Action Requested
Staff recommends that the Planning Commission recommend approval of the Conditional Use
Permit request to allow up to three rental trucks on site, as illustrated on drawings dated December
5, 2007, with the following conditions:
1. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all
require permits.
2. No more than 4 rental trucks/ trailers shall be parked on the property.
Background/Discussion
Elk River Farm Supply is located on Highway 10 in downtown Elk River, historically known as the grain
elevator. The applicant would like to offer additional services to their customers by offering rental trucks.
The applicant proposes two to three rental trucks to be stored on site when not in use.

Conditional Use Permit
The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:
7. 1Vill not endanger, injure or detrimentally a~ect the use and enjoyment of other property in the immediate
vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the
city.
2. bill be consistent with the comprehensive plan.
3. Dill not impede the normal and orderly development and improvement of surrounding vacant propery.
4. IP>ill be served adequately by and will not adversely a~ect essential public facilities and serrrices including
streets, police and fire protection, drainage, rrfuse disposal, water and sewer Systems, park,.c and schools; and
will not, in particular, create traffic congestion or interference with tra~ic on adjacent and neighboring public
thoroughfares.
5. tYlill not involve uses, activities, processes, materials, equipment and conditions of operation that will be
detrimental to any persons or properly because of excessive traffic, noise, smoke, fumes, glare, odors, dust or
vibrations.
6. Weill not result in the destruction, lass or damage of a natural, scenic or historic feature of major importance.
7. lYlill fully comply with all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license or permit to establish and operate the proposed use in the city.

If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the request is consistent with all
of these standards.
Overview/Analysis
The Elk River Farm Supply is requesting approval to allow three to four Budget Rental trucks for
their business. The C-3 Zoning district allows equipment rental businesses by way of Conditional
Use Permit. They would offer the renting of the trucks to their customers and store the trucks on
site when not in use.
Elk River Farm Supply is located in downtown Elk River in between Highway 10 and the Rail Road
tracks next to the city parking lot. According to the site plan the proposed Budget truck parking is
on either side of the existing garage, which would have one truck visible from Highway 10.
Outdoor storage is present along Highway 10 in this area of town. Grand Rental Station is southeast
of the subject site with outdoor storage visible from Highway 10.
This property is within the downtown study area. While there is no moratorium, any new activity
before a plan has been finalized may be considered an impediment to redevelopment efforts.
Recommendation
Staff supports approval of the Conditional Use Permit as presented in this report.

Elk River Farm Supply is proposing to ad Budget Truck Rental service to our
customers. It would consist of positioning 3 to 4 trucks on our lot. We have ample room
to store them both in back of our building and in front. It will not require additional
employees, but would enhance our offerings to our customers.
This is a service that is not currently available in our community and we would
appreciate consideration of a conditional use permit allowing this service.
