SUBJECT: Conditional Use Permit for Mineral
Excavation by the Shiely Company/
Public Hearing Case No. CU 95-04
The Shiely Company is requesting a conditional use permit for mineral
excavation. As the Council will recall, Northern Con-Agg initiated this
request and then sold their property in Elk River to the Shiely Company. A
site plan is attached to this memo showing the location of the affected
property.
This issue was in front of the City Council on their April 17, 1995, meeting.
It was tabled at that time until staff could work out language that would
allow hours of operation outside the normal hours for unique situations. A
revised conditional use permit is also attached to this memo. Condition #12
titled "hours of operation" reflects this new language. By staff having to
approve additional hours, the City will be able to monitor potential problems.
