Subject: AUTHORIZATION FOR POLICE DEPARTMENT TO
CHARGE IMPOUND FEES
Over the past year, the police department has impounded several
vehicles for drug/alcohol related arrests where forfeiture of the
vehicles by the police was possible. To date, we have five (5)
vehicles impounded at the Elk River City Street Department within
their fenced lot.
It appears that all five of these vehicles will become the property
of the City of Elk River. When all legal requirements are met, we
will obtain Certificates of Title and sell most of these vehicles
by a bidding process.
Two (2) of the above vehicles are pickups and Street Superintendent
Phil Hals has expressed an interest in them for their department
use. I have indicated to Phil that I thought that would be a good
use for them.
• There are occasions, however, when we are not (for whatever reason)
authorized to forfeit a vehicle. When this happens, we charge a
ten dollar ($10) per day impound fee. This fee, when received, is
deposited in the general fund.
To make the impound fee official, I am requesting that the City
Council, by motion, authorize the police department to charge a
daily impound fee of ten dollars ($10) for vehicles held at the
street department fenced in lot.
