avenue to act as a visual enhancement to the farm. I have discussed this idea with Cargill and planting trees is in their future plans; therefore, they are in agreement with the proposed condition. Recommendation Staff recommends approval of the conditional use permit by Cargill to expand their existing swine research capabilities and for their existing feedlot with the following conditions: 1. That the applicant meet all the requirements as set forth in the feedlot permit from the Minnesota Pollution Control Agency. 2. Washwater from the feed mill will be stored in the 50' x 100' x 6' earthen holding basin. Manure will be stored in the two {2) remaining earthen holding basins. Manure from the animal feedlot will be used as fertilizer which shall be removed from the feedlot facilities at least once per week and applied to i 140 acres of crop land. The owner of the feedlot shall abide by the following special condition(s): 1. The application rate of manure shall not exceed the recommended crop nutrient requirements; and 2. This Certificate. of Compliance is issued to you in lieu of an animal feedlot permit because your facility dces not constitute a potential pollution hazard. Please be advised that should your facility become a potential pollution hazard in the future, you will have to reapply for an animal feedlot permit. Furthermore, should you increase the number of animals at-your facility to a point requiring a construction invest~aent, should you change the ownership of your facility or should you change your proposed method of storing, handling, utilizing or disposing of animal manure, you .are required to reapply for an animal feedlot permit. 2.
