Action Requested
Staff recommends that the Planning Commission recommend approval of the Conditional Use
Permit request, as illustrated on drawings dated 11 /05/07, with the following conditions:
1. As a Conditional Use Permit is not a Building Permit, the applicant shall apply for all
require permits.
2. All window awnings shall be of a metal standing seam material, as shown on revision
sheets "ASI 6 A1" - "ASI 6 A6"
3. The two north facade artificial windows shall be either metal or fabric.
4. All conditions, as approved on February 20, 2007, shall also be maintained.

Overview
The applicant is requesting a material change to an already approved Conditional Use Permit. The
request is specific only to the change of the material for the window awnings.
The subject building (CUP and building materials) was approved on February 20, 2007 which
included fabric awnings above the windows. The applicant is requesting they be allowed to
substitute the fabric with metal standing seam roofing. The building occupant would prefer to have
metal standing seam for its longevity characteristics, as fabric awnings would require more
maintenance.
Both fabric and metal are acceptable materials as designated by the design standards, so staff
recommends the Planning Commission recommend approval of the request.

7. lY/ill not endanger, injure or detrimentally affect the use and enjoyment of otherproperty in the immediate
vicinity or the public health, safety, morals, comfort, convenience orgeneral welfare of the neighborhood or the
city.
2. lY/ill be consistent with the comprehensive plan.
3. lY/ill not impede the normal and orderly development and improvement of surrounding vacantpropery.
4. Will be served adequately by and will not adversely a~ect essential public facilities and services including
streets, police and fire protection, drainage, refuse disposal, water and server ystems, parks and schools; and
will not, in particular, create tra~c congestion or interference with tra~c on adjacent and neighboring public
thoroughfares.
5. lY/ill not involve uses, activities, processes, materials, equipment and conditions of operation that will be
detrimental to any persons orproperty because of excessive traffic, noise, smoke, fumes, glare, odors, dust or
vibrations.
6. Will not result in the destruction, loss ar damage of a natural, scenic or historic feature of major importance.
7. lYlill fully comply with all other requirements of this Code, including any applicable requirements and
standards for the issuance of a license orpermit to establish and operate theproposed use in the city.
If denial of such a permit should occur, it shall accompany recommendations or determinations by
findings or a report stating how the proposed use does not comply with the standards set forth in
Section 30-654.
In the review of the standards for CUP as outlined, it appears that the change from fabric awnings
to metal awnings is consistent with all of these standards.
