Staff recommends that the City Council approve the Conditional Use Permit request to allow up to four
rental trucks on site, as illustrated on drawings dated December 5, 2007, with the following conditions:
1. As a conditional use permit is not a building permit, the applicant shall apply for all
required permits.
2. No more than 4 rental trucks/ trailers shall be parked on the property.
3. The applicant shall provide the City a survey of the property verifying the property
lines, prior to storing trucks outside.
Summary
Elk River Farm Supply is located on Highway 10 in downtown Elk River, historically known as the grain
elevator. The applicant would like to offer additional services to their customers by offering rental trucks.
The applicant proposes two to three rental trucks to be stored on site when not in use, with a maximum
of four. According to the site plan, the proposed Budget truck parking is on either side of the existing
garage, which would have one truck visible from Highway 10. Outdoor storage is present along Highway
10 in this area of town. Grand Rental Station is southeast of the subject site with outdoor storage visible
from Highway 10.
Planning Commission Discussion
The Planning Commission held a public hearing on January 8, 2008 for this request; no public comment
was made. The Commissioners questioned the location of the trucks and the number. The applicant
indicated he anticipates one to two trucks stored on the site at a time in hopes that the other trucks will
be rented. Commissioners had comments on the signage on the trucks; the applicant indicated the only
signage on the trucks would relate to Budget Rental, not Elk River Farm Supply. Commissioner
Anderson was opposed to the proposal due to lack of space on the site. The Commissioners were all
concerned about the trucks being stored on the property and not in the adjacent right-of--way.
In response to the right-of--way encroachment concern, staff added condition number 3 based on these
comments. The Planning Commission recommends approval as written with one member opposed.

Public Comment
There was no public comment at the meeting on January 8, 2008. One person came to the meeting late
and indicated to staff that he was opposed to the project and plans to attend the City Council meeting.
Staff has received a few galls in opposition of the proposal due to site space.

The issuance of a Conditional Use Permit can be ordered only if the use at the proposed location:

vicinity or the public health, safety, morals, comfort, convenience orgeneral avelfare of the neighborhood or the
city.

7. Wlill fully comply ~arith all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license orpermit to establish and operate the proposed use in the city.
If denial of such a permit should occur, it shall accompany recommendations ox determinations by
findings ox a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards fox CUP as outlined, it appears that the request is consistent with all
of these standards.
Overview/Analysis
The Elk River Farm Supply is requesting approval to allow three to four Budget Rental trucks for
their business. The C-3 Zoning district allows equipment rental businesses by way of Conditional
Use Permit. They would offer the renting of the trucks to their customers and store the trucks on
site when not in use.
Elk River Farm Supply is located in downtown Elk River in between Highway 10 and the Rail Road
tracks next to the city parking lot. According to the site plan the proposed Budget truck parking is
on either side of the existing garage, which would have one truck visible from Highway 10.
Outdoor storage is present along Highway 10 in this area of town. Grand Rental Station is southeast
of the subject site with outdoor storage visible from Highway 10.
This property is within the downtown study area. While there is no moratorium, any new activity
before a plan has been finalized maybe considered an impediment to redevelopment efforts.
Recommendation
Staff supports approval of the Conditional Use Permit as presented in this report.

Elk River Farm Supply is proposing to ad Budget Truck Rental service to our
customers. It would consist of positioning 3 to 4 trucks on our lot. We have ample room
to stare them both in back of our building and in front. It will not require additional
employees, but would enhance our offerings to onr customers.
This is a service that is not currently available in our community and we would
appreciate consideration of a conditional use permit allowing this service.
